55 AN ACT
66 relating to the authority of the Harris County Hospital District to
77 employ and commission peace officers.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subsection (a), Section 281.057, Health and
1010 Safety Code, is amended to read as follows:
1111 (a) The board of the Dallas County Hospital District, the
1212 Tarrant County Hospital District, the Bexar County Hospital
1313 District, [or] the El Paso County Hospital District, or the Harris
1414 County Hospital District may employ and commission peace officers
1515 for the district.
1616 SECTION 2. Article 2.12, Code of Criminal Procedure, is
1717 amended to read as follows:
1818 Art. 2.12. WHO ARE PEACE OFFICERS. The following are peace
1919 officers:
2020 (1) sheriffs, their deputies, and those reserve
2121 deputies who hold a permanent peace officer license issued under
2222 Chapter 1701, Occupations Code;
2323 (2) constables, deputy constables, and those reserve
2424 deputy constables who hold a permanent peace officer license issued
2525 under Chapter 1701, Occupations Code;
2626 (3) marshals or police officers of an incorporated
2727 city, town, or village, and those reserve municipal police officers
2828 who hold a permanent peace officer license issued under Chapter
2929 1701, Occupations Code;
3030 (4) rangers, officers, and members of the reserve
3131 officer corps commissioned by the Public Safety Commission and the
3232 Director of the Department of Public Safety;
3333 (5) investigators of the district attorneys', criminal
3434 district attorneys', and county attorneys' offices;
3535 (6) law enforcement agents of the Texas Alcoholic
3636 Beverage Commission;
3737 (7) each member of an arson investigating unit
3838 commissioned by a city, a county, or the state;
3939 (8) officers commissioned under Section 37.081,
4040 Education Code, or Subchapter E, Chapter 51, Education Code;
4141 (9) officers commissioned by the General Services
4242 Commission;
4343 (10) law enforcement officers commissioned by the
4444 Parks and Wildlife Commission;
4545 (11) officers commissioned under Chapter 23,
4646 Transportation Code;
4747 (12) municipal park and recreational patrolmen and
4848 security officers;
4949 (13) security officers and investigators commissioned
5050 as peace officers by the comptroller;
5151 (14) officers commissioned by a water control and
5252 improvement district under Section 49.216, Water Code;
5353 (15) officers commissioned by a board of trustees
5454 under Chapter 54, Transportation Code;
5555 (16) investigators commissioned by the Texas Medical
5656 Board;
5757 (17) officers commissioned by:
5858 (A) the board of managers of the Dallas County
5959 Hospital District, the Tarrant County Hospital District, the Bexar
6060 County Hospital District, [or] the El Paso County Hospital
6161 District, or the Harris County Hospital District under Section
6262 281.057, Health and Safety Code;
6363 (B) the board of directors of the Ector County
6464 Hospital District under Section 1024.117, Special District Local
6565 Laws Code;
6666 (C) the board of directors of the Midland County
6767 Hospital District of Midland County, Texas, under Section 1061.121,
6868 Special District Local Laws Code; and
6969 (D) the board of hospital managers of the Lubbock
7070 County Hospital District of Lubbock County, Texas, under Section
7171 1053.113, Special District Local Laws Code;
7272 (18) county park rangers commissioned under
7373 Subchapter E, Chapter 351, Local Government Code;
7474 (19) investigators employed by the Texas Racing
7575 Commission;
7676 (20) officers commissioned under Chapter 554,
7777 Occupations Code;
7878 (21) officers commissioned by the governing body of a
7979 metropolitan rapid transit authority under Section 451.108,
8080 Transportation Code, or by a regional transportation authority
8181 under Section 452.110, Transportation Code;
8282 (22) investigators commissioned by the attorney
8383 general under Section 402.009, Government Code;
8484 (23) security officers and investigators commissioned
8585 as peace officers under Chapter 466, Government Code;
8686 (24) officers appointed by an appellate court under
8787 Subchapter F, Chapter 53, Government Code;
8888 (25) officers commissioned by the state fire marshal
8989 under Chapter 417, Government Code;
9090 (26) an investigator commissioned by the commissioner
9191 of insurance under Section 701.104, Insurance Code;
9292 (27) apprehension specialists and inspectors general
9393 commissioned by the Texas Juvenile Justice Department as officers
9494 under Sections 242.102 and 243.052, Human Resources Code;
9595 (28) officers appointed by the inspector general of
9696 the Texas Department of Criminal Justice under Section 493.019,
9797 Government Code;
9898 (29) investigators commissioned by the Texas
9999 Commission on Law Enforcement under Section 1701.160, Occupations
100100 Code;
101101 (30) commission investigators commissioned by the
102102 Texas Private Security Board under Section 1702.061, Occupations
103103 Code;
104104 (31) the fire marshal and any officers, inspectors, or
105105 investigators commissioned by an emergency services district under
106106 Chapter 775, Health and Safety Code;
107107 (32) officers commissioned by the State Board of
108108 Dental Examiners under Section 254.013, Occupations Code, subject
109109 to the limitations imposed by that section;
110110 (33) investigators commissioned by the Texas Juvenile
111111 Justice Department as officers under Section 221.011, Human
112112 Resources Code; and
113113 (34) the fire marshal and any related officers,
114114 inspectors, or investigators commissioned by a county under
115115 Subchapter B, Chapter 352, Local Government Code.
116116 SECTION 3. This Act takes effect immediately if it receives
117117 a vote of two-thirds of all the members elected to each house, as
118118 provided by Section 39, Article III, Texas Constitution. If this
119119 Act does not receive the vote necessary for immediate effect, this
120120 Act takes effect September 1, 2023.
