1010 A BILL TO BE ENTITLED
1111 AN ACT
1212 relating to procedural requirements for uranium mining production
1313 area authorizations.
1414 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1515 SECTION 1. Section 27.0513(d), Water Code, is amended to
1616 read as follows:
1717 (d) Notwithstanding Sections 5.551, 5.556, 27.011, and
1818 27.018, an application for an authorization or an amendment to an
1919 authorization that allows the permit holder to conduct mining and
2020 restoration activities in production zones within the boundary
2121 established in the permit is an uncontested matter not subject to a
2222 contested case hearing or the hearing requirements of Chapter 2001,
2323 Government Code, if:
2424 (1) the authorization is for a production zone located
2525 within the boundary of a permit that incorporates, for each
2626 production zone addressed in the application, a range table of
2727 groundwater quality restoration values used to measure groundwater
2828 restoration by the commission;
2929 (2) the application includes, for each production zone
3030 addressed in the application, groundwater quality restoration
3131 values falling at or below the upper limit of the range established
3232 in Subdivision (1); and
3333 (3) the authorization is for a production zone located
3434 within the boundary of a permit that incorporates groundwater
3535 baseline characteristics of the wells for the application required
3636 by commission rule.
3737 SECTION 2. Sections 27.0513(f) and (g), Water Code, are
3838 repealed.
3939 SECTION 3. The change in law made by this Act applies only
4040 to an application for an authorization or an amendment to an
4141 authorization that is submitted to the Texas Commission on
4242 Environmental Quality on or after the effective date of this Act.
4343 An application for an authorization or an amendment to an
4444 authorization that was submitted to the commission before the
4545 effective date of this Act is governed by the law in effect at the
4646 time the application or amendment was submitted, and the former law
4747 is continued in effect for that purpose.
4848 SECTION 4. This Act takes effect September 1, 2023.
