 A BILL TO BE ENTITLED
 AN ACT
 relating to the purchase of a vehicle on which a total loss has been
 made by an insurer.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1.  Subchapter E, Chapter 501, Transportation Code,
 is amended by adding Section 501.098 to read as follows:
 Sec. 501.098.  TITLE NOT REQUIRED. Notwithstanding any
 other provision of law, a metal recycler or used automotive parts
 recycler may purchase from an insurer a vehicle on which a total
 loss payment has been made by an insurer without obtaining a
 certificate of title or salvage certificate for the vehicle if the
 following apply:
 (1)  The vehicle is purchased from an insurer by a metal
 recycler or used automotive parts recycler solely for the purposes
 of recycling parts, dismantling or scrap.
 (2) The metal recycler or used automotive parts
 recycler submits to the department a form, prescribed and furnished
 by the department and posted on the department's publicly
 accessible Internet website, that contains the following:
 (a)  The vehicle information, including year,
 make, model and vehicle identification number;
 (b)  Insurer information;
 (c)  Metal recycler or used automotive parts
 recycler information;
 (d)  Anticipated method and date of final
 disposition of the dismantled vehicle;
 (e)  An attestation by an authorized
 representative of the metal recycler or used automotive parts
 recycler that the vehicle is being purchased solely for the
 purposes of recycling parts, dismantling or scrap; and
 (f)  A bill of sale that memorializes the transfer
 of the vehicle between the insurer and the vehicle salvage dealer.
 (3)  The metal recycler or used automotive parts
 recycler does not begin the dismantling or destruction of a vehicle
 until two business days following the submission of the documents
 listed under paragraph (2).
 SECTION 2.  This Act takes effect September 1, 2023.
