| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Chapter 38, Penal Code, is amended by adding |
|---|
| 11 | 11 | | Section 38.115 to read as follows: |
|---|
| 12 | 12 | | Sec. 38.115. TAMPERING WITH CORRECTIONAL FACILITY TABLET |
|---|
| 13 | 13 | | DEVICE. (a) In this section, "correctional facility" means: |
|---|
| 14 | 14 | | (1) any place described by Section 1.07(a)(14)(A), |
|---|
| 15 | 15 | | (B), or (C); or |
|---|
| 16 | 16 | | (2) a secure correctional facility or secure detention |
|---|
| 17 | 17 | | facility, as defined by Section 51.02, Family Code. |
|---|
| 18 | 18 | | (b) A person commits an offense if the person, while |
|---|
| 19 | 19 | | confined in a correctional facility, alters, modifies, or breaches |
|---|
| 20 | 20 | | the security, programming, or operating system of a tablet device |
|---|
| 21 | 21 | | provided to the person by the operator of the correctional |
|---|
| 22 | 22 | | facility. |
|---|
| 23 | 23 | | (c) An offense under this section is a felony of the third |
|---|
| 24 | 24 | | degree. |
|---|
| 25 | 25 | | SECTION 2. This Act takes effect September 1, 2023. |
