| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. (a) In this section, "commission" means the |
|---|
| 12 | 12 | | Health and Human Services Commission. |
|---|
| 13 | 13 | | (b) The commission shall develop and implement a plan to |
|---|
| 14 | 14 | | ensure that each forensic state hospital bed that is funded to |
|---|
| 15 | 15 | | provide competency restoration services is brought online and |
|---|
| 16 | 16 | | providing those services not later than August 31, 2024. |

| 17 | 17 | | (c) Not later than January 1, 2024, the commission shall |
|---|
| 18 | 18 | | submit to each standing committee of the legislature with |
|---|
| 19 | 19 | | jurisdiction over state hospitals a report on the plan established |
|---|
| 20 | 20 | | by the commission under Subsection (b) of this section. |
|---|
| 21 | 21 | | SECTION 2. This Act expires December 1, 2024. |
|---|
| 22 | 22 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 23 | 23 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 24 | 24 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 25 | 25 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 26 | 26 | | Act takes effect September 1, 2023. |
