77 relating to required human trafficking prevention training and
88 disclosure of certain information about human trafficking by tattoo
99 and body piercing studios.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 402.0351(a), Government Code, is amended
1212 by amending Subdivision (1) and adding Subdivision (1-a) to read as
1313 follows:
1414 (1) "Body piercing studio" has the meaning assigned by
1515 Section 146.001, Health and Safety Code.
1616 (1-a) "Cosmetology facility" means a person who holds
1717 a license to operate a facility or school under Chapter 1602,
1818 Occupations Code.
1919 SECTION 2. Section 402.0351(a-1), Government Code, is
2020 amended to read as follows:
2121 (a-1) Except as provided by Subsection (a-3), a person who
2222 operates any of the following entities shall post at the entity the
2323 sign prescribed under Subsection (b), or, if applicable, a similar
2424 sign or notice as prescribed by other state law:
2525 (1) an entity permitted or licensed under Chapter 25,
2626 26, 28, 32, 69, or 71, Alcoholic Beverage Code, other than an entity
2727 holding a food and beverage certificate;
2828 (2) a cosmetology facility;
2929 (3) a hospital;
3030 (4) a massage establishment;
3131 (5) a massage school;
3232 (6) a sexually oriented business;
3333 (7) a tattoo studio; [or]
3434 (8) a transportation hub; or
3535 (9) a body piercing studio.
3636 SECTION 3. Chapter 146, Health and Safety Code, is amended
3737 by adding Section 146.0075 to read as follows:
3838 Sec. 146.0075. REQUIRED HUMAN TRAFFICKING TRAINING. (a)
3939 Each employee of a tattoo studio or body piercing studio within the
4040 time prescribed by rules adopted by the executive commissioner
4141 shall complete a training course approved by the executive
4242 commissioner on identifying and assisting victims of human
4343 trafficking.
4444 (b) The executive commissioner shall approve training
4545 courses on human trafficking prevention, including at least one
4646 course that is available without charge. The department shall post
4747 the list of the approved training courses on the department's
4848 Internet website.
4949 (c) A tattoo studio or body piercing studio shall post signs
5050 relating to human trafficking as required by Section 402.0351,
5151 Government Code.
5252 SECTION 4. As soon as practicable after the effective date
5353 of this Act:
5454 (1) the executive commissioner of the Health and Human
5555 Services Commission shall:
5656 (A) approve human trafficking prevention
5757 training courses as provided by Section 146.0075(b), Health and
5858 Safety Code, as added by this Act; and
5959 (B) adopt rules necessary to implement Section
6060 146.0075, Health and Safety Code, as added by this Act; and
6161 (2) the Department of State Health Services shall post
6262 on its Internet website the list of human trafficking prevention
6363 courses approved by the executive commissioner of the Health and
6464 Human Services Commission under Section 146.0075(b), Health and
6565 Safety Code, as added by this Act.
6666 SECTION 5. An employee of a tattoo studio or body piercing
6767 studio is not required to complete a training course as required by
6868 Section 146.0075(a), Health and Safety Code, as added by this Act,
6969 before January 1, 2024.
7070 SECTION 6. This Act takes effect September 1, 2023.
