| 7 | 7 | | relating to the purchase of a vehicle on which a total loss has been |

| 8 | 8 | | made by an insurer. |
|---|
| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter E, Chapter 501, Transportation Code, |
|---|
| 11 | 11 | | is amended by adding Section 501.098 to read as follows: |
|---|
| 12 | 12 | | Sec. 501.098. TITLE NOT REQUIRED. Notwithstanding any |
|---|
| 13 | 13 | | other provision of law, a metal recycler or used automotive parts |
|---|
| 14 | 14 | | recycler may purchase from an insurer a vehicle on which a total |
|---|
| 15 | 15 | | loss payment has been made by an insurer without obtaining a |
|---|
| 16 | 16 | | certificate of title or salvage certificate for the vehicle if the |
|---|
| 17 | 17 | | following apply: |
|---|
| 18 | 18 | | (1) The vehicle is purchased from an insurer by a metal |
|---|
| 19 | 19 | | recycler or used automotive parts recycler solely for the purposes |
|---|
| 20 | 20 | | of recycling parts, dismantling or scrap. |
|---|
| 21 | 21 | | (2) The metal recycler or used automotive parts |
|---|
| 22 | 22 | | recycler submits to the department a form, prescribed and furnished |
|---|
| 23 | 23 | | by the department and posted on the department's publicly |
|---|
| 24 | 24 | | accessible Internet website, that contains the following: |
|---|
| 25 | 25 | | (a) The vehicle information, including year, |
|---|
| 26 | 26 | | make, model and vehicle identification number; |
|---|
| 27 | 27 | | (b) Insurer information; |
|---|
| 28 | 28 | | (c) Metal recycler or used automotive parts |
|---|
| 29 | 29 | | recycler information; |
|---|
| 30 | 30 | | (d) Anticipated method and date of final |
|---|
| 31 | 31 | | disposition of the dismantled vehicle; |
|---|
| 32 | 32 | | (e) An attestation by an authorized |
|---|
| 33 | 33 | | representative of the metal recycler or used automotive parts |
|---|
| 34 | 34 | | recycler that the vehicle is being purchased solely for the |
|---|
| 35 | 35 | | purposes of recycling parts, dismantling or scrap; and |
|---|
| 36 | 36 | | (f) A bill of sale that memorializes the transfer |
|---|
| 37 | 37 | | of the vehicle between the insurer and the vehicle salvage dealer. |
|---|
| 38 | 38 | | (3) The metal recycler or used automotive parts |
|---|
| 39 | 39 | | recycler does not begin the dismantling or destruction of a vehicle |
|---|
| 40 | 40 | | until two business days following the submission of the documents |
|---|
| 41 | 41 | | listed under paragraph (2). |
|---|
| 42 | 42 | | SECTION 2. This Act takes effect September 1, 2023. |
