A BILL TO BE ENTITLED
AN ACT
relating to creating the criminal offense of tampering with a
correctional facility tablet device.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Chapter 38, Penal Code, is amended by adding
Section 38.115 to read as follows:
Sec. 38.115. TAMPERING WITH CORRECTIONAL FACILITY TABLET
DEVICE. (a) In this section, "correctional facility" means:
(1) any place described by Section 1.07(a)(14)(A),
(B), or (C); or
(2) a secure correctional facility or secure detention
facility, as defined by Section 51.02, Family Code.
(b) A person commits an offense if the person, while
confined in a correctional facility, alters, modifies, or breaches
the security, programming, or operating system of a tablet device
provided to the person by the operator of the correctional
facility.
(c) An offense under this section is a felony of the third
degree.
SECTION 2. This Act takes effect September 1, 2023.
