 A BILL TO BE ENTITLED
 AN ACT
 relating to the applicability of certain requirements regarding
 public school class size.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1.  Section 25.112, Education Code, is amended by
 amending Subsection (d) and adding Subsection (g) to read as
 follows:
 (d)  Subject to Subsection (g), on [On] application of a
 school district, the commissioner may except the district from the
 limit in Subsection (a) if the commissioner finds the limit works an
 undue hardship on the district.  An exception expires at the end of
 the school year for which it is granted.
 (g)  The commissioner may not grant an exception to the limit
 under Subsection (a) if the district has been assigned an overall
 performance rating of D or F under Section 39.054 for the preceding
 school year or for the most recent school year for which a
 performance rating was assigned.
 SECTION 2.  This Act applies beginning with the 2023-2024
 school year.
 SECTION 3.  This Act takes effect immediately if it receives
 a vote of two-thirds of all the members elected to each house, as
 provided by Section 39, Article III, Texas Constitution.  If this
 Act does not receive the vote necessary for immediate effect, this
 Act takes effect September 1, 2023.
