66 AN ACT
77 relating to weight limitations for certain natural gas or electric
88 vehicles.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 621.101(b-1), Transportation Code, is
1111 amended to read as follows:
1212 (b-1) Notwithstanding any other provision of this section,
1313 a vehicle [or combination of vehicles] that is powered by an engine
1414 fueled primarily by natural gas or powered primarily by means of
1515 electric battery power may exceed the gross [any] weight limitation
1616 under this section for the vehicle by up to 2,000 pounds [an amount
1717 that is equal to the difference between the weight of the vehicle
1818 attributable to the natural gas tank and fueling system carried by
1919 that vehicle and the weight of a comparable diesel tank and fueling
2020 system], provided that the maximum gross weight of the vehicle [or
2121 combination of vehicles] may not exceed 82,000 pounds.
2222 SECTION 2. This Act takes effect immediately if it receives
2323 a vote of two-thirds of all the members elected to each house, as
2424 provided by Section 39, Article III, Texas Constitution. If this
2525 Act does not receive the vote necessary for immediate effect, this
2626 Act takes effect September 1, 2023.
