| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 25.112, Education Code, is amended by |
|---|
| 11 | 11 | | amending Subsection (d) and adding Subsection (g) to read as |
|---|
| 12 | 12 | | follows: |
|---|
| 13 | 13 | | (d) Subject to Subsection (g), on [On] application of a |
|---|
| 14 | 14 | | school district, the commissioner may except the district from the |
|---|
| 15 | 15 | | limit in Subsection (a) if the commissioner finds the limit works an |
|---|
| 16 | 16 | | undue hardship on the district. An exception expires at the end of |
|---|
| 17 | 17 | | the school year for which it is granted. |
|---|
| 18 | 18 | | (g) The commissioner may not grant an exception to the limit |
|---|
| 19 | 19 | | under Subsection (a) if the district has been assigned an overall |
|---|
| 20 | 20 | | performance rating of D or F under Section 39.054 for the preceding |
|---|
| 21 | 21 | | school year or for the most recent school year for which a |
|---|
| 22 | 22 | | performance rating was assigned. |

| 23 | 23 | | SECTION 2. This Act applies beginning with the 2023-2024 |
|---|
| 24 | 24 | | school year. |
|---|
| 25 | 25 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 26 | 26 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 27 | 27 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 28 | 28 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 29 | 29 | | Act takes effect September 1, 2023. |
