| 7 | 7 | | relating to weight limitations for certain natural gas or electric |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 621.101(b-1), Transportation Code, is |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | (b-1) Notwithstanding any other provision of this section, |
|---|
| 13 | 13 | | a vehicle [or combination of vehicles] that is powered by an engine |
|---|
| 14 | 14 | | fueled primarily by natural gas or powered primarily by means of |
|---|
| 15 | 15 | | electric battery power may exceed the gross [any] weight limitation |
|---|
| 16 | 16 | | under this section for the vehicle by up to 2,000 pounds [an amount |
|---|
| 17 | 17 | | that is equal to the difference between the weight of the vehicle |
|---|
| 18 | 18 | | attributable to the natural gas tank and fueling system carried by |
|---|
| 19 | 19 | | that vehicle and the weight of a comparable diesel tank and fueling |
|---|
| 20 | 20 | | system], provided that the maximum gross weight of the vehicle [or |
|---|
| 21 | 21 | | combination of vehicles] may not exceed 82,000 pounds. |

| 22 | 22 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 23 | 23 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 24 | 24 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 25 | 25 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 26 | 26 | | Act takes effect September 1, 2023. |
