66 AN ACT
77 relating to the establishment of the African American studies
88 advisory board by the State Board of Education.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter A, Chapter 28, Education Code, is
1111 amended by adding Section 28.019 to read as follows:
1212 Sec. 28.019. AFRICAN AMERICAN STUDIES ADVISORY BOARD. (a)
1313 In this section, "board" means the African American studies
1414 advisory board.
1515 (b) The State Board of Education shall establish and
1616 maintain an African American studies advisory board for the purpose
1717 of broadening the content in social studies, African American
1818 studies, and any other identified courses to include citizenship,
1919 culture, economics, science, technology, geography, and politics
2020 as they relate to the history of African Americans.
2121 (c) The board is composed of 15 members appointed by the
2222 State Board of Education as follows:
2323 (1) 10 members who are academic professionals with
2424 expertise in African American studies and who have served to
2525 actively educate the public on the impact of the enslavement era,
2626 the contributions of African Americans to society, and racial
2727 equity issues, including:
2828 (A) five members who are:
2929 (i) faculty and staff members representing
3030 the African American studies departments of institutions of higher
3131 education in this state; and
3232 (ii) recommended by five different
3333 institutions of higher education in this state, including:
3434 (a) at least one member recommended by
3535 a public junior college;
3636 (b) one member recommended by Prairie
3737 View A&M University's African American studies initiative; and
3838 (c) one member recommended by Texas
3939 Southern University's African American studies minor program; and
4040 (B) five members who:
4141 (i) represent school districts; and
4242 (ii) are recommended by organizations that
4343 represent practitioners, administrators, and school leaders,
4444 including at least:
4545 (a) one member recommended by the
4646 Texas Alliance of Black School Educators;
4747 (b) one member recommended by the
4848 Texas Caucus of Black School Board Members; and
4949 (c) one member recommended by the
5050 Texas Association of Rural Schools; and
5151 (2) five members who:
5252 (A) represent public school students and
5353 parents;
5454 (B) include three current public school
5555 students; and
5656 (C) are recommended by education organizations,
5757 including at least:
5858 (i) one member recommended by a statewide
5959 organization focused on research-based education policy; and
6060 (ii) one member recommended by an advocacy
6161 organization that works with parents of students.
6262 (d) Not later than November 1 of each year, the State Board
6363 of Education shall solicit and review recommendations and make
6464 final appointments to the board in accordance with Subsection (c).
6565 (e) Members of the board serve staggered two-year terms,
6666 with the terms of five members expiring on December 1 of each year.
6767 Members may be reappointed at the end of a term for up to four terms.
6868 (f) The members of the board shall elect a presiding officer
6969 for the board. The board shall hold meetings at the call of the
7070 presiding officer.
7171 (g) The board shall:
7272 (1) advise and provide recommendations to the State
7373 Board of Education and the agency on curriculum and guidance
7474 related to African American history and culture; and
7575 (2) review and propose changes to interdisciplinary
7676 content that references African American history and culture,
7777 including textbooks, for kindergarten through grade 12.
7878 (h) Not later than December 1 of each year, the board shall
7979 prepare and submit to the governor, the legislature, the agency,
8080 and the State Board of Education a written report that includes:
8181 (1) a summary of the board's work throughout the year;
8282 (2) any information provided to the State Board of
8383 Education and the agency under Subsection (g); and
8484 (3) recommendations for legislative action.
8585 (i) Section 2110.008, Government Code, does not apply to the
8686 advisory board established under this section.
8787 SECTION 2. Not later than December 1, 2023, the African
8888 American studies advisory board established under Section 28.019,
8989 Education Code, as added by this Act, shall hold its first meeting.
9090 SECTION 3. This Act takes effect September 1, 2023.
