A BILL TO BE ENTITLED
AN ACT
relating to the processing of an application for an authorization
to use a standard permit for a rock or concrete crushing facility.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 382.05195, Health and Safety Code, is
amended by adding Subsection (l) to read as follows:
(l) The commission shall give priority when processing
applications for an authorization to use a standard permit under
this section for a rock or concrete crushing facility to an operator
who the commission determines:
(1) has previously been authorized to use a standard
permit under this section for a rock or concrete crushing facility;
and
(2) reclaimed the land disturbed by the rock or
concrete crushing facility described by Subdivision (1) before the
180th day after the date the facility ceased operating.
SECTION 2. This Act takes effect September 1, 2023.
