| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 382.05195, Health and Safety Code, is |
|---|
| 11 | 11 | | amended by adding Subsection (l) to read as follows: |
|---|
| 12 | 12 | | (l) The commission shall give priority when processing |
|---|
| 13 | 13 | | applications for an authorization to use a standard permit under |
|---|
| 14 | 14 | | this section for a rock or concrete crushing facility to an operator |
|---|
| 15 | 15 | | who the commission determines: |
|---|
| 16 | 16 | | (1) has previously been authorized to use a standard |
|---|
| 17 | 17 | | permit under this section for a rock or concrete crushing facility; |
|---|
| 18 | 18 | | and |
|---|
| 19 | 19 | | (2) reclaimed the land disturbed by the rock or |
|---|
| 20 | 20 | | concrete crushing facility described by Subdivision (1) before the |
|---|
| 21 | 21 | | 180th day after the date the facility ceased operating. |
|---|
| 22 | 22 | | SECTION 2. This Act takes effect September 1, 2023. |
