| 7 | 7 | | relating to the service retirement eligibility and benefits of |

| 8 | 8 | | certain members of the Employees Retirement System of Texas. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 814.109, Government Code, is repealed. |
|---|
| 11 | 11 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 12 | 12 | | to an individual who retires on or after the effective date of this |
|---|
| 13 | 13 | | Act. An individual who retires before the effective date of this Act |
|---|
| 14 | 14 | | is governed by the law in effect immediately before that date, and |
|---|
| 15 | 15 | | the former law is continued in effect for that purpose. |
|---|
| 16 | 16 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 17 | 17 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 18 | 18 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 19 | 19 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 20 | 20 | | Act takes effect September 1, 2023. |
