66 AN ACT
77 relating to the purchase of a vehicle on which a total loss has been
88 made by an insurer.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter E, Chapter 501, Transportation Code,
1111 is amended by adding Section 501.098 to read as follows:
1212 Sec. 501.098. TITLE NOT REQUIRED. Notwithstanding any
1313 other provision of law, a metal recycler or used automotive parts
1414 recycler may purchase from an insurer a vehicle on which a total
1515 loss payment has been made by an insurer without obtaining a
1616 certificate of title or salvage certificate for the vehicle if the
1717 following apply:
1818 (1) The vehicle is purchased from an insurer by a metal
1919 recycler or used automotive parts recycler solely for the purposes
2020 of recycling parts, dismantling or scrap.
2121 (2) The metal recycler or used automotive parts
2222 recycler submits to the department a form, prescribed and furnished
2323 by the department and posted on the department's publicly
2424 accessible Internet website, that contains the following:
2525 (a) The vehicle information, including year,
2626 make, model and vehicle identification number;
2727 (b) Insurer information;
2828 (c) Metal recycler or used automotive parts
2929 recycler information;
3030 (d) Anticipated method and date of final
3131 disposition of the dismantled vehicle;
3232 (e) An attestation by an authorized
3333 representative of the metal recycler or used automotive parts
3434 recycler that the vehicle is being purchased solely for the
3535 purposes of recycling parts, dismantling or scrap; and
3636 (f) A bill of sale that memorializes the transfer
3737 of the vehicle between the insurer and the vehicle salvage dealer.
3838 (3) The metal recycler or used automotive parts
3939 recycler does not begin the dismantling or destruction of a vehicle
4040 until two business days following the submission of the documents
4141 listed under paragraph (2).
4242 SECTION 2. This Act takes effect September 1, 2023.
