55 relating to access to and use of certain criminal history record
66 information.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 22.0834, Education Code, is amended by
99 amending Subsections (a), (a-1), (b), (c), (d), (e), (f), (h), (l),
1010 (o), and (p) and adding Subsections (b-1), (d-1), (d-2), and (q) to
1111 read as follows:
1212 (a) Except as provided by Subsection (a-1), this subsection
1313 applies to a person who is not an applicant for or holder of a
1414 certificate under Subchapter B, Chapter 21, and who [on or after
1515 January 1, 2008,] is offered employment by an entity or a
1616 subcontractor of an entity that contracts with a school district,
1717 open-enrollment charter school, or shared services arrangement to
1818 provide services, if:
1919 (1) the employee or applicant has or will have
2020 continuing duties related to the contracted services; and
2121 (2) the employee or applicant has or will have direct
2222 contact with students.
2323 (a-1) This section does not apply to an employee or
2424 applicant of a public works contractor if:
2525 (1) the public work does not involve the construction,
2626 alteration, or repair of an instructional facility as defined by
2727 Section 46.001;
2828 (2) for public work that involves construction of a
2929 new instructional facility, the person's duties related to the
3030 contracted services will be completed not later than the seventh
3131 day before the first date the facility will be used for
3232 instructional purposes; or
3333 (3) for a public work that involves an existing
3434 instructional facility:
3535 (A) the public work area contains sanitary
3636 facilities and is separated from all areas used by students by a
3737 secure barrier fence that is not less than six feet in height; and
3838 (B) the contracting entity adopts a policy
3939 prohibiting employees, including subcontracting entity employees,
4040 from interacting with students or entering areas used by students,
4141 informs employees of the policy, and enforces the policy at the
4242 public work area [a contracting entity, subcontracting entity, or
4343 other person subject to Section 22.08341].
4444 (b) If the contracting entity is a qualified school
4545 contractor, a [A] person to whom Subsection (a) applies must submit
4646 to a national criminal history record information review by the
4747 qualified school contractor [under this section] before being
4848 employed or serving in a capacity described by that subsection.
4949 (b-1) If the contracting entity or subcontracting entity is
5050 not a qualified school contractor, a person to whom Subsection (a)
5151 applies must submit to a national criminal history record
5252 information review by the school district, charter school, regional
5353 education service center, commercial transportation company, or
5454 education shared services arrangement.
5555 (c) Before or immediately after employing or securing the
5656 services of a person to whom Subsection (a) applies, the qualified
5757 school contractor or [entity contracting with a] school district,
5858 open-enrollment charter school, or shared services arrangement
5959 shall send or ensure that the person sends to the department
6060 information that is required by the department for obtaining
6161 national criminal history record information, which may include
6262 fingerprints and photographs. The department shall obtain the
6363 person's national criminal history record information and report
6464 the results through the criminal history clearinghouse as provided
6565 by Section 411.0845, Government Code.
6666 (d) A qualified school contractor or [An entity contracting
6767 with] a school district, open-enrollment charter school, or shared
6868 services arrangement shall obtain all criminal history record
6969 information that relates to a person to whom Subsection (a) applies
7070 through the criminal history clearinghouse as provided by Section
7171 411.0845, Government Code. [The entity shall certify to the school
7272 district that the entity has received all criminal history record
7373 information relating to a person to whom Subsection (a) applies.]
7474 (d-1) A qualified school contractor acting as a contracting
7575 entity shall require that any of its subcontracting entities obtain
7676 all criminal history record information that relates to an employee
7777 to whom Subsection (a) applies if the subcontracting entity is also
7878 a qualified school contractor.
7979 (d-2) A qualified school contractor shall require that any
8080 of its subcontracting entities that are not qualified school
8181 contractors comply with Subsection (b-1) as it relates to an
8282 employee to whom Subsection (a) applies.
8383 (e) The requirements of Subsections (b), (d-1), and (d-2) do
8484 not apply to a qualified school contractor if a [A] school district,
8585 open-enrollment charter school, or shared services arrangement
8686 obtains [may obtain] the criminal history record information of a
8787 person to whom this section applies through the criminal history
8888 clearinghouse as provided by Section 411.0845, Government Code.
8989 (f) In the event of an emergency, a school district may
9090 allow a person to whom Subsection (a) [or (g)] applies to enter
9191 school district property if the person is accompanied by a district
9292 employee. A school district may adopt rules regarding an emergency
9393 situation under this subsection.
9494 (h) A school district, open-enrollment charter school, [or]
9595 shared services arrangement, or qualified school contractor may
9696 obtain from any law enforcement or criminal justice agency all
9797 criminal history record information that relates to a person to
9898 whom this section [Subsection (g)] applies.
9999 (l) [A contracting entity shall require that a
100100 subcontracting entity obtain all criminal history record
101101 information that relates to an employee to whom Subsection (a)
102102 applies.] If a contracting or subcontracting entity determines
103103 that Subsection (a) does not apply to an employee, the contracting
104104 or subcontracting entity shall make a reasonable effort to ensure
105105 that the conditions or precautions that resulted in the
106106 determination that Subsection (a) did not apply to the employee
107107 continue to exist throughout the time that the contracted services
108108 are provided.
109109 (o) A school district, charter school, regional education
110110 service center, commercial transportation company, education
111111 shared services arrangement, or qualified school contractor,
112112 contracting entity, or subcontracting entity may not permit an
113113 employee to whom Subsection (a) applies to provide services at a
114114 school if the employee has been convicted of a felony or misdemeanor
115115 offense that would prevent a person from being employed under
116116 Section 22.085(a).
117117 (p) In this section:
118118 (1) "Contracting entity" means an entity that
119119 contracts directly with a school district, open-enrollment charter
120120 school, or shared services arrangement to provide services to the
121121 school district, open-enrollment charter school, or shared
122122 services arrangement.
123123 (2) "Public works contractor" means an entity that
124124 contracts directly or subcontracts with an entity that contracts
125125 with a school district, open-enrollment charter school, or shared
126126 services arrangement to provide services to the school district,
127127 open-enrollment charter school, or shared services arrangement.
128128 (3) "Qualified school contractor" has the meaning
129129 assigned by Section 411.12505, Government Code.
130130 (4) "Subcontracting entity" means an entity that
131131 contracts with another entity that is not a school district,
132132 open-enrollment charter school, or shared services arrangement to
133133 provide services to a school district, open-enrollment charter
134134 school, or shared services arrangement.
135135 (q) A qualified school contractor shall certify to the
136136 school district, open-enrollment charter school, or shared
137137 services arrangement that the entity has received all criminal
138138 history record information relating to a person who is employed by
139139 or under a current offer of employment by the qualified school
140140 contractor.
141141 SECTION 2. Section 22.0835(f), Education Code, is amended
142142 to read as follows:
143143 (f) A school district, open-enrollment charter school, or
144144 shared services arrangement may obtain from the department or any
145145 law enforcement or criminal justice agency all criminal history
146146 record information that relates to a person to whom Subsection (e)
147147 applies.
148148 SECTION 3. Section 22.085(c), Education Code, is amended to
149149 read as follows:
150150 (c) A school district, open-enrollment charter school, or
151151 shared services arrangement may not allow a person who is an
152152 employee of or applicant for employment by a qualified school
153153 contractor or an entity that contracts with the district, school,
154154 or shared services arrangement to serve at the district or school or
155155 for the shared services arrangement if the district, school, or
156156 shared services arrangement obtains information described by
157157 Subsection (a) through a criminal history record information review
158158 concerning the employee or applicant. A school district,
159159 open-enrollment charter school, or shared services arrangement
160160 must ensure that an entity that the district, school, or shared
161161 services arrangement contracts with for services has obtained all
162162 criminal history record information as required by Section 22.0834
163163 [or 22.08341].
164164 SECTION 4. Section 1104.402(a), Estates Code, is amended to
165165 read as follows:
166166 (a) Except as provided by Section [1104.403,] 1104.404[,]
167167 or 1104.406(a), the clerk of the county having venue of the
168168 proceeding for the appointment of a guardian shall obtain criminal
169169 history record information that is maintained by the Department of
170170 Public Safety or the Federal Bureau of Investigation identification
171171 division relating to[:
172172 [(1) a private professional guardian;
173173 [(2) each person who represents or plans to represent
174174 the interests of a ward as a guardian on behalf of the private
175175 professional guardian;
176176 [(3) each person employed by a private professional
177177 guardian who will:
178178 [(A) have personal contact with a ward or
179179 proposed ward;
180180 [(B) exercise control over and manage a ward's
181181 estate; or
182182 [(C) perform any duties with respect to the
183183 management of a ward's estate;
184184 [(4) each person employed by or volunteering or
185185 contracting with a guardianship program to provide guardianship
186186 services to a ward of the program on the program's behalf; or
187187 [(5)] any [other] person proposed to serve as a
188188 guardian under this title, including a proposed temporary guardian,
189189 [and] a proposed successor guardian, or any person who will have
190190 contact with the proposed ward or the proposed ward's estate on
191191 behalf of the proposed guardian, other than an attorney or a person
192192 who is a certified guardian.
193193 SECTION 5. Section 1104.404, Estates Code, is amended to
194194 read as follows:
195195 Sec. 1104.404. EXCEPTION FOR INFORMATION CONCERNING
196196 CERTAIN PERSONS. (a) The clerk described by Section 1104.402 is
197197 not required to obtain criminal history record information from the
198198 Department of Public Safety for a person if the Judicial Branch
199199 Certification Commission conducted a criminal history check on the
200200 person under Sections 155.203 and 155.207 [Chapter 155], Government
201201 Code. However, the clerk shall obtain criminal history record
202202 information from the Federal Bureau of Investigation
203203 identification division relating to each person described by
204204 Section 1104.402.
205205 (b) The commission [board] shall provide to the clerk [at
206206 the court's request] the criminal history record information that
207207 was obtained from the Department of Public Safety [or the Federal
208208 Bureau of Investigation]. The commission is prohibited from
209209 disseminating criminal history record information that was
210210 obtained from the Federal Bureau of Investigation under Section
211211 411.1408, Government Code, for purposes of determining whether an
212212 applicant is ineligible for certification as a guardian.
213213 SECTION 6. Section 1104.405(a), Estates Code, is amended to
214214 read as follows:
215215 (a) Criminal history record information obtained or
216216 provided under Section 1104.402[, 1104.403,] or 1104.404 is
217217 privileged and confidential and is for the exclusive use of the
218218 court. The criminal history record information may not be released
219219 or otherwise disclosed to any person or agency except on court order
220220 [or consent of the person being investigated]. The court may use
221221 the criminal history record information only to determine whether
222222 to:
223223 (1) appoint, remove, or continue the appointment of a
224224 private professional guardian, a guardianship program, or the
225225 Health and Human Services Commission; or
226226 (2) appoint any person proposed to serve as a guardian
227227 under this title, including a proposed temporary guardian, a
228228 proposed successor guardian, or any person who will have contact
229229 with the proposed ward or the proposed ward's estate on behalf of
230230 the proposed guardian, other than an attorney or a certified
231231 guardian.
232232 SECTION 7. Section 14.151(a), Finance Code, is amended to
233233 read as follows:
234234 (a) The commissioner or an assistant commissioner,
235235 examiner, or other employee of the office shall obtain criminal
236236 history record information maintained by the Department of Public
237237 Safety, the Federal Bureau of Investigation Identification
238238 Division, or another law enforcement agency relating to a person
239239 described by Section 411.095(a) [411.095(a)(1)], Government Code.
240240 SECTION 8. Section 152.203, Government Code, is amended to
241241 read as follows:
242242 Sec. 152.203. RULES ON INELIGIBILITY. The supreme court
243243 shall by order adopt rules on an applicant's [applicants']
244244 ineligibility for certification, registration, or licensing under
245245 this subtitle based on the applicant's [person's] criminal history
246246 or other information that indicates the applicant [person] lacks
247247 the honesty, trustworthiness, or integrity to hold the
248248 certification, registration, or license. The commission shall, in
249249 accordance with this section and rules adopted by order of the
250250 United States Supreme Court, obtain criminal history record
251251 information that is maintained by the Department of Public Safety
252252 or the Federal Bureau of Investigation identification division on
253253 each applicant for certification, registration, or licensing under
254254 this subtitle to be used only for the determination of each
255255 applicant's ineligibility under rules adopted by United States
256256 Supreme Court order under this section. The commission may not use
257257 criminal history record information obtained from the Federal
258258 Bureau of Investigation identification division under this section
259259 for any other purpose. The commission may not transfer criminal
260260 history record information obtained from the Federal Bureau of
261261 Investigation identification division under this section to any
262262 other state agency, entity, or person. The commission shall
263263 destroy criminal history record information immediately after each
264264 determination of ineligibility is made.
265265 SECTION 9. Section 155.205, Government Code, is amended to
266266 read as follows:
267267 Sec. 155.205. DUTY TO OBTAIN CRIMINAL HISTORY RECORD
268268 INFORMATION. (a) In accordance with Subsection (c) and the rules
269269 adopted by the supreme court under Section 155.203, the commission
270270 shall obtain criminal history record information that is maintained
271271 by the Department of Public Safety. The clerk shall obtain in
272272 accordance with Subsection (b) criminal history record information
273273 from [or] the Federal Bureau of Investigation identification
274274 division relating to an individual seeking appointment as a
275275 guardian or temporary guardian.
276276 (b) The clerk [commission] shall obtain[:
277277 [(1)] fingerprint-based criminal history record
278278 information of a proposed guardian if:
279279 (1) [(A)] the liquid assets of the estate of a ward
280280 exceed $50,000; or
281281 (2) [(B)] the proposed guardian is not a resident of
282282 this state.
283283 (c) The commission shall obtain[; or
284284 [(2)] name-based criminal history record information
285285 of a proposed guardian, including any criminal history record
286286 information under the current name and all former names of the
287287 proposed guardian, if:
288288 (1) [(A)] the liquid assets of the estate of a ward are
289289 $50,000 or less; and
290290 (2) [(B)] the proposed guardian is a resident of this
291291 state.
292292 (d) Each proposed guardian described by Subsection (b)
293293 shall file with the commission proof of having submitted to a
294294 fingerprint-based criminal history search.
295295 SECTION 10. Section 155.207(a), Government Code, is amended
296296 to read as follows:
297297 (a) The commission shall use the criminal history record
298298 information obtained under this subchapter only for a purpose
299299 authorized by this subchapter [or to maintain the registration of a
300300 guardianship under Subchapter D].
301301 SECTION 11. Section 411.082, Government Code, is amended by
302302 adding Subdivisions (1-a) and (1-b) to read as follows:
303303 (1-a) "Applicant" means an individual who submits an
304304 application for employment, licensure, certification, or
305305 registration that requires the department to conduct a background
306306 check using criminal history record information.
307307 (1-b) "Application" means an application submitted by
308308 hard copy or electronically for employment, licensure,
309309 certification, or registration that requires the department to
310310 conduct a background check using criminal history record
311311 information.
312312 SECTION 12. Section 411.084, Government Code, is amended by
313313 amending Subsection (b) and adding Subsection (d) to read as
314314 follows:
315315 (b) Notwithstanding Subsection (a) or any other provision
316316 in this subchapter relating to the release or disclosure of such
317317 information, criminal history record information obtained from the
318318 Federal Bureau of Investigation may be released or disclosed only
319319 to a governmental entity or as authorized by federal law and
320320 regulations, federal executive orders, and federal policy.
321321 (d) Notwithstanding any other provision of this subchapter,
322322 a private entity that purchases information from the department is
323323 not required to provide proof of cyber-threat insurance coverage or
324324 post a performance bond if that entity:
325325 (1) provides proof of an audit by a certified public
326326 accountant certifying that the requestor has implemented internal
327327 controls and security protocols that are consistent with the
328328 National Institute of Standards and Technology standards for
329329 cybersecurity and approved by the Department of Information
330330 Resources or an IT cybersecurity professional certified by the
331331 National Institute of Standards and Technology or a similar
332332 organization;
333333 (2) provides proof of Payment Card Industry Data
334334 Security Standard (PCI DSS) certification or certification by a
335335 similar organization recognized by the Department of Information
336336 Resources; or
337337 (3) provides proof of compliance with voluntary
338338 compliance standards for cybersecurity developed by a national
339339 organization of certified public accountants for the management of
340340 customer data, including SOC 1, SOC 2, or SOC.
341341 SECTION 13. Section 411.0891, Government Code, is amended
342342 by amending Subsections (a), (b), and (d) and adding Subsections
343343 (a-1) and (e) to read as follows:
344344 (a) The [Subject to Section 411.087, the] department may [is
345345 authorized to] obtain as provided by Subsection (a-1) [and use]
346346 criminal history record information [maintained by the Federal
347347 Bureau of Investigation or the department] that relates to a person
348348 who:
349349 (1) is an applicant for or holds a registration issued
350350 by the director under Subchapter C, Chapter 481, Health and Safety
351351 Code, that authorizes the person to manufacture, distribute,
352352 analyze, or conduct research with a controlled substance;
353353 (2) is an applicant for or holds a registration issued
354354 by the department under Chapter 487, Health and Safety Code, to be a
355355 director, manager, or employee of a dispensing organization, as
356356 defined by Section 487.001, Health and Safety Code;
357357 (3) is an applicant for or holds an authorization
358358 issued by the department under Section 521.2476, Transportation
359359 Code, to do business in this state as a vendor of ignition interlock
360360 devices;
361361 (4) is an applicant for or holds certification by the
362362 department as an inspection station or an inspector under
363363 Subchapter G, Chapter 548, Transportation Code, holds an inspection
364364 station or inspector certificate issued under that subchapter, or
365365 is the owner of an inspection station operating under that chapter;
366366 [or]
367367 (5) is an applicant for or holds a certificate of
368368 registration issued by the department under Chapter 1956,
369369 Occupations Code, to act as a metal recycling entity;
370370 (6) is an applicant for or holds a license to carry a
371371 handgun issued by the department under Subchapter H, or is an
372372 applicant for or holds a certification as an instructor issued by
373373 the department under this chapter;
374374 (7) is an applicant for or holds a Capitol access pass
375375 issued by the department under Section 411.0625; or
376376 (8) is an applicant for or holds a license or
377377 commission issued by the department under Chapter 1702, Occupations
378378 Code.
379379 (a-1) Subject to Section 411.087 and consistent with the
380380 public policy of this state, the department is entitled to:
381381 (1) obtain through the Federal Bureau of Investigation
382382 criminal history record information maintained or indexed by that
383383 bureau that pertains to a person described by Subsection (a); and
384384 (2) obtain from any other criminal justice agency in
385385 this state criminal history record information maintained by that
386386 criminal justice agency that relates to a person described by
387387 Subsection (a).
388388 (b) The department may not release or disclose to any person
389389 criminal history record information obtained from the Federal
390390 Bureau of Investigation under Subsection (a-1)(1). The department
391391 may release or disclose criminal history record information
392392 obtained [or used] by the department under Subsection (a-1)(2) for
393393 a purpose described by Subsection (a) to another person or agency
394394 only:
395395 (1) in a criminal proceeding;
396396 (2) in a hearing conducted by the department;
397397 (3) under an order from a court; or
398398 (4) with the consent of the person who is the subject
399399 of the criminal history record information.
400400 (d) The department may require any person for whom the
401401 department is authorized to obtain [and use] criminal history
402402 record information [maintained by the Federal Bureau of
403403 Investigation or the department] under Subsections [Subsection]
404404 (a) and (a-1) to submit a complete and legible set of fingerprints
405405 to the department on a form prescribed by the department for the
406406 purpose of obtaining criminal history record information.
407407 (e) The department shall destroy criminal history record
408408 information that is obtained under this section after the
409409 information is used for its authorized purpose.
410410 SECTION 14. Section 411.090, Government Code, is amended by
411411 amending Subsections (a) and (b) and adding Subsections (a-1), (d),
412412 and (e) to read as follows:
413413 (a) The State Board for Educator Certification is entitled
414414 to obtain [from the department] any criminal history record
415415 information as provided by Subsection (a-1) [maintained by the
416416 department] about a person who has applied to the board for or who
417417 currently holds a certificate under Subchapter B, Chapter 21,
418418 Education Code.
419419 (a-1) Subject to Section 411.087 and consistent with the
420420 public policy of this state, the State Board for Educator
421421 Certification is entitled to:
422422 (1) obtain through the Federal Bureau of Investigation
423423 criminal history record information maintained or indexed by that
424424 bureau that pertains to a person described by Subsection (a); and
425425 (2) obtain from the department or any other criminal
426426 justice agency in this state criminal history record information
427427 maintained by the department or that criminal justice agency that
428428 relates to a person described by Subsection (a).
429429 (b) The State Board for Educator Certification may not
430430 release or disclose to any person criminal history record
431431 information obtained from the Federal Bureau of Investigation under
432432 Subsection (a-1)(1). Criminal history record information obtained
433433 by the board under Subsection (a-1)(2) in the original form or any
434434 subsequent form:
435435 (1) may be used only for a purpose related to the
436436 issuance, denial, reprimand, suspension, revocation, or
437437 cancellation of a certificate issued by the board;
438438 (2) may not be released to any person except:
439439 (A) to the person who is the subject of the
440440 information;
441441 (B) to the Texas Education Agency;
442442 (C) to a local or regional educational entity as
443443 provided by Section 411.097; or
444444 (D) by court order; and
445445 (3) is not subject to disclosure as provided by
446446 Chapter 552[; and
447447 [(4) shall be destroyed by the board after the
448448 information is used for the authorized purposes].
449449 (d) The State Board for Educator Certification is not
450450 prohibited from disclosing criminal history record information
451451 obtained under Subsection (a-1)(2) in a criminal proceeding or in a
452452 hearing conducted by the Texas Education Agency or the State Board
453453 for Educator Certification.
454454 (e) The State Board for Educator Certification shall
455455 destroy criminal history record information that is obtained under
456456 this section after the information is used for its authorized
457457 purpose.
458458 SECTION 15. Section 411.0901, Government Code, is amended
459459 by amending Subsections (a) and (b) and adding Subsections (a-1),
460460 (c), and (d) to read as follows:
461461 (a) The Texas Education Agency is entitled to obtain
462462 criminal history record information as provided by Subsection (a-1)
463463 [maintained by the department] about a person who:
464464 (1) is employed or is an applicant for employment by a
465465 school district or open-enrollment charter school;
466466 (2) is employed or is an applicant for employment by a
467467 shared services arrangement, if the employee's or applicant's
468468 duties are or will be performed on school property or at another
469469 location where students are regularly present; [or]
470470 (3) is employed or is an applicant for employment by an
471471 entity that contracts or subcontracts with a school district,
472472 open-enrollment charter school, or shared services arrangement, if
473473 the applicant or employee has or will have:
474474 (A) continuing duties related to the contracted
475475 or subcontracted services; and
476476 (B) direct contact with students;
477477 (4) is employed or is an applicant for employment by
478478 the Texas Education Agency; or
479479 (5) provides services as a tutor on behalf of a service
480480 provider that offers accelerated or supplemental instruction under
481481 Section 28.0211, Education Code, if the tutor has or will have
482482 continuing duties related to the services provided and has or will
483483 have direct contact with students [if:
484484 [(A) the employee or applicant has or will have
485485 continuing duties relating to the contracted services; and
486486 [(B) the employee or applicant has or will have
487487 direct contact with students].
488488 (a-1) Subject to Section 411.087 and consistent with the
489489 public policy of this state, the Texas Education Agency is entitled
490490 to:
491491 (1) obtain through the Federal Bureau of Investigation
492492 criminal history record information maintained or indexed by that
493493 bureau that pertains to a person described by Subsection (a); and
494494 (2) obtain from the department or any other criminal
495495 justice agency in this state criminal history record information
496496 maintained by the department or that criminal justice agency that
497497 relates to a person described by Subsection (a).
498498 (b) The Texas Education Agency may not release or disclose
499499 to any person criminal history record information obtained from the
500500 Federal Bureau of Investigation under Subsection (a-1)(1).
501501 Criminal history record information obtained by the agency under
502502 Subsection (a-1)(2) in the original form or any subsequent form:
503503 (1) may be used only for a purpose authorized by the
504504 Education Code;
505505 (2) may not be released to any person except:
506506 (A) the person who is the subject of the
507507 information;
508508 (B) the State Board for Educator Certification;
509509 (C) a local or regional educational entity as
510510 provided by Section 411.097; [or]
511511 (D) by court order; or
512512 (E) as provided by Subsection (c); and
513513 (3) is not subject to disclosure as provided by
514514 Chapter 552[; and
515515 [(4) shall be destroyed by the agency after the

517517 (c) The Texas Education Agency is not prohibited from
518518 disclosing criminal history record information obtained under
519519 Subsection (a-1)(2) in a criminal proceeding or in a hearing
520520 conducted by the Texas Education Agency or the State Board for
521521 Educator Certification.
522522 (d) The Texas Education Agency shall destroy criminal
523523 history record information that is obtained under this section
524524 after the information is used for its authorized purpose.
525525 SECTION 16. Section 411.093, Government Code, is amended to
526526 read as follows:
527527 Sec. 411.093. ACCESS TO CRIMINAL HISTORY RECORD
528528 INFORMATION: TEXAS DEPARTMENT OF LICENSING AND REGULATION. (a)
529529 The Texas Department of Licensing and Regulation is entitled to
530530 obtain [from the department] criminal history record information as
531531 provided by Subsection (b) [maintained the department] that
532532 relates to [a person who is]:
533533 (1) an applicant for or the holder of:
534534 (A) a driver education instructor license under
535535 Chapter 1001, Education Code;
536536 (B) a license under Chapter 202, Occupations
537537 Code;
538538 (C) a license under Chapter 401, Occupations
539539 Code;
540540 (D) a license under Chapter 402, Occupations Code
541541 [a license, certificate, registration, title, or permit issued by
542542 the department]; or
543543 (E) an instructor license or motorcycle school
544544 license under Chapter 662, Transportation Code;
545545 (2) a person who is:
546546 (A) an applicant for or the holder of a license
547547 under Chapter 91, Labor Code; or
548548 (B) a controlling person, as defined by Chapter
549549 91, Labor Code, of an entity described by Paragraph (A); or
550550 (3) a person who:
551551 (A) is an applicant for or the holder of a license
552552 under Chapter 455, Occupations Code; or
553553 (B) has an interest described under Section
554554 455.1525(e), Occupations Code, in an entity described by Paragraph
555555 (A)[, certificate, registration, title, or permit issued by the
556556 department].
557557 (b) Subject to Section 411.087 and consistent with the
558558 public policy of this state, the Texas Department of Licensing and
559559 Regulation is entitled to:
560560 (1) obtain through the Federal Bureau of Investigation
561561 criminal history record information maintained or indexed by that
562562 bureau that pertains to a person described by Subsection (a); and
563563 (2) obtain from the department or any other criminal
564564 justice agency in this state criminal history record information
565565 maintained by the department or that criminal justice agency that
566566 relates to a person described by Subsection (a).
567567 (c) The Texas Department of Licensing and Regulation may not
568568 release or disclose to any person criminal history record
569569 information obtained from the Federal Bureau of Investigation under
570570 Subsection (b)(1). Criminal history record information obtained by
571571 the Texas Department of Licensing and Regulation under Subsection
572572 (b)(2) may not be released or disclosed to any person except on
573573 court order, with the written consent of the person who is the
574574 subject of the criminal history record information, or as provided
575575 by Subsection (d).
576576 (d) The Texas Department of Licensing and Regulation is not
577577 prohibited from disclosing criminal history record information
578578 obtained under Subsection (b)(2) in a criminal proceeding or in a
579579 hearing conducted by the Texas Department of Licensing and
580580 Regulation or the State Office of Administrative Hearings.
581581 (e) The Texas Department of Licensing and Regulation shall
582582 destroy criminal history record information that is obtained under
583583 this section after the information is used for its authorized
584584 purpose.
585585 SECTION 17. Section 411.095, Government Code, is amended to
586586 read as follows:
587587 Sec. 411.095. ACCESS TO CRIMINAL HISTORY RECORD
588588 INFORMATION: CONSUMER CREDIT COMMISSIONER. (a) The consumer
589589 credit commissioner is entitled to obtain [from the department]
590590 criminal history record information as provided by Subsection (a-1)
591591 that relates to a person who is:
592592 (1) an applicant for or holder of a license or
593593 registration under Chapter 180, 342, 347, 348, 351, 353, 371, 393,
594594 or 394, Finance Code;
595595 (2) an employee of or volunteer with the Office of
596596 Consumer Credit Commissioner;
597597 (3) an applicant for employment with the Office of
598598 Consumer Credit Commissioner; [or]
599599 (4) a contractor or subcontractor of the Office of
600600 Consumer Credit Commissioner; or
601601 (5) an officer, director, owner, or employee of a
602602 person described by Subdivision (1) or another person having a
603603 substantial relationship with that person under Chapter 180, 342,
604604 347, 348, 351, 353, 371, 393, or 394, Finance Code.
605605 (a-1) Subject to Section 411.087 and consistent with the
606606 public policy of this state, the consumer credit commissioner is
607607 entitled to:
608608 (1) obtain through the Federal Bureau of Investigation
609609 criminal history record information maintained or indexed by that
610610 bureau that pertains to a person described by Subsection (a); and
611611 (2) obtain from the department or any other criminal
612612 justice agency in this state criminal history record information
613613 maintained by the department or that criminal justice agency that
614614 relates to a person described by Subsection (a).
615615 (b) The consumer credit commissioner may not release or
616616 disclose to any person criminal history record information obtained
617617 from the Federal Bureau of Investigation under Subsection (a-1)(1).
618618 The consumer credit commissioner may not release or disclose
619619 criminal history record information obtained under Subsection
620620 (a-1)(2) except [this section unless]:
621621 (1) [the information is obtained from a
622622 fingerprint-based search; and
623623 [(2) the information is released or disclosed:
624624 [(A)] on court order;
625625 (2) [(B)] to the person who is the subject of the
626626 criminal history record information; [or]
627627 (3) [(C)] with the consent of the person who is the
628628 subject of the criminal history record information; or
629629 (4) in a hearing where the Office of Consumer Credit
630630 Commissioner is a party.
631631 (c) The consumer credit commissioner shall destroy criminal
632632 history record information that is obtained under this section
633633 after the information is used for its authorized purpose.
634634 SECTION 18. Section 411.096, Government Code, is amended to
635635 read as follows:
636636 Sec. 411.096. ACCESS TO CRIMINAL HISTORY RECORD
637637 INFORMATION: TEXAS RACING COMMISSION. (a) The Texas Racing
638638 Commission is entitled to obtain as provided by Subsection (a-1)
639639 [from the department] criminal history record information
640640 [maintained by the department] that relates [pertains] to [a person
641641 who is]:
642642 (1) a person who:
643643 (A) is an applicant for or the holder of a license
644644 or certificate under Chapter 2025, Occupations Code;
645645 (B) is an owner or manager of an applicant or
646646 license holder described by Paragraph (A); or
647647 (C) has an interest described under Chapter 2025,
648648 Occupations Code, in an entity described by that chapter;
649649 (2) an applicant for employment at or current employee
650650 of:
651651 (A) the Texas Racing Commission; or
652652 (B) a place of employment within the racing
653653 industry of this state; or
654654 (3) an applicant for employment at, current employee
655655 of, or person who contracts or may contract to provide goods or
656656 services with the Texas Racing Commission [appointed to the
657657 commission;
658658 [(2) an applicant for employment by the commission; or
659659 [(3) an applicant for a license under Subtitle A-1,
660660 Title 13, Occupations Code (Texas Racing Act)].
661661 (a-1) Subject to Section 411.087 and consistent with the
662662 public policy of this state, the Texas Racing Commission is
663663 entitled to:
664664 (1) obtain through the Federal Bureau of Investigation
665665 criminal history record information maintained or indexed by that
666666 bureau that pertains to a person described by Subsection (a); and
667667 (2) obtain from the department or any other criminal
668668 justice agency in this state criminal history record information
669669 maintained by the department or that criminal justice agency that
670670 relates to a person described by Subsection (a).
671671 (b) The Texas Racing Commission may not release or disclose
672672 to any person criminal history record information obtained from the
673673 Federal Bureau of Investigation under Subsection (a-1)(1).
674674 Criminal history record information obtained by the Texas Racing
675675 Commission [commission] under Subsection (a-1)(2) [(a)] may not be
676676 released or disclosed to any person except [in a criminal
677677 proceeding, in a hearing conducted by the commission,] on court
678678 order, [or] with the written consent of the person who is the
679679 subject of the criminal history record information, or as provided
680680 by Subsection (c) [applicant].
681681 (c) The Texas Racing Commission is not prohibited from
682682 disclosing criminal history record information obtained under
683683 Subsection (a-1)(2) in a criminal proceeding or in a hearing
684684 conducted by the Texas Racing Commission or the State Office of
685685 Administrative Hearings.
686686 (d) The Texas Racing Commission shall destroy criminal
687687 history record information that is obtained under this section
688688 after the information is used for its authorized purpose.
689689 SECTION 19. Section 411.097, Government Code, is amended by
690690 amending Subsections (a), (b), (c), and (d) and adding Subsections
691691 (c-1), (g), and (h) to read as follows:
692692 (a) A school district, charter school, private school,
693693 regional education service center, commercial transportation
694694 company, or education shared services arrangement, or an entity
695695 that contracts to provide services to a school district, charter
696696 school, or shared services arrangement, is entitled to obtain [from
697697 the department] criminal history record information as provided by
698698 Subsection (c-1) [maintained by the department] that the district,
699699 school, service center, shared services arrangement, or entity is
700700 required or authorized to obtain under Subchapter C, Chapter 22,
701701 Education Code, that relates to a person who is:
702702 (1) an applicant for employment by the district,
703703 school, service center, or shared services arrangement;
704704 (2) an employee of or an applicant for employment with
705705 a public or commercial transportation company that contracts with
706706 the district, school, service center, or shared services
707707 arrangement to provide transportation services if the employee
708708 drives or the applicant will drive a bus in which students are
709709 transported or is employed or is seeking employment as a bus monitor
710710 or bus aide on a bus in which students are transported; [or]
711711 (3) an employee of or applicant for employment by an
712712 entity that contracts to provide services to a school district,
713713 charter school, or shared services arrangement as provided by
714714 Section 22.0834 [or 22.08341], Education Code;
715715 (4) an employee of or applicant for employment by a
716716 subcontractor of an entity that contracts to provide services to a
717717 school district, charter school, or shared services arrangement as
718718 provided by Section 22.0834, Education Code; or
719719 (5) a tutor who provides services on behalf of a
720720 service provider that offers accelerated or supplemental
721721 instruction under Section 28.0211, Education Code.
722722 (b) A school district, charter school, private school,
723723 regional education service center, or education shared services
724724 arrangement is entitled to obtain [from the department] criminal
725725 history record information as provided by Subsection (c-1)
726726 [maintained by the department] that the district, school, service
727727 center, or shared services arrangement is required or authorized to
728728 obtain under Subchapter C, Chapter 22, Education Code, that relates
729729 to a person who is a volunteer, student teacher, or employee of the
730730 district, school, service center, or shared services arrangement.
731731 (c) An open-enrollment charter school is entitled to obtain
732732 [from the department] criminal history record information as
733733 provided by Subsection (c-1) [maintained by the department] that
734734 relates to a person who:
735735 (1) is a member of the governing body of the school, as
736736 defined by Section 12.1012, Education Code; or
737737 (2) has agreed to serve as a member of the governing
738738 body of the school.
739739 (c-1) Subject to Section 411.087 and consistent with the
740740 public policy of this state:
741741 (1) a school district, charter school, regional
742742 education service center, or education shared services arrangement
743743 is entitled to obtain through the Federal Bureau of Investigation
744744 criminal history record information maintained or indexed by that
745745 bureau that pertains to a person described by Subsection (a), (b),
746746 or (c), as applicable; and
747747 (2) a school district, charter school, private school,
748748 regional education service center, commercial transportation
749749 company, or education shared services arrangement, or an entity
750750 that contracts to provide services to a school district, charter
751751 school, or shared services arrangement, is entitled to obtain from
752752 the department or any other criminal justice agency in this state
753753 criminal history record information maintained by the department or
754754 that criminal justice agency that relates to a person described by
755755 Subsection (a), (b), or (c), as applicable.
756756 (d) A school district, charter school, regional education
757757 service center, or education shared services arrangement may not
758758 release or disclose to any person criminal history record
759759 information obtained from the Federal Bureau of Investigation under
760760 Subsection (c-1)(1). Criminal history record information obtained
761761 by a school district, charter school, private school, service
762762 center, commercial transportation company, or shared services
763763 arrangement, or obtained by an entity that contracts to provide
764764 services to a school district, charter school, or shared services
765765 arrangement, under Subsection (c-1)(2) in the original form or any
766766 subsequent form:
767767 (1) may not be released to any person except:
768768 (A) the individual who is the subject of the
769769 information;
770770 (B) the Texas Education Agency;
771771 (C) the State Board for Educator Certification;
772772 (D) the chief personnel officer of the
773773 transportation company, if the information is obtained under
774774 Subsection (a)(2); or
775775 (E) by court order; and
776776 (2) is not subject to disclosure as provided by
777777 Chapter 552[; and
778778 [(3) shall be destroyed by the school district,
779779 charter school, private school, service center, commercial
780780 transportation company, or shared services arrangement on the
781781 earlier of:
782782 [(A) the first anniversary of the date the
783783 information was originally obtained; or
784784 [(B) the date the information is used for the
785785 authorized purpose].
786786 (g) A school district, charter school, private school,
787787 regional education service center, commercial transportation
788788 company, or education shared services arrangement or an entity that
789789 contracts to provide services to a school district, charter school,
790790 or shared services arrangement, as applicable, is not prohibited
791791 from disclosing criminal history record information obtained under
792792 Subsection (c-1)(2) in a criminal proceeding or in a hearing
793793 conducted by the Texas Education Agency or the State Board for
794794 Educator Certification.
795795 (h) A school district, charter school, private school,
796796 regional education service center, commercial transportation
797797 company, or education shared services arrangement or an entity that
798798 contracts to provide services to a school district, charter school,
799799 or shared services arrangement, as applicable, shall destroy
800800 criminal history record information that is obtained under this
801801 section after the information is used for its authorized purpose.
802802 SECTION 20. Section 411.0995, Government Code, is amended
803803 to read as follows:
804804 Sec. 411.0995. ACCESS TO CRIMINAL HISTORY RECORD
805805 INFORMATION: STATE BOARD OF VETERINARY MEDICAL EXAMINERS. (a) The
806806 State Board of Veterinary Medical Examiners is entitled to obtain
807807 [from the department] criminal history record information as
808808 provided by Subsection (b) [maintained by the department] that
809809 relates to a license under Chapter 801, Occupations Code, for a
810810 person who is:
811811 (1) an applicant for:
812812 (A) a license, temporary license, or special
813813 license to practice veterinary medicine;
814814 (B) a veterinary technician license; or
815815 (C) an equine dental provider license; or
816816 (2) a holder of a license described by Subdivision
817817 (1)(A), (B), or (C) [(1) an applicant for a license to practice
818818 equine dentistry under Chapter 801, Occupations Code; or
819819 [(2) the holder of a license under that chapter].
820820 (b) Subject to Section 411.087 and consistent with the
821821 public policy of this state, the State Board of Veterinary Medical
822822 Examiners is entitled to:
823823 (1) obtain through the Federal Bureau of Investigation
824824 criminal history record information maintained or indexed by that
825825 bureau that pertains to a person described by Subsection (a); and
826826 (2) obtain from the department or any other criminal
827827 justice agency in this state criminal history record information
828828 maintained by the department or that criminal justice agency that
829829 relates to a person described by Subsection (a).
830830 (c) The State Board of Veterinary Medical Examiners may not
831831 release or disclose to any person criminal history record
832832 information obtained from the Federal Bureau of Investigation under
833833 Subsection (b)(1). Criminal history record information obtained by
834834 the State Board of Veterinary Medical Examiners under Subsection
835835 (b)(2) may not be released or disclosed to any person except on
836836 court order, with the written consent of the person who is the
837837 subject of the criminal history record information, or as provided
838838 by Subsection (d).
839839 (d) The State Board of Veterinary Medical Examiners is not
840840 prohibited from disclosing criminal history record information
841841 obtained under Subsection (b)(2) in a criminal proceeding or in a
842842 hearing conducted by the State Board of Veterinary Medical
843843 Examiners.
844844 (e) The State Board of Veterinary Medical Examiners shall
845845 destroy criminal history record information that is obtained under
846846 this section after the information is used for its authorized
847847 purpose.
848848 SECTION 21. Section 411.105, Government Code, is amended to
849849 read as follows:
850850 Sec. 411.105. ACCESS TO CRIMINAL HISTORY RECORD
851851 INFORMATION: TEXAS STATE BOARD OF PUBLIC ACCOUNTANCY. (a) The
852852 Texas State Board of Public Accountancy is entitled to obtain [from
853853 the department] criminal history record information as provided by
854854 Subsection (b) [maintained by the department] that relates to [a
855855 person who is]:
856856 (1) an applicant for a license or certification as a
857857 certified public accountant under Chapter 901, Occupations Code;
858858 [or]
859859 (2) an applicant to take the uniform certified public
860860 accountant [CPA] examination under Chapter 901, Occupations Code;
861861 (3) an applicant for reinstatement of a license or
862862 certificate under Chapter 901, Occupations Code;
863863 (4) an applicant for a license or certification
864864 renewal under Chapter 901, Occupations Code; or
865865 (5) an owner or an individual who seeks to become an
866866 owner of a certified public accountancy firm if the owner or
867867 prospective owner is not a license holder under Chapter 901,
868868 Occupations Code [that Act].
869869 (b) Subject to Section 411.087 of this code and Section
870870 901.169, Occupations Code, and consistent with the public policy of
871871 this state, the Texas State Board of Public Accountancy is entitled
872872 to:
873873 (1) obtain through the Federal Bureau of Investigation
874874 criminal history record information maintained or indexed by that
875875 bureau that pertains to a person described by Subsection (a); and
876876 (2) obtain from the department or any other criminal
877877 justice agency in this state criminal history record information
878878 maintained by the department or that criminal justice agency that
879879 relates to a person described by Subsection (a).
880880 (c) The Texas State Board of Public Accountancy may not
881881 release or disclose to any person criminal history record
882882 information obtained from the Federal Bureau of Investigation under
883883 Subsection (b)(1). Criminal history record information obtained by
884884 the board under Subsection (b)(2) may not be released or disclosed
885885 to any person except on court order, with the written consent of the
886886 person who is the subject of the criminal history record
887887 information, or as provided by Subsection (d).
888888 (d) The board is not prohibited from disclosing criminal
889889 history record information obtained under Subsection (b)(2) in a
890890 criminal proceeding or in a hearing conducted by or on behalf of the
891891 board.
892892 (e) The board shall destroy criminal history record
893893 information that is obtained under this section after the
894894 information is used for its authorized purpose.
895895 SECTION 22. Section 411.106, Government Code, is amended to
896896 read as follows:
897897 Sec. 411.106. ACCESS TO CRIMINAL HISTORY RECORD
898898 INFORMATION: TEXAS DEPARTMENT OF INSURANCE. (a) The Texas
899899 Department of Insurance [for good cause shown] is entitled to
900900 obtain [from the department] criminal history record information as
901901 provided by Subsection (a-1) [maintained by the department] that
902902 relates to a person who is:
903903 (1) an applicant for a license, permit, certificate of
904904 authority, certificate of registration, or other authorization
905905 issued by the Texas Department [State Board] of Insurance to engage
906906 in an activity regulated under the Insurance Code; or
907907 (2) a corporate officer or director of an insurance
908908 company regulated by the Texas Department of Insurance.
909909 (a-1) Subject to Section 411.087 and consistent with the
910910 public policy of this state, the Texas Department of Insurance is
911911 entitled to:
912912 (1) obtain through the Federal Bureau of Investigation
913913 criminal history record information maintained or indexed by that
914914 bureau that pertains to a person described by Subsection (a); and
915915 (2) obtain from the department or any other criminal
916916 justice agency in this state criminal history record information
917917 maintained by the department or that criminal justice agency that
918918 relates to a person described by Subsection (a).
919919 (b) The Texas Department of Insurance may not release or
920920 disclose to any person criminal history record information obtained
921921 from the Federal Bureau of Investigation under Subsection (a-1)(1).
922922 Criminal history record information obtained by the Texas
923923 Department of Insurance under Subsection (a-1)(2) [(a)] may not be
924924 disclosed or released to any person except on court order, [or] with
925925 the written consent of the person who is the subject of the criminal
926926 history record information, or as provided by Subsection (b-1).
927927 (b-1) The Texas Department of Insurance is not prohibited
928928 from disclosing criminal history record information obtained under
929929 Subsection (a-1)(2) in a criminal proceeding or in a hearing
930930 conducted by the Texas Department of Insurance.
931931 (c) The [After the] Texas Department of Insurance [makes a
932932 determination as to the issuance of a license or certificate of
933933 authority to an applicant, the Texas Department of Insurance] shall
934934 destroy [seal the] criminal history record information that is
935935 obtained under this section after the information is used for its
936936 authorized purpose [regarding the applicant and shall deliver the
937937 information to the commissioner of insurance or the commissioner's
938938 designee, who shall maintain the information as provided by State
939939 Board of Insurance rule].
940940 SECTION 23. Section 411.107, Government Code, is amended to
941941 read as follows:
942942 Sec. 411.107. ACCESS TO CRIMINAL HISTORY RECORD
943943 INFORMATION: RECEIVER. (a) In this section, "receiver" has the
944944 meaning assigned by Section 443.004 [Article 21.28], Insurance
945945 Code.
946946 (b) A receiver is entitled to obtain [from the department]
947947 criminal history record information as provided by Subsection (b-1)
948948 [maintained by the department] that relates to a person:
949949 (1) who is a creditor or claimant of the receivership
950950 estate; or
951951 (2) against whom the receivership estate has a claim
952952 [the receiver believes is necessary for the investigation of any
953953 matter relating to a receivership estate].
954954 (b-1) A receiver is entitled to obtain from the department
955955 or any other criminal justice agency in this state criminal history
956956 record information maintained by the department or that criminal
957957 justice agency that relates to a person described by Subsection
958958 (b).
959959 (c) Criminal history record information obtained by a
960960 receiver under Subsection (b-1) [(b)] may not be released or
961961 disclosed to any person except on court order or with the written
962962 consent of the person who is the subject of the criminal history
963963 record information.
964964 (d) A receiver shall [may] destroy criminal history record
965965 information obtained by the receiver under this section [Subsection
966966 (b)] after the purpose for which the information was obtained is
967967 accomplished.
968968 SECTION 24. Section 411.108, Government Code, is amended to
969969 read as follows:
970970 Sec. 411.108. ACCESS TO CRIMINAL HISTORY RECORD
971971 INFORMATION: TEXAS LOTTERY COMMISSION. (a) The Texas Lottery
972972 Commission is entitled to obtain [from the department] criminal
973973 history record information as provided by Subsection (a-2)
974974 [maintained by the department] that relates to a person who, under
975975 Section 466.201 [under Chapter 466], is:
976976 (1) a sales agent or an applicant for a sales agent
977977 license;
978978 (2) a person required to be named in a license
979979 application;
980980 (3) a lottery operator or prospective lottery operator
981981 who has submitted a written proposal to the commission in
982982 connection with the procurement of lottery operations and services
983983 by the commission;
984984 (4) an employee of a lottery operator or prospective
985985 lottery operator, if the employee is or will be directly involved in
986986 lottery operations;
987987 (5) a person who manufactures or distributes lottery
988988 equipment or supplies or a representative of a person who
989989 manufactures or distributes lottery equipment or supplies offered
990990 to the lottery;
991991 (6) a person who has submitted a written bid or
992992 proposal to the commission in connection with the procurement of
993993 goods or services by the commission, if the amount of the bid or
994994 proposal exceeds $500;
995995 (7) an employee or other person who works for or will
996996 work for a sales agent or an applicant for a sales agent license;
997997 (8) a person who proposes to enter into or who has a
998998 contract with the commission to supply goods or services to the
999999 commission;
10001000 (9) if a person described in Subdivisions (1) through
10011001 (8) of this section is not an individual, an individual who:
10021002 (A) is an officer or director of the person;
10031003 (B) holds more than 10 percent of the stock in the
10041004 person;
10051005 (C) holds an equitable interest greater than 10
10061006 percent in the person;
10071007 (D) is a creditor of the person who holds more
10081008 than 10 percent of the person's outstanding debt;
10091009 (E) is the owner or lessee of a business that the
10101010 person conducts or through which the person will conduct
10111011 lottery-related activities;
10121012 (F) shares or will share in the profits, other
10131013 than stock dividends, of the person;
10141014 (G) participates in managing the affairs of the
10151015 person; or
10161016 (H) is an employee of the person who is or will be
10171017 involved in:
10181018 (i) selling tickets; or
10191019 (ii) handling money from the sale of
10201020 tickets;
10211021 (10) the executive director or a prospective executive
10221022 director of the commission;
10231023 (11) an employee or prospective employee of the
10241024 commission; or
10251025 (12) a sales agent whose license is renewed under
10261026 Section 466.158.
10271027 (a-1) The Texas Lottery Commission is entitled to obtain
10281028 [from the department] criminal history record information as
10291029 provided by Subsection (a-2) [maintained by the department] that
10301030 relates to a person licensed under Chapter 2001, Occupations Code,
10311031 or described by Section 2001.3025, Occupations Code.
10321032 (a-2) Subject to Sections 411.087, 466.201, and 467.036(b)
10331033 of this code and Section 2001.3025, Occupations Code, and
10341034 consistent with the public policy of this state, the Texas Lottery
10351035 Commission is entitled to:
10361036 (1) obtain through the Federal Bureau of Investigation
10371037 criminal history record information maintained or indexed by that
10381038 bureau that pertains to a person described by Subsection (a) or
10391039 (a-1); and
10401040 (2) obtain from the department or any other criminal
10411041 justice agency in this state criminal history record information
10421042 maintained by the department or that criminal justice agency that
10431043 relates to a person described by Subsection (a) or (a-1).
10441044 (b) The Texas Lottery Commission may not release or disclose
10451045 to any person criminal history record information obtained from the
10461046 Federal Bureau of Investigation under Subsection (a-2)(1).
10471047 Criminal history record information obtained by the commission
10481048 under Subsection (a-2)(2) [(a) or (a-1)] may not be released or
10491049 disclosed to any person except on court order, with the written
10501050 consent of the person who is the subject of the criminal history
10511051 record information, or as provided by Subsection (c) or (d).
10521052 (c) The Texas Lottery Commission [commission] is not
10531053 prohibited from disclosing to the person who is the subject of the
10541054 criminal history record information obtained under Subsection
10551055 (a-2)(2) the dates and places of arrests, offenses, and
10561056 dispositions contained in the [criminal history record]
10571057 information.
10581058 (d) The Texas Lottery Commission is not prohibited from
10591059 disclosing criminal history record information obtained under
10601060 Subsection (a-2)(2) in a criminal proceeding or in a hearing
10611061 conducted by the State Office of Administrative Hearings.
10621062 (e) The Texas Lottery Commission shall destroy criminal
10631063 history record information that is obtained under this section
10641064 after the information is used for its authorized purpose.
10651065 SECTION 25. Section 411.109, Government Code, is amended by
10661066 amending Subsections (a), (b), and (d) and adding Subsections (c),
10671067 (f), and (g) to read as follows:
10681068 (a) The comptroller is entitled to obtain [from the
10691069 department] criminal history record information as provided by
10701070 Subsection (c) [maintained by the department] that the comptroller
10711071 believes is necessary for the enforcement or administration of
10721072 Chapter 103, Civil Practice and Remedies Code, or Chapter 151, 152,
10731073 154, 155, or 162, Tax Code, including criminal history record
10741074 information that relates to a person who is:
10751075 (1) an applicant for a permit under any of those
10761076 chapters;
10771077 (2) a permit holder under any of those chapters;
10781078 (3) an officer, director, stockholder owning 10
10791079 percent or more of the outstanding stock, partner, owner, or
10801080 managing employee of an applicant or permit holder under any of
10811081 those chapters that is a corporation, association, joint venture,
10821082 syndicate, partnership, or proprietorship;
10831083 (4) believed to have violated any of those chapters;
10841084 (5) being considered by the comptroller for employment
10851085 as a peace officer; or
10861086 (6) receiving, scheduled to receive, or applying to
10871087 receive compensation under Chapter 103, Civil Practice and Remedies
10881088 Code.
10891089 (b) The comptroller is entitled to obtain [from the
10901090 department] criminal history record information as provided by
10911091 Subsection (c) [maintained by the department] that relates to a
10921092 person who is an employee, intern, learner, trainee, contractor,
10931093 subcontractor, apprentice, or volunteer of, or who is an applicant
10941094 for employment or service in one of those capacities with, the
10951095 comptroller's office in a position that involves:
10961096 (1) handling currency, checks, or other funds;
10971097 (2) having access to taxpayer account information;
10981098 (3) working in a location designated by the
10991099 comptroller as a security-sensitive area; [or]
11001100 (4) performing financial management duties designated
11011101 by the comptroller as security sensitive;
11021102 (5) performing work on a computer system; or
11031103 (6) having remote access to comptroller computer
11041104 systems, information technology, or information technology
11051105 resources.
11061106 (c) Subject to Section 411.087 and consistent with the
11071107 public policy of this state, the comptroller is entitled to:
11081108 (1) obtain through the Federal Bureau of Investigation
11091109 criminal history record information maintained or indexed by that
11101110 bureau that pertains to a person described by Subsection (a) or (b);
11111111 and
11121112 (2) obtain from the department or any other criminal
11131113 justice agency in this state criminal history record information
11141114 maintained by the department or that criminal justice agency that
11151115 relates to a person described by Subsection (a) or (b).
11161116 (d) The comptroller may not release or disclose to any
11171117 person criminal history record information obtained from the
11181118 Federal Bureau of Investigation under Subsection (c)(1). Criminal
11191119 history record information obtained by the comptroller under
11201120 Subsection (c)(2) [Subsections (a), (b), and (c)] may not be
11211121 released or disclosed to any person except on court order, with the
11221122 written consent of the person who is the subject of the criminal
11231123 history record information, or as provided by Subsection (e) or
11241124 (f).
11251125 (f) The comptroller is not prohibited from disclosing
11261126 criminal history record information obtained under Subsection
11271127 (c)(2) in a criminal proceeding or in a hearing conducted by the
11281128 comptroller.
11291129 (g) The comptroller shall destroy criminal history record
11301130 information that is obtained under this section after the
11311131 information is used for its authorized purpose.
11321132 SECTION 26. Section 411.110, Government Code, is amended by
11331133 amending Subsections (a), (b), (c), and (e) and adding Subsection
11341134 (a-1) to read as follows:
11351135 (a) The Department of State Health Services and the Health
11361136 and Human Services Commission are entitled to obtain [from the
11371137 department] criminal history record information as provided by
11381138 Subsection (a-1) [maintained by the department] that relates to a
11391139 person who is:
11401140 (1) [a person who is:
11411141 [(A)] an applicant for a license or certificate
11421142 under Chapter 773, Health and Safety Code, [the Emergency Health
11431143 Care Act (Chapter 773, Health and Safety Code);]
11441144 [(B)] an owner or manager of an applicant for an
11451145 emergency medical services provider license under that chapter,
11461146 [Act;] or
11471147 [(C)] the holder of a license or certificate
11481148 under that chapter [Act];
11491149 (2) an applicant for a license or a license holder
11501150 under Subchapter I, L, or [Subchapter] N, Chapter 431, Health and
11511151 Safety Code;
11521152 (3) an applicant for employment at or current employee
11531153 of:
11541154 (A) a public health hospital as defined by
11551155 Section 13.033, Health and Safety Code; or
11561156 (B) the South Texas Health Care System;
11571157 (4) an applicant for employment at, current employee
11581158 of, or person who contracts or may contract to provide goods or
11591159 services with the Council on Sex Offender Treatment or other
11601160 division or component of the Health and Human Services Commission
11611161 that monitors sexually violent predators as described by Section
11621162 841.003(a), Health and Safety Code; [or]
11631163 (5) [a person] authorized to access vital records or
11641164 the vital records electronic registration system under Chapter 191,
11651165 Health and Safety Code, including an employee of or contractor for
11661166 the Department of State Health Services, a local registrar, a
11671167 medical professional, or a funeral director; or
11681168 (6) an applicant for a license or a license holder
11691169 under Subchapter C, Chapter 443, Health and Safety Code.
11701170 (a-1) Subject to Section 411.087 and consistent with the
11711171 public policy of this state, the Department of State Health
11721172 Services and the Health and Human Services Commission are entitled
11731173 to:
11741174 (1) obtain through the Federal Bureau of Investigation
11751175 criminal history record information maintained or indexed by that
11761176 bureau that pertains to a person described by Subsection (a); and
11771177 (2) obtain from the department or any other criminal
11781178 justice agency in this state criminal history record information
11791179 maintained by the department or that criminal justice agency that
11801180 relates to a person described by Subsection (a).
11811181 (b) The Department of State Health Services or the Health
11821182 and Human Services Commission, as applicable, may not release or
11831183 disclose to any person criminal history record information obtained
11841184 from the Federal Bureau of Investigation under Subsection
11851185 (a-1)(1). Criminal history record information obtained by the
11861186 Department of State Health Services or the Health and Human
11871187 Services Commission under Subsection (a-1)(2) [(a)] may not be
11881188 released or disclosed to any person except:
11891189 (1) on court order;
11901190 (2) [,] with the written consent of the person who [or
11911191 entity that] is the subject of the criminal history record
11921192 information;
11931193 (3) between the Department of State Health Services
11941194 and the Health and Human Services Commission to share with the other
11951195 agency information obtained under this section for the purposes
11961196 authorized by this section; or
11971197 (4) [, or] as provided by Subsection (e).
11981198 (c) The [After an entity is licensed or certified, the]
11991199 Department of State Health Services or the Health and Human
12001200 Services Commission, as applicable, shall destroy the criminal
12011201 history record information that is obtained under this section
12021202 after the information is used for its authorized purpose [relates
12031203 to that entity. The Department of State Health Services or the
12041204 Health and Human Services Commission, as applicable, shall destroy
12051205 the criminal history record information that relates to:
12061206 [(1) an applicant for employment after that applicant
12071207 is employed or, for an applicant who is not employed, after the
12081208 check of the criminal history record information on that applicant
12091209 is completed; or
12101210 [(2) an employee or contractor after the check of the
12111211 criminal history record information on that employee or contractor
12121212 is completed].
12131213 (e) The Department of State Health Services or the Health
12141214 and Human Services Commission, as applicable, is not prohibited
12151215 from disclosing criminal history record information obtained under
12161216 Subsection (a-1)(2) [(a)] in a criminal proceeding or in a hearing
12171217 conducted by that agency [the Department of State Health Services
12181218 or the Health and Human Services Commission, as applicable].
12191219 SECTION 27. Section 411.1103, Government Code, is amended
12201220 to read as follows:
12211221 Sec. 411.1103. ACCESS TO CRIMINAL HISTORY RECORD
12221222 INFORMATION: [DEPARTMENT OF STATE HEALTH SERVICES AND] HEALTH AND
12231223 HUMAN SERVICES COMMISSION. (a) The [Department of State Health
12241224 Services and the] Health and Human Services Commission is [are]
12251225 entitled to obtain [from the department] criminal history record
12261226 information as provided by Subsection (d) [maintained by the
12271227 department] that relates to a person:
12281228 (1) who is:
12291229 (A) an applicant for employment at a state
12301230 hospital established under Chapter 552, Health and Safety Code;
12311231 (B) an employee of a state hospital established
12321232 under Chapter 552, Health and Safety Code;
12331233 (C) a person who contracts or may contract to
12341234 provide goods or services to the [Department of State Health
12351235 Services or the] Health and Human Services Commission, as
12361236 applicable, at a state hospital established under Chapter 552,
12371237 Health and Safety Code, or an employee of or applicant for
12381238 employment with that person;
12391239 (D) a volunteer with a state hospital established
12401240 under Chapter 552, Health and Safety Code; or
12411241 (E) an applicant for a volunteer position with a
12421242 state hospital established under Chapter 552, Health and Safety
12431243 Code; and
12441244 (2) who would be placed in direct contact with a
12451245 patient at a state hospital established under Chapter 552, Health
12461246 and Safety Code.
12471247 (b) The Health and Human Services Commission may not release
12481248 or disclose to any person criminal history record information
12491249 obtained from the Federal Bureau of Investigation under Subsection
12501250 (d)(1). Criminal history record information obtained by the
12511251 [Department of State Health Services or the] Health and Human
12521252 Services Commission under Subsection (d)(2) [this section] may not
12531253 be released or disclosed to any person except:
12541254 (1) on court order;
12551255 (2) with the consent of the person who is the subject
12561256 of the criminal history record information;
12571257 (3) for purposes of an administrative hearing held by
12581258 the [Department of State Health Services or the] Health and Human
12591259 Services Commission[, as applicable,] concerning the person who is
12601260 the subject of the criminal history record information; or
12611261 (4) as provided by Subsection (c).
12621262 (c) The [Department of State Health Services or the] Health
12631263 and Human Services Commission is not prohibited from releasing
12641264 criminal history record information obtained under Subsection
12651265 (d)(2) [this section] to the person who is the subject of the
12661266 criminal history record information.
12671267 (d) Subject to Section 411.087 and consistent with the
12681268 public policy of this state, the [Department of State Health
12691269 Services and the] Health and Human Services Commission is [are]
12701270 entitled to:
12711271 (1) obtain through the Federal Bureau of Investigation
12721272 criminal history record information maintained or indexed by that
12731273 bureau that pertains to a person described by Subsection (a); and
12741274 (2) obtain from the department or any other criminal
12751275 justice agency in this state criminal history record information
12761276 maintained by the department or that criminal justice agency that
12771277 relates to a person described by Subsection (a).
12781278 (e) This section does not prohibit the [Department of State
12791279 Health Services or the] Health and Human Services Commission from
12801280 obtaining and using criminal history record information as provided
12811281 by other law.
12821282 (f) The Health and Human Services Commission shall destroy
12831283 criminal history record information that is obtained under this
12841284 section after the information is used for its authorized purpose.
12851285 SECTION 28. Section 411.1105, Government Code, is amended
12861286 to read as follows:
12871287 Sec. 411.1105. ACCESS TO CRIMINAL HISTORY RECORD
12881288 INFORMATION: [DEPARTMENT OF STATE HEALTH SERVICES AND] HEALTH AND
12891289 HUMAN SERVICES COMMISSION. (a) The [Department of State Health
12901290 Services and the] Health and Human Services Commission is [are]
12911291 entitled to obtain [from the department] criminal history record
12921292 information as provided by Subsections (a-1) and (b) [maintained by
12931293 the department] that relates to a person who is:
12941294 (1) an applicant for a chemical dependency counselor's
12951295 license, a counselor intern's registration, or a clinical
12961296 supervisor certification under Chapter 504, Occupations Code; or
12971297 (2) the holder of a license, registration, or
12981298 certification under that chapter.
12991299 (a-1) Subject to Section 411.087 and consistent with the
13001300 public policy of this state, the Health and Human Services
13011301 Commission is entitled to:
13021302 (1) obtain through the Federal Bureau of Investigation
13031303 criminal history record information maintained or indexed by that
13041304 bureau that pertains to a person described by Subsection (a); and
13051305 (2) obtain from the department or any other criminal
13061306 justice agency in this state criminal history record information
13071307 maintained by the department or that criminal justice agency that
13081308 relates to a person described by Subsection (a).
13091309 (b) In addition to information obtained from the Federal
13101310 Bureau of Investigation under Subsection (a-1)(1) and Section
13111311 411.087, the [Department of State Health Services and the] Health
13121312 and Human Services Commission is [are] entitled to obtain
13131313 information relating to the wanted persons status of an individual
13141314 listed in Subsection (a).
13151315 (c) The Health and Human Services Commission may not release
13161316 or disclose to any person criminal history record information
13171317 obtained from the Federal Bureau of Investigation under Subsection
13181318 (a-1)(1) or (b). Criminal history record information obtained by
13191319 the [Department of State Health Services or the] Health and Human
13201320 Services Commission under Subsection (a-1)(2) [(a)] may not be
13211321 released or disclosed to any person except:
13221322 (1) on court order;
13231323 (2) [,] with the consent of the person who is the
13241324 subject of the criminal history record information; [,] or
13251325 (3) as provided by Subsection (d).
13261326 (d) The [Department of State Health Services or the] Health
13271327 and Human Services Commission[, as applicable,] may provide the
13281328 applicant or licensee with a copy of the person's criminal history
13291329 record information obtained from the Department of Public Safety [,
13301330 Federal Bureau of Investigation identification division,] or
13311331 another law enforcement agency under Subsection (a-1)(2).
13321332 (e) This section does not prohibit the Health and Human
13331333 Services Commission from obtaining and using criminal history
13341334 record information as provided by other law.
13351335 (f) The Health and Human Services Commission shall destroy
13361336 criminal history record information that is obtained under this
13371337 section after the information is used for its authorized purpose.
13381338 SECTION 29. Section 411.1106, Government Code, is amended
13391339 by amending Subsections (b), (c), (d), and (e) and adding
13401340 Subsections (b-1) and (f) to read as follows:
13411341 (b) The executive commissioner of the commission, or the
13421342 executive commissioner's designee, is entitled to obtain [from the
13431343 department] criminal history record information as provided by
13441344 Subsection (b-1) [maintained by the department] that relates to a
13451345 person who is:
13461346 (1) an applicant [for employment] for a position in
13471347 which the person, as an employee, contractor, or volunteer, would
13481348 have access to sensitive personal or financial information, as
13491349 determined by the executive commissioner, in:
13501350 (A) the eligibility services division of the
13511351 commission as established under Section 531.008; [or]
13521352 (B) the commission's office of inspector general
13531353 as established by Section 531.008 and Subchapter C, Chapter 531; or
13541354 (C) the regulatory division of the commission as
13551355 established under Section 531.008; or
13561356 (2) an employee of or a contractor or volunteer for the
13571357 commission who has access to sensitive personal or financial
13581358 information, as determined by the executive commissioner.
13591359 (b-1) Subject to Section 411.087 and consistent with the
13601360 public policy of this state, the commission is entitled to:
13611361 (1) obtain through the Federal Bureau of Investigation
13621362 criminal history record information maintained or indexed by that
13631363 bureau that pertains to a person described by Subsection (b); and
13641364 (2) obtain from the department or any other criminal
13651365 justice agency in this state criminal history record information
13661366 maintained by the department or that criminal justice agency that
13671367 relates to a person described by Subsection (b).
13681368 (c) The commission may not release or disclose to any person
13691369 criminal history record information obtained from the Federal
13701370 Bureau of Investigation under Subsection (b-1)(1). Criminal
13711371 history record information obtained by the executive commissioner
13721372 of the commission, or by the executive commissioner's designee,
13731373 under Subsection (b-1)(2) [(b)] may not be released or disclosed,
13741374 except:
13751375 (1) if the information is in a public record at the
13761376 time the information is obtained;
13771377 (2) on court order;
13781378 (3) to a criminal justice agency, upon request;
13791379 (4) with the consent of the person who is the subject
13801380 of the criminal history record information; or
13811381 (5) as provided by Subsection (d).
13821382 (d) The commission is not prohibited from disclosing
13831383 criminal history record information obtained under Subsection
13841384 (b-1)(2) [(b)] in a criminal proceeding or in a hearing conducted by
13851385 the commission.
13861386 (e) The executive commissioner shall destroy [all] criminal
13871387 history record information obtained under this section [Subsection
13881388 (b)] as soon as practicable after the information is used for its
13891389 authorized purpose.
13901390 (f) This section does not prohibit the commission from
13911391 obtaining and using criminal history record information as provided
13921392 by other law.
13931393 SECTION 30. Section 411.1131, Government Code, is amended
13941394 to read as follows:
13951395 Sec. 411.1131. ACCESS TO CRIMINAL HISTORY RECORD
13961396 INFORMATION: HEALTH AND HUMAN SERVICES COMMISSION. (a) The Health
13971397 and Human Services Commission is entitled to obtain [from the
13981398 department] criminal history record information as provided by
13991399 Subsection (a-1) [maintained by the department] that relates to a
14001400 person who is an applicant for a staff position at an outdoor
14011401 training program for children who are deaf or hard of hearing
14021402 conducted by a private entity through a contract with the Health and
14031403 Human Services Commission in accordance with Section 81.013, Human
14041404 Resources Code.
14051405 (a-1) Subject to Section 411.087 and consistent with the
14061406 public policy of this state, the Health and Human Services
14071407 Commission is entitled to:
14081408 (1) obtain through the Federal Bureau of Investigation
14091409 criminal history record information maintained or indexed by that
14101410 bureau that pertains to a person described by Subsection (a); and
14111411 (2) obtain from the department or any other criminal
14121412 justice agency in this state criminal history record information
14131413 maintained by the department or that criminal justice agency that
14141414 relates to a person described by Subsection (a).
14151415 (b) Criminal history record information obtained by the
14161416 Health and Human Services Commission under Subsection (a-1) [(a)]
14171417 may be used only to evaluate an applicant for a staff position at an
14181418 outdoor training program for children who are deaf or hard of
14191419 hearing. The Health and Human Services Commission may release or
14201420 disclose the information obtained under Subsection (a-1)(2) to a
14211421 private entity described by Subsection (a) for that purpose.
14221422 (c) The Health and Human Services Commission may not release
14231423 or disclose to any person criminal history record information
14241424 obtained from the Federal Bureau of Investigation under Subsection
14251425 (a-1)(1). The Health and Human Services Commission may not release
14261426 or disclose information obtained under Subsection (a-1)(2) [(a)],
14271427 except as described by Subsection (b), on court order, or with the
14281428 consent of the person who is the subject of the criminal history
14291429 record information.
14301430 (d) The Health and Human Services Commission[, and] shall
14311431 destroy [all] criminal history record information obtained under
14321432 Subsection (a-1) [(a)] after the information is used for its
14331433 authorized purpose.
14341434 (e) This section does not prohibit the Health and Human
14351435 Services Commission from obtaining and using criminal history
14361436 record information as provided by other law.
14371437 SECTION 31. Section 411.114(a), Government Code, is amended
14381438 by amending Subdivisions (2), (3), (4), (6), and (7) and adding
14391439 Subdivision (4-a) to read as follows:
14401440 (2) The Department of Family and Protective Services
14411441 or the Health and Human Services Commission, as applicable, shall
14421442 obtain [from the department] criminal history record information as
14431443 provided by Subdivision (4) [maintained by the department] that
14441444 relates to a person who is:
14451445 (A) an applicant for a license, registration,
14461446 certification, or listing under Chapter 42, Human Resources Code;
14471447 (B) an owner, operator, or employee of or an
14481448 applicant for employment by a child-care facility, child-placing
14491449 agency, or family home licensed, registered, certified, or listed
14501450 under Chapter 42, Human Resources Code;
14511451 (C) a person 14 years of age or older who will be
14521452 regularly or frequently working or staying in a facility or family
14531453 home, other than a child in the care of the home or facility;
14541454 (D) an applicant selected for a position with the
14551455 Department of Family and Protective Services or the Health and
14561456 Human Services Commission, the duties of which include direct
14571457 delivery of protective services to children, elderly persons, or
14581458 persons with a disability;
14591459 (E) an employee of, an applicant for employment
14601460 with, or a volunteer or an applicant volunteer with a business
14611461 entity or person who [that] contracts with the Department of Family
14621462 and Protective Services or the Health and Human Services Commission
14631463 to provide direct delivery of protective services to children,
14641464 elderly persons, or persons with a disability, if the person's
14651465 duties or responsibilities include direct contact with children,
14661466 elderly persons, or persons with a disability;
14671467 (F) a registered volunteer with the Department of
14681468 Family and Protective Services or the Health and Human Services
14691469 Commission;
14701470 (G) a person providing or applying to provide
14711471 in-home, adoptive, or foster care for children in the care of the
14721472 Department of Family and Protective Services or the Health and
14731473 Human Services Commission and other persons living in the residence
14741474 in which the child will reside;
14751475 (H) a Department of Family and Protective
14761476 Services employee or a Health and Human Services Commission
14771477 employee who is engaged in the direct delivery of protective
14781478 services to children, elderly persons, or persons with a
14791479 disability;
14801480 (I) an alleged perpetrator in a report the
14811481 Department of Family and Protective Services or the Health and
14821482 Human Services Commission receives alleging that the person has
14831483 abused, neglected, or exploited a child, an elderly person, or a
14841484 person with a disability, provided that:
14851485 (i) the report alleges the person has
14861486 engaged in conduct that meets the applicable definition of abuse,
14871487 neglect, or exploitation under Chapter 261, Family Code, or Chapter
14881488 48, Human Resources Code; and
14891489 (ii) the person is not also the victim of
14901490 the alleged conduct;
14911491 (J) a person providing child care for a child who
14921492 is in the care of the Department of Family and Protective Services
14931493 or the Health and Human Services Commission and who is or will be
14941494 receiving adoptive, foster, or in-home care;
14951495 (K) through a contract with a nonprofit
14961496 management center, an employee of, an applicant for employment
14971497 with, or a volunteer or an applicant volunteer with a nonprofit,
14981498 tax-exempt organization that provides any service that involves the
14991499 care of or access to a child, an elderly person, or a person with a
15001500 disability; or
15011501 (L) an applicant for a child-care administrator
15021502 or child-placing agency administrator license under Chapter 43,
15031503 Human Resources Code.
15041504 (3) In addition to the criminal history record
15051505 information the Department of Family and Protective Services or the
15061506 Health and Human Services Commission is required to obtain under
15071507 Subdivision (2), the Department of Family and Protective Services
15081508 or the Health and Human Services Commission, as applicable, is
15091509 entitled to obtain [from the department] criminal history record
15101510 information as provided by Subdivision (4) [maintained by the
15111511 department] that relates to a person who is:
15121512 (A) an applicant for a position with the
15131513 Department of Family and Protective Services or the Health and
15141514 Human Services Commission regardless of the duties of the position,
15151515 including a position described by Subdivision (2)(D);
15161516 (B) a Department of Family and Protective
15171517 Services employee or a Health and Human Services Commission
15181518 employee regardless of the duties of the employee's position,
15191519 including an employee described by Subdivision (2)(H);
15201520 (C) a volunteer or applicant volunteer with the
15211521 Department of Family and Protective Services or the Health and
15221522 Human Services Commission regardless of the duties to be performed,
15231523 including a registered volunteer;
15241524 (D) an employee of, an applicant for employment
15251525 with, or a volunteer or an applicant volunteer with an entity or
15261526 person who [that] contracts with the Department of Family and
15271527 Protective Services or the Health and Human Services Commission, as
15281528 applicable, and has access to confidential information in that
15291529 department's or commission's records, if the employee, applicant,
15301530 volunteer, or applicant volunteer has or will have access to that
15311531 confidential information;
15321532 (E) a person living in the residence in which the
15331533 alleged victim of the report resides, including an alleged
15341534 perpetrator in a report described by Subdivision (2)(I);
15351535 (F) a person providing, at the request of the
15361536 child's parent, in-home care for a child who is the subject of a
15371537 report alleging the child has been abused or neglected;
15381538 (G) a person providing, at the request of the
15391539 child's parent, in-home care for a child only if the person gives
15401540 written consent to the release and disclosure of the information;
15411541 (H) a child who is related to the caretaker, as
15421542 determined under Section 42.002, Human Resources Code, or any other
15431543 person who resides in, is present in, or has unsupervised access to
15441544 a child in the care of a facility or family home;
15451545 (I) a relative of a child in the care of the
15461546 Department of Family and Protective Services or the Health and
15471547 Human Services Commission, as applicable, to the extent necessary
15481548 to comply with Section 162.007, Family Code;
15491549 (J) a person providing or applying to provide
15501550 in-home, adoptive, or foster care for children to the extent
15511551 necessary to comply with Subchapter B, Chapter 162, Family Code;
15521552 (K) a person who volunteers to supervise
15531553 visitation under Subchapter B, Chapter 263, Family Code;
15541554 (L) an employee of or volunteer at, or an
15551555 applicant for employment with or to be a volunteer at, an entity
15561556 that provides supervised independent living services to a young
15571557 adult receiving extended foster care services from the Department
15581558 of Family and Protective Services or the Health and Human Services
15591559 Commission, as applicable;
15601560 (M) a person 14 years of age or older who will be
15611561 regularly or frequently working or staying in a host home that is
15621562 providing supervised independent living services to a young adult
15631563 receiving extended foster care services from the Department of
15641564 Family and Protective Services or the Health and Human Services
15651565 Commission, as applicable;
15661566 (N) a volunteer or applicant volunteer with a
15671567 local affiliate in this state of Big Brothers Big Sisters of
15681568 America;
15691569 (O) a volunteer or applicant volunteer with an
15701570 organization that provides court-appointed volunteer advocates for
15711571 abused or neglected children; or
15721572 (P) an employee, volunteer, or applicant
15731573 volunteer of a children's advocacy center under Subchapter E,
15741574 Chapter 264, Family Code, including a member of the governing board
15751575 of a center.
15761576 (4) Subject to Section 411.087 and consistent with the
15771577 public policy of this state, the Department of Family and
15781578 Protective Services and the Health and Human Services Commission
15791579 are entitled to:
15801580 (A) obtain through the Federal Bureau of
15811581 Investigation criminal history record information maintained or
15821582 indexed by that bureau that pertains to a person described by
15831583 Subdivision (2) or (3); and
15841584 (B) obtain from the department or any other
15851585 criminal justice agency in this state criminal history record
15861586 information maintained by the department or that criminal justice
15871587 agency that relates to a person described by Subdivision (2) or (3).
15881588 (4-a) Law enforcement entities shall expedite the
15891589 furnishing of criminal history record [such] information obtained
15901590 under Subdivision (4)(B) to Department of Family and Protective
15911591 Services workers or Health and Human Services Commission workers,
15921592 as applicable, to ensure prompt criminal background checks for the
15931593 safety of alleged victims and Department of Family and Protective
15941594 Services workers or Health and Human Services Commission workers,
15951595 as applicable.
15961596 (6) The Department of Family and Protective Services
15971597 or the Health and Human Services Commission, as applicable, may not
15981598 release or disclose to any person criminal history record
15991599 information obtained from the Federal Bureau of Investigation under
16001600 Subdivision (4)(A). Criminal history record information obtained
16011601 by the Department of Family and Protective Services or the Health
16021602 and Human Services Commission under Subdivision (4)(B) [this
16031603 subsection] may not be released to any person except:
16041604 (A) on court order;
16051605 (B) with the consent of the person who is the
16061606 subject of the criminal history record information;
16071607 (C) for purposes of an administrative hearing
16081608 held by the Department of Family and Protective Services or the
16091609 Health and Human Services Commission, as applicable, concerning the
16101610 person who is the subject of the criminal history record
16111611 information; or
16121612 (D) as provided by Subdivision (7).
16131613 (7) Subject to Subdivision (8), the Department of
16141614 Family and Protective Services or the Health and Human Services
16151615 Commission, as applicable, is not prohibited from releasing
16161616 criminal history record information obtained under Subdivision
16171617 (4)(B) [this subsection] to:
16181618 (A) the person who is the subject of the criminal
16191619 history record information;
16201620 (B) a child-placing agency listed in Subdivision
16211621 (2) that is seeking to verify or approve a foster or adoptive home
16221622 under procedures authorized by federal law;
16231623 (C) an adult who resides with an alleged victim
16241624 of abuse, neglect, or exploitation of a child, elderly person, or
16251625 person with a disability and who also resides with the alleged
16261626 perpetrator of that abuse, neglect, or exploitation if:
16271627 (i) the alleged perpetrator is the subject
16281628 of the criminal history record information; and
16291629 (ii) the Department of Family and
16301630 Protective Services or the Health and Human Services Commission, as
16311631 applicable, determines that the release of information to the adult
16321632 is necessary to ensure the safety or welfare of the alleged victim
16331633 or the adult; or
16341634 (D) an elderly person or a person with a
16351635 disability who is an alleged victim of abuse, neglect, or
16361636 exploitation and who resides with the alleged perpetrator of that
16371637 abuse, neglect, or exploitation if:
16381638 (i) the alleged perpetrator is the subject
16391639 of the criminal history record information; and
16401640 (ii) the Department of Family and
16411641 Protective Services or the Health and Human Services Commission, as
16421642 applicable, determines that the release of information to the
16431643 person is necessary to ensure the safety or welfare of the person.
16441644 SECTION 32. Section 411.114, Government Code, is amended by
16451645 adding Subsection (d) to read as follows:
16461646 (d) The Department of Family and Protective Services and the
16471647 Health and Human Services Commission, as applicable, shall destroy
16481648 criminal history record information that is obtained under this
16491649 section after the information is used for its authorized purpose.
16501650 SECTION 33. Section 411.1142, Government Code, is amended
16511651 by amending Subsections (a), (b), and (d) and adding Subsections
16521652 (a-1) and (f) to read as follows:
16531653 (a) The Early Childhood Intervention program within the
16541654 Health and Human Services Commission, as established by Chapter 73,
16551655 Human Resources Code, is entitled to obtain criminal history record
16561656 information as provided by Subsection (a-1) [maintained by the
16571657 Department of Public Safety, the Federal Bureau of Investigation
16581658 identification division, or another law enforcement agency] that
16591659 relates to a person:
16601660 (1) who is an employee or an applicant for permanent,
16611661 temporary, or consultative employment or for a volunteer position;
16621662 and
16631663 (2) [positions] whose employment or potential
16641664 employment or volunteer position with the program or a local
16651665 provider involves the delivery of early childhood intervention
16661666 services or involves direct interactions with or the opportunity to
16671667 interact and associate with children.
16681668 (a-1) Subject to Section 411.087 and consistent with the
16691669 public policy of this state, the Health and Human Services
16701670 Commission is entitled to:
16711671 (1) obtain through the Federal Bureau of Investigation
16721672 criminal history record information maintained or indexed by that
16731673 bureau that pertains to a person who is described by Subsection (a);
16741674 and
16751675 (2) obtain from the department or any other criminal
16761676 justice agency in this state criminal history record information
16771677 maintained by the department or that criminal justice agency that
16781678 relates to a person described by Subsection (a).
16791679 (b) The Health and Human Services Commission may not release
16801680 or disclose to any person criminal history record information
16811681 obtained from the Federal Bureau of Investigation under Subsection
16821682 (a-1)(1). Criminal history record information obtained by the
16831683 Health and Human Services Commission under Subsection (a-1)(2)
16841684 [(a)] may not be released or disclosed to any person except:
16851685 (1) on court order;
16861686 (2) [,] with the consent of the person who is the
16871687 subject of the criminal history record information; [,] or
16881688 (3) as provided by Subsection (d).
16891689 (d) The Health and Human Services Commission may provide the
16901690 applicant, employee, professional consultant, or volunteer with a
16911691 copy of the person's criminal history record information obtained
16921692 from the Department of Public Safety[, Federal Bureau of
16931693 Investigation identification division,] or another law enforcement
16941694 agency under Subsection (a-1)(2).
16951695 (f) The Health and Human Services Commission shall destroy
16961696 criminal history record information that is obtained under this
16971697 section after the information is used for its authorized purpose.
16981698 SECTION 34. Section 411.1143, Government Code, is amended
16991699 to read as follows:
17001700 Sec. 411.1143. ACCESS TO CRIMINAL HISTORY RECORD
17011701 INFORMATION; AGENCIES OPERATING PART OF MEDICAL ASSISTANCE
17021702 PROGRAM. (a) The Health and Human Services Commission, an agency
17031703 operating part of the medical assistance program under Chapter 32,
17041704 Human Resources Code, or the office of inspector general
17051705 established under Chapter 531, Government Code, is entitled to
17061706 obtain [from the department the] criminal history record
17071707 information as provided by Subsection (a-2) [maintained by the
17081708 department] that relates to a provider under the medical assistance
17091709 program or a person applying to enroll as a provider under the
17101710 medical assistance program.
17111711 (a-1) Criminal history record information the Health and
17121712 Human Services Commission [an agency] or the office of inspector
17131713 general is authorized to obtain under Subsection (a) includes
17141714 criminal history record information relating to:
17151715 (1) a person with a direct or indirect ownership or
17161716 control interest, as defined by 42 C.F.R. Section 455.101, in a
17171717 provider of five percent or more; and
17181718 (2) a person whose information is required to be
17191719 disclosed in accordance with 42 C.F.R. Part 1001.
17201720 (a-2) Subject to Section 411.087 and consistent with the
17211721 public policy of this state, the Health and Human Services
17221722 Commission and the office of inspector general are entitled to:
17231723 (1) obtain through the Federal Bureau of Investigation
17241724 criminal history record information maintained or indexed by that
17251725 bureau that pertains to a person who is described by Subsection (a)
17261726 or (a-1); and
17271727 (2) obtain from the department or any other criminal
17281728 justice agency in this state criminal history record information
17291729 maintained by the department or that criminal justice agency that
17301730 relates to a person described by Subsection (a) or (a-1).
17311731 (b) The Health and Human Services Commission or the office
17321732 of inspector general, as applicable, may not release or disclose to
17331733 any person criminal history record information obtained from the
17341734 Federal Bureau of Investigation under Subsection (a-2)(1).
17351735 Criminal history record information obtained by the Health and
17361736 Human Services Commission or the office of inspector general
17371737 [commission or an agency] under Subsection (a-2)(2) [(a)] may not
17381738 be released or disclosed to any person except in a criminal
17391739 proceeding, in an administrative proceeding, on court order, or
17401740 with the consent of the provider or applicant.
17411741 (c) This section does not prohibit the Health and Human
17421742 Services Commission or the office of inspector general from
17431743 obtaining and using criminal history record information as provided
17441744 by other law.
17451745 (d) The Health and Human Services Commission and the office
17461746 of inspector general shall destroy criminal history record
17471747 information obtained under this section after the information is
17481748 used for its authorized purpose.
17491749 SECTION 35. Section 411.1144, Government Code, is amended
17501750 to read as follows:
17511751 Sec. 411.1144. ACCESS TO CRIMINAL HISTORY RECORD
17521752 INFORMATION: HEALTH AND HUMAN SERVICES COMMISSION AND [AGENCIES
17531753 WITH] EMPLOYEES, CONTRACTORS, OR VOLUNTEERS AT STATE SUPPORTED
17541754 LIVING CENTERS. (a) The [Department of State Health Services and
17551755 the] Health and Human Services Commission is [are] entitled to
17561756 obtain [from the department] criminal history record information as
17571757 provided by Subsection (d) [maintained by the department] that
17581758 relates to a person:
17591759 (1) who is:
17601760 (A) an applicant for employment with the Health
17611761 and Human Services Commission [agency];
17621762 (B) an employee of the Health and Human Services
17631763 Commission [agency];
17641764 (C) a volunteer with the Health and Human
17651765 Services Commission [agency];
17661766 (D) an applicant for a volunteer position with
17671767 the Health and Human Services Commission [agency];
17681768 (E) an applicant for a contract with the Health
17691769 and Human Services Commission [agency]; or
17701770 (F) a contractor of the Health and Human Services
17711771 Commission [agency]; and
17721772 (2) who would be placed in direct contact with a
17731773 resident or client of a state supported living center, as defined by
17741774 Section 555.001, Health and Safety Code.
17751775 (b) The commission may not release or disclose to any person
17761776 criminal history record information obtained from the Federal
17771777 Bureau of Investigation under Subsection (d)(1). Criminal history
17781778 record information obtained by the Health and Human Services
17791779 Commission [an agency] under Subsection (d)(2) [(a)] may not be
17801780 released or disclosed to any person except:
17811781 (1) on court order;
17821782 (2) with the consent of the person who is the subject
17831783 of the criminal history record information;
17841784 (3) for purposes of an administrative hearing held by
17851785 the agency concerning the person who is the subject of the criminal
17861786 history record information; or
17871787 (4) as provided by Subsection (c).
17881788 (c) The Health and Human Services Commission is prohibited
17891789 from releasing criminal history record information obtained under
17901790 Subsection (d)(1) to the person who is the subject of the criminal
17911791 history record information. The Health and Human Services
17921792 Commission [An agency] is not prohibited from releasing criminal
17931793 history record information obtained under Subsection (d)(2) [(a) or
17941794 (d)] to the person who is the subject of the criminal history record
17951795 information.
17961796 (d) Subject to Section 411.087 and consistent with the
17971797 public policy of this state, the [Department of State Health
17981798 Services and the] Health and Human Services Commission is [are]
17991799 entitled to:
18001800 (1) obtain through the Federal Bureau of Investigation
18011801 criminal history record information maintained or indexed by that
18021802 bureau that pertains to a person described by Subsection (a); and
18031803 (2) obtain from the department or any other criminal
18041804 justice agency in this state criminal history record information
18051805 maintained by the department or that criminal justice agency that
18061806 relates to a person described by Subsection (a).
18071807 (e) This section does not prohibit the Health and Human
18081808 Services Commission [an agency] from obtaining and using criminal
18091809 history record information as provided by other law.
18101810 (f) The Health and Human Services Commission shall destroy
18111811 criminal history record information obtained under this section
18121812 after the information is used for its authorized purpose.
18131813 SECTION 36. Section 411.115, Government Code, is amended by
18141814 amending Subsections (b), (d), and (e) and adding Subsections (c)
18151815 and (f) to read as follows:
18161816 (b) The Department of State Health Services, the Health and
18171817 Human Services Commission, a local mental health or intellectual
18181818 and developmental disability authority, or a community center, as
18191819 applicable, is entitled to obtain [from the department] criminal
18201820 history record information as provided by Subsection (c)
18211821 [maintained by the department] that relates to a person:
18221822 (1) who is:
18231823 (A) an applicant for employment with the
18241824 Department of State Health Services, the Health and Human Services
18251825 Commission, a local mental health or intellectual and developmental
18261826 disability authority, or a community center;
18271827 (B) an employee of the Department of State Health
18281828 Services, the Health and Human Services Commission, a local mental
18291829 health or intellectual and developmental disability authority, or a
18301830 community center;
18311831 (C) an applicant for employment with or an
18321832 employee of a business or person who [that] contracts with the
18331833 Department of State Health Services, the Health and Human Services
18341834 Commission, a local mental health or intellectual and developmental
18351835 disability authority, or a community center to provide residential
18361836 services to patients with mental illness or clients with an
18371837 intellectual or developmental disability who were furloughed or
18381838 discharged from a Department of State Health Services facility, a
18391839 Health and Human Services Commission facility, or a community
18401840 center, as applicable;
18411841 (D) a volunteer with the Department of State
18421842 Health Services, the Health and Human Services Commission, a local
18431843 mental health or intellectual and developmental disability
18441844 authority, or a community center; or
18451845 (E) a volunteer applicant; and
18461846 (2) who would be placed in direct contact with
18471847 patients with mental illness or clients with an intellectual or
18481848 developmental disability.
18491849 (c) Subject to Section 411.087 and consistent with the
18501850 public policy of this state, the Department of State Health
18511851 Services, the Health and Human Services Commission, a local mental
18521852 health or intellectual and developmental disability authority, or a
18531853 community center, as applicable, is entitled to:
18541854 (1) obtain through the Federal Bureau of Investigation
18551855 criminal history record information maintained or indexed by that
18561856 bureau that pertains to a person who is described by Subsection (b);
18571857 and
18581858 (2) obtain from the department or any other criminal
18591859 justice agency in this state criminal history record information
18601860 maintained by the department or that criminal justice agency that
18611861 relates to a person described by Subsection (b).
18621862 (d) The Department of State Health Services, the Health and
18631863 Human Services Commission, a local mental health or intellectual
18641864 and developmental disability authority, or a community center, as
18651865 applicable, may not release or disclose to any person criminal
18661866 history record information obtained from the Federal Bureau of
18671867 Investigation under Subsection (c)(1). Criminal history record
18681868 information obtained by the Department of State Health Services,
18691869 the Health and Human Services Commission, a local mental health or
18701870 intellectual and developmental disability authority, or a
18711871 community center, as applicable, under Subsection (c)(2) [(b)] may
18721872 not be released or disclosed to a person, other than the contractor
18731873 that employs the person who is the subject of the criminal history
18741874 record information, except on court order or with the consent of the
18751875 person who is the subject of the criminal history record
18761876 information.
18771877 (e) The Department of State Health Services, the Health and
18781878 Human Services Commission, a local mental health or intellectual
18791879 and developmental disability authority, or a community center, as
18801880 applicable, shall [collect and] destroy criminal history record
18811881 information obtained under this section after the information is
18821882 used for its authorized purpose [that relates to a person
18831883 immediately after making an employment decision or taking a
18841884 personnel action relating to the person who is the subject of the
18851885 criminal history record information].
18861886 (f) This section does not prohibit the Department of State
18871887 Health Services, the Health and Human Services Commission, a local
18881888 mental health or intellectual and developmental disability
18891889 authority, or a community center, as applicable, from obtaining and
18901890 using criminal history record information as provided by other law.
18911891 SECTION 37. Subchapter F, Chapter 411, Government Code, is
18921892 amended by adding Section 411.1161 to read as follows:
18931893 Sec. 411.1161. ACCESS TO CRIMINAL HISTORY RECORD
18941894 INFORMATION: HEALTH AND HUMAN SERVICES COMMISSION AND NURSE AIDE
18951895 CERTIFICATION, MEDICATION AIDE PERMIT, AND NURSING FACILITY
18961896 ADMINISTRATOR LICENSE. (a) The Health and Human Services
18971897 Commission is entitled to obtain criminal history record
18981898 information as provided by Subsection (b) that relates to a person
18991899 who is an initial or renewal applicant for:
19001900 (1) a nurse aide certification with inclusion in the
19011901 nurse aide registry established under Chapter 250, Health and
19021902 Safety Code;
19031903 (2) a medication aide permit issued under Chapter 142,
19041904 Health and Safety Code; or
19051905 (3) a nursing facility administrator license issued
19061906 under Chapter 242, Health and Safety Code.
19071907 (b) Subject to Section 411.087 and consistent with the
19081908 public policy of this state, the Health and Human Services
19091909 Commission is entitled to:
19101910 (1) obtain through the Federal Bureau of Investigation
19111911 criminal history record information maintained or indexed by that
19121912 bureau that pertains to a person described by Subsection (a); and
19131913 (2) obtain from the department or any other criminal
19141914 justice agency in this state criminal history record information
19151915 maintained by the department or that criminal justice agency that
19161916 relates to a person described by Subsection (a).
19171917 (c) The Health and Human Services Commission may not release
19181918 or disclose to any person criminal history record information
19191919 obtained from the Federal Bureau of Investigation under Subsection
19201920 (b)(1). Criminal history record information obtained by the Health
19211921 and Human Services Commission under Subsection (b)(2) may not be
19221922 released or disclosed to any person except:
19231923 (1) on court order;
19241924 (2) with the consent of the person who is the subject
19251925 of the criminal history record information;
19261926 (3) for purposes of an administrative hearing held by
19271927 the Health and Human Services Commission concerning the person who
19281928 is the subject of the criminal history record information; or
19291929 (4) as provided by Subsection (d).
19301930 (d) The Health and Human Services Commission is not
19311931 prohibited from releasing criminal history record information
19321932 obtained under Subsection (b)(2) to the person who is the subject of
19331933 the criminal history record information.
19341934 (e) This section does not prohibit the Health and Human
19351935 Services Commission from obtaining and using criminal history
19361936 record information as provided by other law.
19371937 (f) The Health and Human Services Commission shall destroy
19381938 criminal history record information that is obtained under this
19391939 section after the information is used for its authorized purpose.
19401940 SECTION 38. Section 411.122(d), Government Code, as amended

19921992 (3) is subject to investigation by the board in
19931993 connection with a complaint or formal charge against the person; or
19941994 (4) is accepted for enrollment in a nursing education
19951995 program that prepares the person for licensure as a vocational,
19961996 registered, or advanced practice registered nurse.
19971997 (b) Subject to Section 411.087 and consistent with the
19981998 public policy of this state, the Texas Board of Nursing is entitled
19991999 to:
20002000 (1) obtain through the Federal Bureau of Investigation
20012001 criminal history record information maintained or indexed by that
20022002 bureau that pertains to a person described by Subsection (a); and
20032003 (2) obtain from the department or any other criminal
20042004 justice agency in this state criminal history record information
20052005 maintained by the department or that criminal justice agency that
20062006 relates to a person described by Subsection (a).
20072007 (c) The Texas Board of Nursing may not release or disclose
20082008 to any person criminal history record information obtained from the
20092009 Federal Bureau of Investigation under Subsection (b)(1). Criminal
20102010 history record information obtained by the Texas Board of Nursing
20112011 under Subsection (b)(2) may not be released or disclosed to any
20122012 person except:
20132013 (1) as required under a court order;
20142014 (2) to a nursing board that is a member of the nurse
20152015 licensure compact under Chapter 304, Occupations Code;
20162016 (3) with the written consent of the person who is the
20172017 subject of the criminal history record information; or
20182018 (4) as provided by Subsection (d).
20192019 (d) The Texas Board of Nursing is not prohibited from
20202020 disclosing criminal history record information obtained under
20212021 Subsection (b)(2) in a criminal proceeding, in a contested case
20222022 proceeding conducted by the State Office of Administrative
20232023 Hearings, or as part of an appeal of a contested case proceeding.
20242024 (e) Criminal history record information obtained by the
20252025 Texas Board of Nursing shall be destroyed by the agency after a
20262026 final determination is made and all appeals are concluded in the
20272027 matter for which the information was obtained.
20282028 SECTION 40. Subchapter F, Chapter 411, Government Code, is
20292029 amended by adding Section 411.12501 to read as follows:
20302030 Sec. 411.12501. ACCESS TO CRIMINAL HISTORY RECORD
20312031 INFORMATION OF FEDERAL BUREAU OF INVESTIGATION: TEXAS ALCOHOLIC
20322032 BEVERAGE COMMISSION. (a) Subject to Section 411.087 and Public Law
20332033 92-544, the Texas Alcoholic Beverage Commission is authorized to
20342034 obtain and use criminal history record information maintained or
20352035 indexed by the Federal Bureau of Investigation that relates to a
20362036 person who is an applicant for or holds a license, permit, or
20372037 certificate under the Texas Alcoholic Beverage Code.
20382038 (b) This section does not limit the commission's ability to
20392039 obtain criminal history record information for criminal justice
20402040 purposes or as authorized by other law.
20412041 (c) The commission may require any person for whom the
20422042 commission is authorized to obtain and use criminal history record
20432043 information under Subsection (a) to submit a complete and legible
20442044 set of fingerprints to the commission on a form prescribed by the
20452045 commission for the purpose of obtaining criminal history record
20462046 information.
20472047 SECTION 41. Subchapter F, Chapter 411, Government Code, is
20482048 amended by adding Section 411.12502 to read as follows:
20492049 Sec. 411.12502. ACCESS TO CRIMINAL HISTORY RECORD
20502050 INFORMATION: TEXAS BEHAVIORAL HEALTH EXECUTIVE COUNCIL. (a) The
20512051 Texas Behavioral Health Executive Council is entitled to obtain
20522052 criminal history record information as provided by Subsection (b)
20532053 that relates to a person who is an applicant for or licensed as:
20542054 (1) a licensed psychologist, licensed psychological
20552055 associate, or licensed specialist in school psychology under
20562056 Chapter 501, Occupations Code;
20572057 (2) a licensed marriage and family therapist or
20582058 licensed marriage and family therapist associate under Chapter 502,
20592059 Occupations Code;
20602060 (3) a licensed professional counselor or licensed
20612061 professional counselor associate under Chapter 503, Occupations
20622062 Code; or
20632063 (4) a licensed baccalaureate social worker, licensed
20642064 master social worker, or licensed clinical social worker under
20652065 Chapter 505, Occupations Code.
20662066 (b) Subject to Section 411.087 and consistent with the
20672067 public policy of this state, the Texas Behavioral Health Executive
20682068 Council is entitled to:
20692069 (1) obtain through the Federal Bureau of Investigation
20702070 criminal history record information maintained or indexed by that
20712071 bureau that pertains to a person described by Subsection (a); and
20722072 (2) obtain from the department or any other criminal
20732073 justice agency in this state criminal history record information
20742074 maintained by the department or that criminal justice agency that
20752075 relates to a person described by Subsection (a).
20762076 (c) The Texas Behavioral Health Executive Council may not
20772077 release or disclose to any person criminal history record
20782078 information obtained from the Federal Bureau of Investigation under
20792079 Subsection (b)(1). Criminal history record information obtained by
20802080 the executive council under Subsection (b)(2) may not be released
20812081 or disclosed to any person except on court order, with the written
20822082 consent of the person who is the subject of the criminal history
20832083 record information, or as provided by Subsection (d).
20842084 (d) The Texas Behavioral Health Executive Council is not
20852085 prohibited from disclosing criminal history record information
20862086 obtained under Subsection (b)(2) in a criminal proceeding or in a
20872087 hearing conducted by the executive council or the State Office of
20882088 Administrative Hearings.
20892089 (e) The Texas Behavioral Health Executive Council shall
20902090 destroy criminal history record information that is obtained under
20912091 this section after the information is used for its authorized
20922092 purpose.
20932093 SECTION 42. Subchapter F, Chapter 411, Government Code, is
20942094 amended by adding Section 411.12503 to read as follows:
20952095 Sec. 411.12503. ACCESS TO CRIMINAL HISTORY RECORD
20962096 INFORMATION: TEXAS BOARD OF CHIROPRACTIC EXAMINERS. (a) The Texas
20972097 Board of Chiropractic Examiners is entitled to obtain criminal
20982098 history record information as provided by Subsection (b) that
20992099 relates to:
21002100 (1) a person who is an applicant for a license or
21012101 registration under Chapter 201, Occupations Code; or
21022102 (2) the holder of a license or registration under
21032103 Chapter 201, Occupations Code.
21042104 (b) Subject to Section 411.087 and consistent with the
21052105 public policy of this state, the Texas Board of Chiropractic
21062106 Examiners is entitled to:
21072107 (1) obtain through the Federal Bureau of Investigation
21082108 criminal history record information maintained or indexed by that
21092109 bureau that pertains to a person described by Subsection (a); and
21102110 (2) obtain from the department or any other criminal
21112111 justice agency in this state criminal history record information
21122112 maintained by the department or that criminal justice agency that
21132113 relates to a person described by Subsection (a).
21142114 (c) The Texas Board of Chiropractic Examiners may not
21152115 release or disclose to any person criminal history record
21162116 information obtained from the Federal Bureau of Investigation under
21172117 Subsection (b)(1). Criminal history record information obtained by
21182118 the Texas Board of Chiropractic Examiners under Subsection (b)(2)
21192119 may not be released or disclosed to any person except on court
21202120 order, with the written consent of the person who is the subject of
21212121 the criminal history record information, or as provided by
21222122 Subsection (d).
21232123 (d) The Texas Board of Chiropractic Examiners is not
21242124 prohibited from disclosing criminal history record information
21252125 obtained under Subsection (b)(2) in a criminal proceeding or in a
21262126 hearing conducted under the authority of the Texas Board of
21272127 Chiropractic Examiners.
21282128 (e) The Texas Board of Chiropractic Examiners shall destroy
21292129 criminal history record information that is obtained under this
21302130 section after the information is used for its authorized purpose.
21312131 SECTION 43. Subchapter F, Chapter 411, Government Code, is
21322132 amended by adding Section 411.12504 to read as follows:
21332133 Sec. 411.12504. ACCESS TO CRIMINAL HISTORY RECORD
21342134 INFORMATION: STATE BOARD OF DENTAL EXAMINERS. (a) The State Board
21352135 of Dental Examiners is entitled to obtain criminal history record
21362136 information as provided by Subsection (b) that relates to a person
21372137 who:
21382138 (1) is an applicant for a license, certificate,
21392139 registration, permit, or other authorization under Subtitle D,
21402140 Title 3, Occupations Code;
21412141 (2) is the holder of a license, certificate,
21422142 registration, permit, or other authorization under that subtitle;
21432143 (3) requests a determination of eligibility for a
21442144 license, certificate, registration, permit, or other authorization
21452145 from the State Board of Dental Examiners; or
21462146 (4) is an applicant for employment at or current
21472147 employee of the State Board of Dental Examiners.
21482148 (b) Subject to Section 411.087 and consistent with the
21492149 public policy of this state, the State Board of Dental Examiners is
21502150 entitled to:
21512151 (1) obtain through the Federal Bureau of Investigation
21522152 criminal history record information maintained or indexed by that
21532153 bureau that pertains to a person described by Subsection (a); and
21542154 (2) obtain from the department or any other criminal
21552155 justice agency in this state criminal history record information
21562156 maintained by the department or that criminal justice agency that
21572157 relates to a person described by Subsection (a).
21582158 (c) The State Board of Dental Examiners may not release or
21592159 disclose to any person criminal history record information obtained
21602160 from the Federal Bureau of Investigation under Subsection (b)(1).
21612161 Criminal history record information obtained by the State Board of
21622162 Dental Examiners under Subsection (b)(2) may not be released or
21632163 disclosed to any person except on court order, with the written
21642164 consent of the person who is the subject of the criminal history
21652165 record information, or as provided by Subsection (d).
21662166 (d) The State Board of Dental Examiners is not prohibited
21672167 from disclosing criminal history record information obtained under
21682168 Subsection (b)(2) in a criminal proceeding or in a hearing
21692169 conducted by the State Board of Dental Examiners or the State Office
21702170 of Administrative Hearings.
21712171 (e) The State Board of Dental Examiners shall destroy
21722172 criminal history record information obtained under this section
21732173 after a final determination is made in the matter for which the
21742174 information was obtained.
21752175 SECTION 44. Subchapter F, Chapter 411, Government Code, is
21762176 amended by adding Section 411.12505 to read as follows:
21772177 Sec. 411.12505. ACCESS TO CRIMINAL HISTORY RECORD
21782178 INFORMATION: QUALIFIED SCHOOL CONTRACTORS. (a) In this section,
21792179 "qualified school contractor" means an entity that:
21802180 (1) contracts or subcontracts to provide services to a
21812181 school district, charter school, or shared services arrangement;
21822182 and
21832183 (2) is determined eligible by the department to obtain
21842184 criminal history record information under the National Child
21852185 Protection Act of 1993 (34 U.S.C. Section 40101 et seq.) for an
21862186 employee, applicant for employment, or volunteer of the qualified
21872187 school contractor.
21882188 (b) A qualified school contractor is entitled to obtain from
21892189 the department or any other criminal justice agency in this state
21902190 criminal history record information maintained by the department or
21912191 that criminal justice agency that relates to a person described by
21922192 Subsection (a)(2).
21932193 (c) Criminal history record information obtained by a
21942194 qualified school contractor under Subsection (b) in the original
21952195 form or any subsequent form:
21962196 (1) may not be released to any person except:
21972197 (A) to the person who is the subject of the
21982198 information;
21992199 (B) with the consent of the person who is the
22002200 subject of the information;
22012201 (C) by court order; or
22022202 (D) except as provided by Subsection (d); and
22032203 (2) is not subject to disclosure as provided by
22042204 Chapter 552.
22052205 (d) A qualified school contractor may provide a fitness
22062206 determination based on criminal history record information
22072207 obtained under this section to a school district, charter school,
22082208 or shared services arrangement.
22092209 (e) A qualified school contractor shall destroy criminal
22102210 history record information that is obtained under this section
22112211 after the information is used for its authorized purpose.
22122212 (f) The department in coordination with the commissioner of
22132213 education may adopt rules necessary to implement this section.
22142214 SECTION 45. Subchapter F, Chapter 411, Government Code, is
22152215 amended by adding Section 411.12506 to read as follows:
22162216 Sec. 411.12506. ACCESS TO CRIMINAL HISTORY RECORD
22172217 INFORMATION: TEXAS COMMISSION ON ENVIRONMENTAL QUALITY. (a) The
22182218 Texas Commission on Environmental Quality is entitled to obtain
22192219 criminal history record information as provided by Subsection (b)
22202220 that relates to a person who:
22212221 (1) is an applicant for a license, permit, or
22222222 registration under:
22232223 (A) Chapters 341, 361, and 366, Health and Safety
22242224 Code;
22252225 (B) Chapter 1903, Occupations Code; or
22262226 (C) Chapters 26 and 37, Water Code;
22272227 (2) is the holder of a license, permit, or
22282228 registration under a provision listed in Subdivision (1); or
22292229 (3) requests a determination of eligibility for a
22302230 license, permit, or registration from the agency under a provision
22312231 listed in Subdivision (1).
22322232 (b) Subject to Section 411.087 and consistent with the
22332233 public policy of this state, the Texas Commission on Environmental
22342234 Quality is entitled to:
22352235 (1) obtain through the Federal Bureau of Investigation
22362236 criminal history record information maintained or indexed by that
22372237 bureau that pertains to a person described by Subsection (a); and
22382238 (2) obtain from the department or any other criminal
22392239 justice agency in this state criminal history record information
22402240 maintained by the department or that criminal justice agency that
22412241 relates to a person described by Subsection (a).
22422242 (c) The Texas Commission on Environmental Quality may not
22432243 release or disclose to any person criminal history record
22442244 information obtained from the Federal Bureau of Investigation under
22452245 Subsection (b)(1). Criminal history record information obtained by
22462246 the Texas Commission on Environmental Quality under Subsection
22472247 (b)(2) may not be released or disclosed to any person except on
22482248 court order, with the written consent of the person who is the
22492249 subject of the criminal history record information, or as provided
22502250 by Subsection (d).
22512251 (d) The Texas Commission on Environmental Quality is not
22522252 prohibited from disclosing criminal history record information
22532253 obtained under Subsection (b)(2) in a criminal proceeding or in an
22542254 administrative proceeding conducted by the Texas Commission on
22552255 Environmental Quality or the State Office of Administrative
22562256 Hearings.
22572257 (e) The Texas Commission on Environmental Quality shall
22582258 destroy criminal history record information that is obtained under
22592259 this section after the information is used for its authorized
22602260 purpose.
22612261 SECTION 46. Subchapter F, Chapter 411, Government Code, is
22622262 amended by adding Section 411.12507 to read as follows:
22632263 Sec. 411.12507. ACCESS TO CRIMINAL HISTORY RECORD
22642264 INFORMATION: TEXAS FUNERAL SERVICE COMMISSION. (a) The Texas
22652265 Funeral Service Commission is entitled to obtain criminal history
22662266 record information as provided by Subsection (b) that relates to:
22672267 (1) a person who is:
22682268 (A) an applicant for a license or certificate
22692269 under Sections 651.259 and 651.302, Occupations Code; or
22702270 (B) the holder of a license or certificate under
22712271 Chapter 651, Occupations Code;
22722272 (2) an applicant for a license or a license holder
22732273 under Chapter 651, Occupations Code;
22742274 (3) an applicant for employment at or current employee
22752275 of the Texas Funeral Service Commission; or
22762276 (4) a person authorized to access vital records or the
22772277 vital records electronic registration system under Chapter 191,
22782278 Health and Safety Code, or a funeral director.
22792279 (b) Subject to Section 411.087 and consistent with the
22802280 public policy of this state, the Texas Funeral Service Commission
22812281 is entitled to:
22822282 (1) obtain through the Federal Bureau of Investigation
22832283 criminal history record information maintained or indexed by that
22842284 bureau that pertains to a person described by Subsection (a); and
22852285 (2) obtain from the department or any other criminal
22862286 justice agency in this state criminal history record information
22872287 maintained by the department or that criminal justice agency that
22882288 relates to a person described by Subsection (a).
22892289 (c) The Texas Funeral Service Commission may not release or
22902290 disclose to any person criminal history record information obtained
22912291 from the Federal Bureau of Investigation under Subsection (b)(1).
22922292 Criminal history record information obtained by the Texas Funeral
22932293 Service Commission under Subsection (b)(2) may not be released or
22942294 disclosed to any person except on court order, with the written
22952295 consent of the person who is the subject of the criminal history
22962296 record information, or as provided by Subsection (d).
22972297 (d) The Texas Funeral Service Commission is not prohibited
22982298 from disclosing criminal history record information obtained under
22992299 Subsection (b)(2) in a criminal proceeding or in a hearing
23002300 conducted by the Texas Funeral Service Commission.
23012301 (e) The Texas Funeral Service Commission may not consider
23022302 offenses described by Section 542.304, Transportation Code, to
23032303 determine whether to hire or retain an employee or to contract with
23042304 a person on whom criminal history record information is obtained
23052305 under this section.
23062306 (f) The Texas Funeral Service Commission shall destroy
23072307 criminal history record information that is obtained under this
23082308 section after the information is used for its authorized purpose.
23092309 SECTION 47. Subchapter F, Chapter 411, Government Code, is
23102310 amended by adding Section 411.12508 to read as follows:
23112311 Sec. 411.12508. ACCESS TO CRIMINAL HISTORY RECORD
23122312 INFORMATION: MANUFACTURED HOUSING DIVISION. (a) The manufactured
23132313 housing division of the Texas Department of Housing and Community
23142314 Affairs is entitled to obtain criminal history record information
23152315 as provided by Subsection (b) that relates to a person who is:
23162316 (1) an applicant for or holder of a license under
23172317 Chapter 1201, Occupations Code; or
23182318 (2) an owner, officer, or related person or manager of
23192319 a person described by Subdivision (1).
23202320 (b) Subject to Section 411.087 of this code and Chapter
23212321 1201, Occupations Code, and consistent with the public policy of
23222322 this state, the manufactured housing division is entitled to:
23232323 (1) obtain through the Federal Bureau of Investigation
23242324 criminal history record information maintained or indexed by that
23252325 bureau that pertains to a person described by Subsection (a); and
23262326 (2) obtain from the department or any other criminal
23272327 justice agency in this state criminal history record information
23282328 maintained by the department or that criminal justice agency that
23292329 relates to a person described by Subsection (a).
23302330 (c) The manufactured housing division may not release or
23312331 disclose to any person criminal history record information obtained
23322332 from the Federal Bureau of Investigation under Subsection (b)(1).
23332333 Criminal history record information obtained by the manufactured
23342334 housing division under Subsection (b)(2) may not be released or
23352335 disclosed to any person except on court order, with the written
23362336 consent of the person who is the subject of the criminal history
23372337 record information, or as provided by Subsection (d).
23382338 (d) The manufactured housing division is not prohibited
23392339 from disclosing criminal history record information obtained under
23402340 Subsection (b)(2) in a criminal proceeding or in a hearing
23412341 conducted by the manufactured housing division. Certified public
23422342 documents that contain criminal history record information
23432343 described by Subsection (b)(2) but that the division does not
23442344 obtain under that subdivision may be used in a criminal or civil
23452345 proceeding or in a hearing conducted by the manufactured housing
23462346 division.
23472347 (e) The manufactured housing division shall destroy
23482348 criminal history record information that is obtained under this
23492349 section after the information is used for its authorized purpose.
23502350 SECTION 48. Subchapter F, Chapter 411, Government Code, is
23512351 amended by adding Section 411.12509 to read as follows:
23522352 Sec. 411.12509. ACCESS TO CRIMINAL HISTORY RECORD
23532353 INFORMATION: STATE FIRE MARSHAL. (a) The state fire marshal is
23542354 entitled to obtain criminal history record information as provided
23552355 by Subsection (b) that relates to a person who is an applicant for a
23562356 license issued by the state fire marshal.
23572357 (b) Subject to Section 411.087 and consistent with the
23582358 public policy of this state, the state fire marshal is entitled to:
23592359 (1) obtain through the Federal Bureau of Investigation
23602360 criminal history record information maintained or indexed by that
23612361 bureau that pertains to a person described by Subsection (a); and
23622362 (2) obtain from the department or any other criminal
23632363 justice agency in this state criminal history record information
23642364 maintained by the department or that criminal justice agency that
23652365 relates to a person described by Subsection (a).
23662366 (c) The state fire marshal may not release or disclose to
23672367 any person criminal history record information obtained from the
23682368 Federal Bureau of Investigation under Subsection (b)(1). Criminal
23692369 history record information obtained by the state fire marshal under
23702370 Subsection (b)(2) may not be disclosed or released to any person
23712371 except on court order, with the written consent of the person who is
23722372 the subject of the criminal history record information, or as
23732373 provided by Subsection (d).
23742374 (d) The state fire marshal is not prohibited from disclosing
23752375 criminal history record information obtained under Subsection
23762376 (b)(2) in a criminal proceeding or in a hearing conducted by the
23772377 state fire marshal.
23782378 (e) The state fire marshal shall destroy criminal history
23792379 record information that is obtained under this section after the
23802380 information is used for its authorized purpose.
23812381 SECTION 49. Subchapter F, Chapter 411, Government Code, is
23822382 amended by adding Section 411.12510 to read as follows:
23832383 Sec. 411.12510. ACCESS TO CRIMINAL HISTORY RECORD
23842384 INFORMATION: TEXAS MEDICAL BOARD. (a) The Texas Medical Board is
23852385 entitled to obtain criminal history record information as provided
23862386 by Subsection (b) that relates to a person who is:
23872387 (1) an applicant for or holder of a license to practice
23882388 medicine;
23892389 (2) an applicant for or holder of a license to practice
23902390 as a physician assistant;
23912391 (3) an applicant for or holder of a license to practice
23922392 as an acupuncturist;
23932393 (4) an applicant for or holder of a certificate to
23942394 practice as an acudetox specialist;
23952395 (5) an applicant for or holder of a license to practice
23962396 as a surgical assistant;
23972397 (6) an applicant for or holder of a general
23982398 certificate to perform radiologic procedures, limited certificate
23992399 to perform radiologic procedures only on specific parts of the
24002400 body, or radiologist assistant certificate;
24012401 (7) an applicant for or holder of a placement on the
24022402 registry of noncertified technicians;
24032403 (8) an employee of an applicant for a hardship
24042404 exemption;
24052405 (9) an applicant for or holder of a license to practice
24062406 as a medical physicist;
24072407 (10) an applicant for or holder of a license to
24082408 practice as a perfusionist;
24092409 (11) an applicant for or holder of a license to
24102410 practice as a respiratory care practitioner; and
24112411 (12) an applicant for or holder of a pain management
24122412 clinic certificate.
24132413 (b) Subject to Section 411.087 and consistent with the
24142414 public policy of this state, the Texas Medical Board is entitled to:
24152415 (1) obtain through the Federal Bureau of Investigation
24162416 criminal history record information maintained or indexed by that
24172417 bureau that pertains to a person described by Subsection (a); and
24182418 (2) obtain from the department or any other criminal
24192419 justice agency in this state criminal history record information
24202420 maintained by the department or that criminal justice agency that
24212421 relates to a person described by Subsection (a).
24222422 (c) The Texas Medical Board may not release or disclose to
24232423 any person criminal history record information obtained from the
24242424 Federal Bureau of Investigation under Subsection (b)(1). Criminal
24252425 history record information obtained by the Texas Medical Board
24262426 under Subsection (b)(2) may not be released or disclosed to any
24272427 person, except as provided by Subsection (d).
24282428 (d) The Texas Medical Board is not prohibited from
24292429 disclosing criminal history record information obtained under
24302430 Subsection (b)(2) in a hearing conducted by the Texas Medical Board
24312431 or its advisory boards.
24322432 (e) The Texas Medical Board shall destroy criminal history
24332433 record information that is obtained under this section after the
24342434 information is used for its authorized purpose.
24352435 SECTION 50. Subchapter F, Chapter 411, Government Code, is
24362436 amended by adding Section 411.12511 to read as follows:
24372437 Sec. 411.12511. ACCESS TO CRIMINAL HISTORY RECORD
24382438 INFORMATION: TEXAS DEPARTMENT OF MOTOR VEHICLES. (a) The Texas
24392439 Department of Motor Vehicles is entitled to obtain criminal history
24402440 record information as provided by Subsection (b) that relates to a
24412441 person:
24422442 (1) who is an applicant for or holds a general
24432443 distinguishing number under Chapter 503, Transportation Code;
24442444 (2) who is an applicant for or holds a license under
24452445 Chapter 2301 or 2302, Occupations Code; or
24462446 (3) who is an officer, director, member, manager,
24472447 principal, partner, trustee, or other person acting in a
24482448 representative capacity for an applicant, general distinguishing
24492449 number holder, or license holder and whose act or omission would be
24502450 cause for denying, revoking, or suspending a general distinguishing

24532453 (b) Subject to Section 411.087 and consistent with the
24542454 public policy of this state, the Texas Department of Motor Vehicles
24552455 is entitled to:
24562456 (1) obtain through the Federal Bureau of Investigation
24572457 criminal history record information maintained or indexed by that
24582458 bureau that pertains to a person described by Subsection (a); and
24592459 (2) obtain from the department or any other criminal
24602460 justice agency in this state criminal history record information
24612461 maintained by the department or that criminal justice agency that
24622462 relates to a person described by Subsection (a).
24632463 (c) The Texas Department of Motor Vehicles may not release
24642464 or disclose to any person criminal history record information
24652465 obtained from the Federal Bureau of Investigation under Subsection
24662466 (b)(1). Criminal history record information obtained by the Texas
24672467 Department of Motor Vehicles under Subsection (b)(2) may not be
24682468 released or disclosed to any person except on court order, with the
24692469 written consent of the person who is the subject of the criminal
24702470 history record information, or as provided by Subsection (d).
24712471 (d) The Texas Department of Motor Vehicles is not prohibited
24722472 from disclosing criminal history record information obtained under
24732473 Subsection (b)(2) in a criminal proceeding or in a hearing in which
24742474 the Texas Department of Motor Vehicles is a party.
24752475 (e) The Texas Department of Motor Vehicles shall destroy
24762476 criminal history record information that is obtained under this
24772477 section after the information is used for its authorized purpose.
24782478 SECTION 51. Subchapter F, Chapter 411, Government Code, is
24792479 amended by adding Section 411.12512 to read as follows:
24802480 Sec. 411.12512. ACCESS TO CRIMINAL HISTORY RECORD
24812481 INFORMATION: TEXAS OPTOMETRY BOARD. (a) The Texas Optometry Board
24822482 is entitled to obtain criminal history record information as
24832483 provided by Subsection (b) that relates to a person who is:
24842484 (1) an applicant for a license under Section 351.251,
24852485 Occupations Code; or
24862486 (2) the holder of a license under Section 351.302,
24872487 Occupations Code.
24882488 (b) Subject to Section 411.087 of this code and Sections
24892489 351.2525 and 351.3045, Occupations Code, and consistent with the
24902490 public policy of this state, the Texas Optometry Board is entitled
24912491 to:
24922492 (1) obtain through the Federal Bureau of Investigation
24932493 criminal history record information maintained or indexed by that
24942494 bureau that pertains to a person described by Subsection (a); and
24952495 (2) obtain from the department or any other criminal
24962496 justice agency in this state criminal history record information
24972497 maintained by the department or that criminal justice agency that
24982498 relates to a person described by Subsection (a).
24992499 (c) The Texas Optometry Board may not release or disclose to
25002500 any person criminal history record information obtained from the
25012501 Federal Bureau of Investigation under Subsection (b)(1). Criminal
25022502 history record information obtained by the Texas Optometry Board
25032503 under Subsection (b)(2) may not be released or disclosed to any
25042504 person except on court order, with the written consent of the person
25052505 who is the subject of the criminal history record information, or as
25062506 provided by Subsection (d).
25072507 (d) The Texas Optometry Board is not prohibited from
25082508 disclosing criminal history record information obtained under
25092509 Subsection (b)(2) in a criminal proceeding or in a hearing
25102510 conducted by the Texas Optometry Board.
25112511 (e) The Texas Optometry Board shall destroy criminal
25122512 history record information that is obtained under this section
25132513 after the information is used for its authorized purpose.
25142514 SECTION 52. Subchapter F, Chapter 411, Government Code, is
25152515 amended by adding Section 411.12513 to read as follows:
25162516 Sec. 411.12513. ACCESS TO CRIMINAL HISTORY RECORD
25172517 INFORMATION: EXECUTIVE COUNCIL OF PHYSICAL THERAPY AND
25182518 OCCUPATIONAL THERAPY EXAMINERS. (a) The Executive Council of
25192519 Physical Therapy and Occupational Therapy Examiners is entitled to
25202520 obtain criminal history record information as provided by
25212521 Subsection (b) that relates to a person who is:
25222522 (1) an applicant for or the holder of a physical
25232523 therapist or physical therapist assistant license under Chapter
25242524 453, Occupations Code; or
25252525 (2) an applicant for or the holder of an occupational
25262526 therapist or occupational therapy assistant license under Chapter
25272527 454, Occupations Code.
25282528 (b) Subject to Section 411.087 and consistent with the
25292529 public policy of this state, the Executive Council of Physical
25302530 Therapy and Occupational Therapy Examiners is entitled to:
25312531 (1) obtain through the Federal Bureau of Investigation
25322532 criminal history record information maintained or indexed by that
25332533 bureau that pertains to a person described by Subsection (a); and
25342534 (2) obtain from the department or any other criminal
25352535 justice agency in this state criminal history record information
25362536 maintained by the department or that criminal justice agency that
25372537 relates to a person described by Subsection (a).
25382538 (c) The Executive Council of Physical Therapy and
25392539 Occupational Therapy Examiners may not release or disclose to any
25402540 person criminal history record information obtained from the
25412541 Federal Bureau of Investigation under Subsection (b)(1). Criminal
25422542 history record information obtained by the Executive Council of
25432543 Physical Therapy and Occupational Therapy Examiners under
25442544 Subsection (b)(2) may not be released or disclosed to any person
25452545 except on court order, with the written consent of the person who is
25462546 the subject of the criminal history record information, or as
25472547 provided by Subsection (d).
25482548 (d) The Executive Council of Physical Therapy and
25492549 Occupational Therapy Examiners is not prohibited from disclosing
25502550 criminal history record information obtained under Subsection
25512551 (b)(2) in a criminal proceeding or in a hearing conducted by the
25522552 Executive Council of Physical Therapy and Occupational Therapy
25532553 Examiners.
25542554 (e) The Executive Council of Physical Therapy and
25552555 Occupational Therapy Examiners shall destroy criminal history
25562556 record information that is obtained under this section after the
25572557 information is used for its authorized purpose.
25582558 SECTION 53. Subchapter F, Chapter 411, Government Code, is
25592559 amended by adding Section 411.12514 to read as follows:
25602560 Sec. 411.12514. ACCESS TO CRIMINAL HISTORY RECORD
25612561 INFORMATION: TEXAS STATE BOARD OF PLUMBING EXAMINERS. (a) The
25622562 Texas State Board of Plumbing Examiners is entitled to obtain
25632563 criminal history record information as provided by Subsection (b)
25642564 that relates to an applicant for a license, registration,
25652565 endorsement, or certificate under Chapter 1301, Occupations Code,
25662566 including a license, registration, endorsement, or certificate, as
25672567 applicable, for any of the following functions: master plumber,
25682568 journeyman plumber, plumbing inspector, tradesman-plumber limited,
25692569 plumber's apprentice, multipurpose residential fire protection
25702570 sprinkler specialist, water supply protection specialist, and
25712571 medical gas piping installation.
25722572 (b) Subject to Section 411.087 and consistent with the
25732573 public policy of this state, the Texas State Board of Plumbing
25742574 Examiners is entitled to:
25752575 (1) obtain through the Federal Bureau of Investigation
25762576 criminal history record information maintained or indexed by that
25772577 bureau that pertains to a person described by Subsection (a); and
25782578 (2) obtain from the department or any other criminal
25792579 justice agency in this state criminal history record information
25802580 maintained by the department or that criminal justice agency that
25812581 relates to a person described by Subsection (a).
25822582 (c) The Texas State Board of Plumbing Examiners may not
25832583 release or disclose to any person criminal history record
25842584 information obtained from the Federal Bureau of Investigation under
25852585 Subsection (b)(1). Criminal history record information obtained by
25862586 the Texas State Board of Plumbing Examiners under Subsection (b)(2)
25872587 may not be released or disclosed to any person except on court
25882588 order, with the written consent of the person or entity that is the
25892589 subject of the criminal history record information, or as provided
25902590 by Subsection (d).
25912591 (d) The Texas State Board of Plumbing Examiners is not
25922592 prohibited from disclosing criminal history record information
25932593 obtained under Subsection (b)(2) in a criminal proceeding or in a
25942594 hearing conducted by the Texas State Board of Plumbing Examiners.
25952595 (e) The Texas State Board of Plumbing Examiners shall
25962596 destroy criminal history record information that is obtained under
25972597 this section after the information is used for its authorized
25982598 purpose.
25992599 SECTION 54. Subchapter F, Chapter 411, Government Code, is
26002600 amended by adding Section 411.12515 to read as follows:
26012601 Sec. 411.12515. ACCESS TO CRIMINAL HISTORY RECORD
26022602 INFORMATION: TEXAS REAL ESTATE COMMISSION AND TEXAS APPRAISER
26032603 LICENSING AND CERTIFICATION BOARD. (a) In this section:
26042604 (1) "Board" means the Texas Appraiser Licensing and
26052605 Certification Board.
26062606 (2) "Commission" means the Texas Real Estate
26072607 Commission.
26082608 (b) The commission is entitled to obtain criminal history
26092609 record information as provided by Subsection (d) that relates to:
26102610 (1) an applicant for an initial broker or sales agent
26112611 license or renewal of a broker or sales agent license under Chapter
26122612 1101, Occupations Code;
26132613 (2) an applicant for an original certificate of
26142614 registration as an easement or right-of-way agent or renewal of a
26152615 certificate of registration as an easement or right-of-way agent
26162616 under Chapter 1101, Occupations Code; or
26172617 (3) an applicant for an apprentice inspector license,
26182618 a real estate inspector license, or a professional inspector
26192619 license or renewal of an apprentice inspector license, a real
26202620 estate inspector license, or a professional inspector license under
26212621 Chapter 1102, Occupations Code.
26222622 (c) The board is entitled to obtain criminal history record
26232623 information as provided by Subsection (d) that relates to:
26242624 (1) an applicant for an appraiser trainee license, a
26252625 residential appraiser license, a residential appraiser
26262626 certificate, or a general appraiser certificate or renewal of an
26272627 appraiser trainee license, a residential appraiser license, a
26282628 residential appraiser certificate, or a general appraiser
26292629 certificate under Chapter 1103, Occupations Code; or
26302630 (2) an applicant for registration or renewal of a
26312631 registration as an appraisal management company under Chapter 1104,
26322632 Occupations Code.
26332633 (d) Subject to Section 411.087 of this code and Sections
26342634 1101.3521, 1101.4521, 1101.5041, 1102.1051, and 1103.2031,
26352635 Occupations Code, and consistent with the public policy of this
26362636 state, the commission and the board are entitled to:
26372637 (1) obtain through the Federal Bureau of Investigation
26382638 criminal history record information maintained or indexed by that
26392639 bureau that pertains to a person described by Subsection (b) or (c);
26402640 and
26412641 (2) obtain from the department or any other criminal
26422642 justice agency in this state criminal history record information
26432643 maintained by the department or that criminal justice agency that
26442644 relates to a person described by Subsection (b) or (c).
26452645 (e) The commission or the board, as applicable, may not
26462646 release or disclose to any person criminal history record
26472647 information obtained from the Federal Bureau of Investigation under
26482648 Subsection (d)(1). The commission or the board, as applicable, is
26492649 not prohibited from disclosing criminal history record information
26502650 obtained under Subsection (d)(2) in a criminal proceeding or in a
26512651 hearing conducted by the State Office of Administrative Hearings on
26522652 behalf of that agency.
26532653 (f) The commission or board shall destroy criminal history
26542654 record information that is obtained under this section after the
26552655 information is used for its authorized purpose.
26562656 SECTION 55. Subchapter F, Chapter 411, Government Code, is
26572657 amended by adding Section 411.12516 to read as follows:
26582658 Sec. 411.12516. ACCESS TO CRIMINAL HISTORY RECORD
26592659 INFORMATION: TEXAS BOARD OF PROFESSIONAL ENGINEERS AND LAND
26602660 SURVEYORS. (a) The Texas Board of Professional Engineers and Land
26612661 Surveyors is entitled to obtain criminal history record information
26622662 as provided by Subsection (b) that relates to an applicant for or
26632663 holder of a license under Chapters 1001 and 1071, Occupations Code.
26642664 (b) Subject to Section 411.087 of this code and Section
26652665 1001.272, Occupations Code, and consistent with the public policy
26662666 of this state, the Texas Board of Professional Engineers and Land
26672667 Surveyors is entitled to:
26682668 (1) obtain through the Federal Bureau of Investigation
26692669 criminal history record information maintained or indexed by that
26702670 bureau that pertains to a person described by Subsection (a); and
26712671 (2) obtain from the department or any other criminal
26722672 justice agency in this state criminal history record information
26732673 maintained by the department or that criminal justice agency that
26742674 relates to a person described by Subsection (a).
26752675 (c) The Texas Board of Professional Engineers and Land
26762676 Surveyors may not release or disclose to any person criminal
26772677 history record information obtained from the Federal Bureau of
26782678 Investigation under Subsection (b)(1). Criminal history record
26792679 information obtained by the Texas Board of Professional Engineers
26802680 and Land Surveyors under Subsection (b)(2) may not be released or
26812681 disclosed to any person except on court order, with the written
26822682 consent of the person who is the subject of the criminal history
26832683 record information, or as provided by Subsection (d).
26842684 (d) The Texas Board of Professional Engineers and Land
26852685 Surveyors is not prohibited from disclosing criminal history record
26862686 information obtained under Subsection (b)(2) in a criminal
26872687 proceeding or in a hearing conducted by the Texas Board of
26882688 Professional Engineers and Land Surveyors.
26892689 (e) The Texas Board of Professional Engineers and Land
26902690 Surveyors shall destroy criminal history record information that is
26912691 obtained under this section after the information is used for its
26922692 authorized purpose.
26932693 SECTION 56. Subchapter F, Chapter 411, Government Code, is
26942694 amended by adding Section 411.12517 to read as follows:
26952695 Sec. 411.12517. ACCESS TO CRIMINAL HISTORY RECORD
26962696 INFORMATION: TEXAS STATE BOARD OF PHARMACY. (a) The Texas State
26972697 Board of Pharmacy is entitled to obtain criminal history record
26982698 information as provided by Subsection (b) that relates to a person
26992699 who:
27002700 (1) is an applicant for or holder of a license,
27012701 certificate, registration, permit, or other authorization under
27022702 Chapters 557, 558, 559, and 568, Occupations Code;
27032703 (2) is an applicant for or holder of a Class A, Class
27042704 B, Class C, Class D, or Class E pharmacy license under Chapters 560
27052705 and 561, Occupations Code;
27062706 (3) requests a determination of eligibility for a
27072707 license, certificate, registration, permit, or other authorization
27082708 from the Texas State Board of Pharmacy; or
27092709 (4) is an applicant for employment at or current
27102710 employee of the Texas State Board of Pharmacy.
27112711 (b) Subject to Section 411.087 and consistent with the
27122712 public policy of this state, the Texas State Board of Pharmacy is
27132713 entitled to:
27142714 (1) obtain through the Federal Bureau of Investigation
27152715 criminal history record information maintained or indexed by that
27162716 bureau that pertains to a person described by Subsection (a); and
27172717 (2) obtain from the department or any other criminal
27182718 justice agency in this state criminal history record information
27192719 maintained by the department or that criminal justice agency that
27202720 relates to a person described by Subsection (a).
27212721 (c) The Texas State Board of Pharmacy may not release or
27222722 disclose to any person criminal history record information obtained
27232723 from the Federal Bureau of Investigation under Subsection (b)(1).
27242724 Criminal history record information obtained by the Texas State
27252725 Board of Pharmacy under Subsection (b)(2) may not be released or
27262726 disclosed to any person except on court order, with the written
27272727 consent of the person who is the subject of the criminal history
27282728 record information, or as provided by Subsection (d).
27292729 (d) The Texas State Board of Pharmacy is not prohibited from
27302730 disclosing criminal history record information obtained under
27312731 Subsection (b)(2) in a criminal proceeding or in a hearing
27322732 conducted by the Texas State Board of Pharmacy or the State Office
27332733 of Administrative Hearings.
27342734 (e) The Texas State Board of Pharmacy shall destroy criminal
27352735 history record information obtained under this section after a
27362736 final determination is made in the matter for which the information
27372737 was obtained.
27382738 SECTION 57. The heading to Section 411.1296, Government
27392739 Code, is amended to read as follows:
27402740 Sec. 411.1296. ACCESS TO CRIMINAL HISTORY RECORD
27412741 INFORMATION: EMPLOYMENT BY APPRAISAL DISTRICT, [AND] APPOINTMENT
27422742 TO APPRAISAL REVIEW BOARD FOR APPRAISAL DISTRICT, AND APPLICANT TO
27432743 TEXAS APPRAISER LICENSING AND CERTIFICATION BOARD.
27442744 SECTION 58. Section 411.1296, Government Code, is amended
27452745 by amending Subsections (a) and (c) and adding Subsections (a-1),
27462746 (d), (e), and (f) to read as follows:
27472747 (a) Except as provided by Subsection (b), an appraisal
27482748 district established by Section 6.01, Tax Code, and the Texas
27492749 Appraiser Licensing and Certification Board are [is] entitled to
27502750 obtain [from the department] criminal history record information as
27512751 provided by Subsection (a-1) [maintained by the department] that
27522752 relates to a person who is an applicant for employment by the
27532753 appraisal district, [or] for appointment to the appraisal review
27542754 board for the appraisal district, for a license or certification as
27552755 an appraiser trainee, licensed residential appraiser, certified
27562756 residential appraiser, or certified general appraiser, or for an
27572757 appraisal management company regulated by the Texas Appraiser
27582758 Licensing and Certification Board.
27592759 (a-1) Subject to Section 411.087 and consistent with the
27602760 public policy of this state, an appraisal district and the Texas
27612761 Appraiser Licensing and Certification Board are entitled to:
27622762 (1) obtain through the Federal Bureau of Investigation
27632763 criminal history record information maintained or indexed by that
27642764 bureau that pertains to a person described by Subsection (a); and
27652765 (2) obtain from the department or any other criminal
27662766 justice agency in this state criminal history record information
27672767 maintained by the department or that criminal justice agency that
27682768 relates to a person described by Subsection (a).
27692769 (c) The appraisal district may provide criminal history
27702770 record information obtained under Subsection (a-1)(2) [this
27712771 section] to the local administrative district judge or to the
27722772 appraisal review board commissioners appointed by the local
27732773 administrative district judge.
27742774 (d) An appraisal district or the Texas Appraiser Licensing
27752775 and Certification Board, as applicable, may not release or disclose
27762776 to any person criminal history record information obtained from the
27772777 Federal Bureau of Investigation under Subsection (a-1)(1).
27782778 Criminal history record information obtained by an appraisal
27792779 district or the Texas Appraiser Licensing and Certification Board
27802780 under Subsection (a-1)(2) may not be released or disclosed to any
27812781 person except on court order, with the written consent of the person
27822782 who is the subject of the criminal history record information, or as
27832783 provided by Subsections (c) and (e).
27842784 (e) An appraisal district or the Texas Appraiser Licensing
27852785 and Certification Board is not prohibited from disclosing criminal
27862786 history record information obtained under Subsection (a-1)(2) in a
27872787 criminal proceeding or in a hearing conducted by an appraisal
27882788 district or the Texas Appraiser Licensing and Certification Board.
27892789 (f) An appraisal district or the Texas Appraiser Licensing
27902790 and Certification Board shall destroy criminal history record
27912791 information that is obtained under this section after the
27922792 information is used for its authorized purpose.
27932793 SECTION 59. Section 411.1386, Government Code, is amended
27942794 by amending Subsections (a), (a-6), (b), (c), (g), and (h) and
27952795 adding Subsections (a-7) and (c-1) to read as follows:
27962796 (a) Except as provided by Subsections (a-1)[, (a-5),] and
27972797 (a-6), the clerk of the county having venue over a proceeding for
27982798 the appointment of a guardian under Title 3, Estates Code, shall
27992799 obtain [from the department] criminal history record information as
28002800 provided by Subsection (a-7) [maintained by the department] that
28012801 relates to[:
28022802 [(1) a private professional guardian;
28032803 [(2) each person who represents or plans to represent
28042804 the interests of a ward as a guardian on behalf of the private
28052805 professional guardian;
28062806 [(3) each person employed by a private professional
28072807 guardian who will:
28082808 [(A) have personal contact with a ward or
28092809 proposed ward;
28102810 [(B) exercise control over and manage a ward's
28112811 estate; or
28122812 [(C) perform any duties with respect to the
28132813 management of a ward's estate;
28142814 [(4) each person employed by or volunteering or
28152815 contracting with a guardianship program to provide guardianship
28162816 services to a ward of the program on the program's behalf; or
28172817 [(5)] any [other] person proposed to serve as a
28182818 guardian under Title 3, Estates Code, including a proposed
28192819 temporary guardian, [and] a proposed successor guardian, or any
28202820 person who will have contact with the proposed ward or the proposed
28212821 ward's estate on behalf of the proposed guardian, other than an
28222822 attorney or a certified guardian.
28232823 (a-6) The clerk described by Subsection (a) is not required
28242824 to obtain criminal history record information from the department
28252825 for a person if the Judicial Branch Certification Commission
28262826 conducted a criminal history check on the person under Sections
28272827 155.203 and 155.207 [Chapter 155]. The commission shall provide to
28282828 the clerk [at the court's request] the criminal history record
28292829 information that was obtained from the department [or the Federal
28302830 Bureau of Investigation]. The clerk shall, in accordance with
28312831 Subsection (a-7)(1), obtain criminal history record information
28322832 from the Federal Bureau of Investigation identification division
28332833 relating to any person described by Subsection (a).
28342834 (a-7) Subject to Section 411.087 and consistent with the
28352835 public policy of this state, the clerk described by Subsection (a)
28362836 is entitled to:
28372837 (1) obtain through the Federal Bureau of Investigation
28382838 criminal history record information maintained or indexed by that
28392839 bureau that pertains to a person described by Subsection (a); and
28402840 (2) obtain from the department or any other criminal
28412841 justice agency in this state criminal history record information
28422842 maintained by the department or that criminal justice agency that
28432843 relates to a person described by Subsection (a).
28442844 (b) Criminal history record information obtained by or
28452845 provided to a clerk under this section [Subsection (a), (a-5), or
28462846 (a-6)] is for the exclusive use of the court and is privileged and
28472847 confidential.
28482848 (c) A clerk may not release or disclose to any person
28492849 criminal history record information obtained from the Federal
28502850 Bureau of Investigation under Subsection (a-7)(1). Criminal
28512851 history record information obtained by or provided to a clerk under
28522852 Subsection (a-7)(2) [(a), (a-5),] or (a-6) may not be released or
28532853 disclosed to any person or agency except on court order or with the
28542854 consent of the person who is the subject of the information.
28552855 (c-1) The clerk shall [may] destroy the criminal history
28562856 record information after the information is used for the purposes
28572857 authorized by this section.
28582858 (g) A person commits an offense if the person releases or
28592859 discloses any information received under this section without the
28602860 authorization prescribed by Subsection (c) [or (d)]. An offense
28612861 under this subsection is a Class A misdemeanor.
28622862 (h) The county clerk may charge a $10 fee to recover the
28632863 costs of obtaining criminal history record information [records]
28642864 authorized by Subsection (a-7) [(a)].
28652865 SECTION 60. Section 411.13861, Government Code, is amended
28662866 by amending Subsections (a), (b), and (c) and adding Subsections
28672867 (a-1) and (c-1) to read as follows:
28682868 (a) The Health and Human Services Commission is entitled to
28692869 obtain [from the Department of Public Safety] criminal history
28702870 record information as provided by Subsection (a-1) [maintained by
28712871 the Department of Public Safety] that relates to a person:
28722872 (1) who is required to undergo a background and
28732873 criminal history check under Chapter 248A, Health and Safety Code;
28742874 (2) who seeks unsupervised visits with a ward of the
28752875 Health and Human Services Commission, including a relative of the
28762876 ward;
28772877 (3) who is an applicant for employment with the Health
28782878 and Human Services Commission for a position in which the person, as
28792879 an employee, would have direct access to residents or clients of a
28802880 facility regulated by the Health and Human Services Commission, as
28812881 determined by the executive commissioner of that commission; or
28822882 (4) who is an employee of the Health and Human Services
28832883 Commission and who has direct access to residents or clients of a
28842884 facility regulated by that commission, as determined by the
28852885 executive commissioner of that commission.
28862886 (a-1) Subject to Section 411.087 and consistent with the
28872887 public policy of this state, the Health and Human Services
28882888 Commission is entitled to:
28892889 (1) obtain through the Federal Bureau of Investigation
28902890 criminal history record information maintained or indexed by that
28912891 bureau that pertains to a person who is described by Subsection (a);
28922892 and
28932893 (2) obtain from the department or any other criminal

28962896 relates to a person described by Subsection (a).
28972897 (b) Criminal history record information obtained under
28982898 Subsection (a-1) [(a)] is for the exclusive use of the Health and
28992899 Human Services Commission and is privileged and confidential.
29002900 (c) The Health and Human Services Commission may not release
29012901 or disclose to any person criminal history record information
29022902 obtained from the Federal Bureau of Investigation under Subsection
29032903 (a-1)(1). Criminal history record information obtained by the
29042904 Health and Human Services Commission under Subsection (a-1)(2)
29052905 [(a)] may not be released or disclosed to any person or agency
29062906 except on court order or with the consent of the person who is the
29072907 subject of the information.
29082908 (c-1) The Health and Human Services Commission shall [may]
29092909 destroy the criminal history record information after the
29102910 information is used for the purposes authorized by this section.
29112911 SECTION 61. Section 411.1405, Government Code, is amended
29122912 by amending Subsections (b), (c), and (d) and adding Subsections
29132913 (b-1) and (g) to read as follows:
29142914 (b) To the extent consistent with Subsection (e), a state
29152915 agency is entitled to obtain [from the department the] criminal
29162916 history record information as provided by Subsection (b-1)
29172917 [maintained by the department] that relates to a person who:
29182918 (1) is an employee, applicant for employment,
29192919 contractor, subcontractor, or intern or other volunteer with the
29202920 state agency or with a contractor or subcontractor for the state
29212921 agency; and
29222922 (2) has access to information resources or information
29232923 resources technologies, other than a desktop computer or telephone
29242924 station assigned to that person.
29252925 (b-1) Subject to Section 411.087 and consistent with the
29262926 public policy of this state, a state agency is entitled to:
29272927 (1) obtain through the Federal Bureau of Investigation
29282928 criminal history record information maintained or indexed by that
29292929 bureau that pertains to a person described by Subsection (b); and
29302930 (2) obtain from the department or any other criminal
29312931 justice agency in this state criminal history record information
29322932 maintained by the department or that criminal justice agency that
29332933 relates to a person described by Subsection (b).
29342934 (c) A state agency may not release or disclose to any person
29352935 criminal history record information obtained from the Federal
29362936 Bureau of Investigation under Subsection (b-1)(1). A state agency
29372937 that obtains criminal history record information under this section
29382938 may not release or disclose the information obtained under
29392939 Subsection (b-1)(2) or any documents or other records derived from
29402940 the information except:
29412941 (1) by court order;
29422942 (2) with the consent of the person who is the subject
29432943 of the information; [or]
29442944 (3) to the affected contractor or subcontractor; or
29452945 (4) as described by Subsection (g) [, unless the
29462946 information was obtained by the department from the Federal Bureau
29472947 of Investigation].
29482948 (d) A state agency and the affected contractor or
29492949 subcontractor shall destroy criminal history record information
29502950 obtained under this section after the information is used for the
29512951 purposes authorized by this section [that relates to a person after
29522952 the information is used to make an employment decision or to take a
29532953 personnel action relating to the person who is the subject of the
29542954 information].
29552955 (g) A state agency is not prohibited from disclosing
29562956 criminal history record information obtained under Subsection
29572957 (b-1)(2) in a criminal proceeding.
29582958 SECTION 62. Section 411.1408, Government Code, is amended
29592959 by amending Subsections (b) and (c) and adding Subsections (b-1)
29602960 and (d) to read as follows:
29612961 (b) The commission is entitled to obtain [from the
29622962 department] criminal history record information as provided by
29632963 Subsection (b-1) [maintained by the department] that relates to a
29642964 person who is an applicant for or the holder of a certificate,
29652965 registration, or license issued by the commission or otherwise
29662966 under Subtitle L, Title 2.
29672967 (b-1) Subject to Section 411.087 and consistent with the
29682968 public policy of this state, the commission is entitled to:
29692969 (1) obtain through the Federal Bureau of Investigation
29702970 criminal history record information maintained or indexed by that
29712971 bureau that pertains to a person described by Subsection (b); and
29722972 (2) obtain from the department or any other criminal
29732973 justice agency in this state criminal history record information
29742974 maintained by the department or that criminal justice agency that
29752975 relates to a person described by Subsection (b).
29762976 (c) The commission may not release or disclose to any person
29772977 criminal history record information obtained from the Federal
29782978 Bureau of Investigation under Subsection (b-1)(1). Criminal
29792979 history record information obtained by the commission under
29802980 Subsection (b-1)(2) [(b)]:
29812981 (1) may be used by the commission for any purpose
29822982 related to the issuance, denial, suspension, revocation, or renewal
29832983 of a certificate, registration, or license issued by the commission
29842984 or otherwise under Subtitle L, Title 2; and
29852985 (2) may not be released or disclosed to any person
29862986 except:
29872987 (A) on court order; or
29882988 (B) [with the consent of the person who is the
29892989 subject of the information; or
29902990 [(C)] as authorized by Section 411.1386(a-6) of
29912991 this code or Section 1104.404, Estates Code, if applicable[; and
29922992 [(3) shall be destroyed by the commission after the
29932993 information is used for the authorized purposes].
29942994 (d) The commission shall destroy criminal history record
29952995 information that is obtained under this section after the
29962996 information is used for its authorized purpose.
29972997 SECTION 63. Section 411.1409, Government Code, is amended
29982998 by amending Subsections (b), (c), (d), and (e) and adding
29992999 Subsection (b-1) to read as follows:
30003000 (b) An appellate court is entitled to obtain [from the
30013001 department] criminal history record information as provided by
30023002 Subsection (b-1) [maintained by the department] that relates to a
30033003 person who is an applicant for:
30043004 (1) employment with the court;
30053005 (2) a volunteer position with the court; or
30063006 (3) an appointment made by the court.
30073007 (b-1) Subject to Section 411.087 and consistent with the
30083008 public policy of this state, the court is entitled to:
30093009 (1) obtain through the Federal Bureau of Investigation
30103010 criminal history record information maintained or indexed by that
30113011 bureau that pertains to a person described by Subsection (b); and
30123012 (2) obtain from the department or any other criminal
30133013 justice agency in this state criminal history record information
30143014 maintained by the department or that criminal justice agency that
30153015 relates to a person described by Subsection (b).
30163016 (c) Criminal history record information obtained by the
30173017 court under this section [Subsection (b)] may be used only to
30183018 evaluate an applicant.
30193019 (d) The court may not release or disclose to any person
30203020 criminal history record information obtained from the Federal
30213021 Bureau of Investigation under Subsection (b-1)(1). The court may
30223022 not release or disclose information obtained under Subsection
30233023 (b-1)(2) [(b)] except on order of a district court [or with the
30243024 consent of the person who is the subject of the criminal history
30253025 record information].
30263026 (e) The [After the expiration of any probationary term of
30273027 the person's employment, volunteer status, or appointment, the]
30283028 court shall destroy [all] criminal history record information
30293029 obtained under this section after the information is used for its
30303030 authorized purpose [Subsection (b)].
30313031 SECTION 64. Subchapter F, Chapter 411, Government Code, is
30323032 amended by adding Section 411.14101 to read as follows:
30333033 Sec. 411.14101. ACCESS TO CRIMINAL HISTORY RECORD
30343034 INFORMATION: STATE OFFICE OF ADMINISTRATIVE HEARINGS. (a) In this
30353035 section, "office" means the State Office of Administrative
30363036 Hearings.
30373037 (b) The office is entitled to obtain criminal history record
30383038 information as provided by Subsection (c) that relates to a person
30393039 who is:
30403040 (1) an employee of, or an applicant for employment
30413041 with, the office; or
30423042 (2) a contractor, subcontractor, volunteer, or intern
30433043 of the office, or an applicant to serve in one of those capacities.
30443044 (c) Subject to Section 411.087 and consistent with the
30453045 public policy of this state, the office is entitled to:
30463046 (1) obtain through the Federal Bureau of Investigation
30473047 criminal history record information maintained or indexed by that
30483048 bureau that pertains to a person described by Subsection (b); and
30493049 (2) obtain from the department or any other criminal
30503050 justice agency in this state criminal history record information
30513051 maintained by the department or that criminal justice agency that
30523052 relates to a person described by Subsection (b).
30533053 (d) The office may not release or disclose to any person
30543054 criminal history record information obtained from the Federal
30553055 Bureau of Investigation under Subsection (c)(1). Criminal history
30563056 record information obtained by the office under Subsection (c)(2)
30573057 may not be released or disclosed to any person except by court order
30583058 or with the written consent of the person who is the subject of the
30593059 criminal history record information.
30603060 (e) The office shall destroy criminal history record
30613061 information that is obtained under this section after the
30623062 information is used for its authorized purpose.
30633063 SECTION 65. Subchapter F, Chapter 411, Government Code, is
30643064 amended by adding Section 411.14102 to read as follows:
30653065 Sec. 411.14102. ACCESS TO CRIMINAL HISTORY RECORD
30663066 INFORMATION: TEXAS BOARD OF ARCHITECTURAL EXAMINERS. (a) The
30673067 Texas Board of Architectural Examiners is entitled to obtain
30683068 criminal history record information as provided by Subsection (b)
30693069 that relates to:
30703070 (1) a person who is:
30713071 (A) an applicant for an architectural
30723072 registration under Chapter 1051, Occupations Code; or
30733073 (B) the holder of an architectural registration
30743074 under that chapter;
30753075 (2) a person who is:
30763076 (A) an applicant for a landscape architectural
30773077 registration under Chapter 1052, Occupations Code; or
30783078 (B) the holder of a landscape architectural
30793079 registration under that chapter; or
30803080 (3) a person who is:
30813081 (A) an applicant for an interior design
30823082 registration under Chapter 1053, Occupations Code; or
30833083 (B) the holder of an interior design registration
30843084 under that chapter.
30853085 (b) Subject to Section 411.087 of this code and Section
30863086 1051.3041, Occupations Code, and consistent with the public policy
30873087 of this state, the Texas Board of Architectural Examiners is
30883088 entitled to:
30893089 (1) obtain through the Federal Bureau of Investigation
30903090 criminal history record information maintained or indexed by that
30913091 bureau that pertains to a person described by Subsection (a); and
30923092 (2) obtain from the department or any other criminal
30933093 justice agency in this state criminal history record information
30943094 maintained by the department or that criminal justice agency that
30953095 relates to a person described by Subsection (a).
30963096 (c) The Texas Board of Architectural Examiners may not
30973097 release or disclose to any person criminal history record
30983098 information obtained from the Federal Bureau of Investigation under
30993099 Subsection (b)(1). Criminal history record information obtained by
31003100 the Texas Board of Architectural Examiners under Subsection (b)(2)
31013101 may not be released or disclosed to any person except on court order
31023102 or as provided by Subsection (d).
31033103 (d) The Texas Board of Architectural Examiners is not
31043104 prohibited from disclosing criminal history record information
31053105 obtained under Subsection (b)(2) in a criminal proceeding or in a
31063106 hearing conducted by the Texas Board of Architectural Examiners or
31073107 the State Office of Administrative Hearings.
31083108 (e) The Texas Board of Architectural Examiners shall
31093109 destroy criminal history record information that is obtained under
31103110 this section after the information is used for its authorized
31113111 purpose.
31123112 SECTION 66. Sections 301.2511(a) and (c), Occupations Code,
31133113 are amended to read as follows:
31143114 (a) An applicant for a vocational, registered, or advanced
31153115 practice registered nurse license must submit to the board, in
31163116 addition to satisfying the other requirements of this subchapter, a
31173117 complete and legible set of fingerprints, on a form prescribed by
31183118 the board, for the purpose of obtaining criminal history record
31193119 information from the Department of Public Safety and the Federal
31203120 Bureau of Investigation.
31213121 (c) The board by rule shall develop a system for obtaining
31223122 criminal history record information for a person accepted for
31233123 enrollment in a nursing educational program that prepares the
31243124 person for [initial] licensure as a vocational, registered, or
31253125 advanced practice registered [or vocational] nurse by requiring the
31263126 person to submit to the board a set of fingerprints that meets the
31273127 requirements of Subsection (a). The board may develop a similar
31283128 system for an applicant for enrollment in a nursing educational
31293129 program. The board may require payment of a fee by a person who is
31303130 required to submit a set of fingerprints under this subsection.
31313131 SECTION 67. Section 1101.002, Occupations Code, is amended
31323132 by adding Subdivision (3-a) to read as follows:
31333133 (3-a) "Easement or right-of-way agent" means a person
31343134 who sells, buys, leases, or transfers an easement or right-of-way
31353135 for another, for compensation or with the expectation of receiving
31363136 compensation, for use in connection with telecommunication,
31373137 utility, railroad, or pipeline service.
31383138 SECTION 68. Section 1101.501, Occupations Code, is amended
31393139 to read as follows:
31403140 Sec. 1101.501. CERTIFICATE REQUIRED. A person may not act
31413141 as an easement or right-of-way agent [sell, buy, lease, or transfer
31423142 an easement or right-of-way for another, for compensation or with
31433143 the expectation of receiving compensation, for use in connection
31443144 with telecommunication, utility, railroad, or pipeline service]
31453145 unless the person:
31463146 (1) holds a license issued under this chapter; or
31473147 (2) holds a certificate of registration issued under
31483148 this subchapter.
31493149 SECTION 69. Section 1101.5041, Occupations Code, is amended
31503150 to read as follows:
31513151 Sec. 1101.5041. CRIMINAL HISTORY RECORD INFORMATION
31523152 REQUIREMENT FOR CERTIFICATE. An applicant for an original
31533153 certificate of registration as an easement or right-of-way agent or
31543154 renewal of a certificate of registration as an easement or
31553155 right-of-way agent must comply with the criminal history record
31563156 check requirements of Section 1101.3521.
31573157 SECTION 70. Section 2025.251, Occupations Code, is amended
31583158 to read as follows:
31593159 Sec. 2025.251. OCCUPATIONAL LICENSE REQUIRED. (a) Except
31603160 as provided by this section, a person, other than as a spectator or
31613161 as a person placing a wager, may not participate in [racing with]
31623162 pari-mutuel racing activities or wagering without first obtaining a
31633163 license from the commission. A person may not engage in any
31643164 occupation for which commission rules require a license under this
31653165 subtitle without first obtaining a license from the commission.
31663166 (b) The commission [by rule] shall [categorize the
31673167 occupations of racetrack employees and] determine the occupations
31683168 that afford [the employee] an opportunity to influence racing with
31693169 pari-mutuel wagering, including individuals who[. The rules must
31703170 require an employee to be licensed under this subtitle if the
31713171 employee]:
31723172 (1) work [works] in an occupation as an employee,
31733173 contractor, or volunteer [determined by the commission] to afford
31743174 the individual [employee] an opportunity to influence racing with
31753175 pari-mutuel wagering; or
31763176 (2) will likely have significant access to the
31773177 backside of a racetrack or to restricted areas of the frontside of a
31783178 racetrack.
31793179 (c) Notwithstanding Subsection (b), the following
31803180 individuals require a criminal history background check before an
31813181 occupational license is issued: commissioners, regulatory
31823182 employees and contractors hired by the commission, racetrack
31833183 association employees, training facility employees, and employees
31843184 of either a recognized horseman's organization or licensed
31853185 racehorse owners.
31863186 SECTION 71. The following provisions are repealed:
31873187 (1) Sections 22.0834(g), (i), (k), (m), and (n),
31883188 Education Code;
31893189 (2) Section 22.08341, Education Code;
31903190 (3) Sections 1104.403, 1104.407, 1104.408, and
31913191 1104.410, Estates Code;
31923192 (4) Section 411.110(d), Government Code;
31933193 (5) Section 411.122(c), Government Code;
31943194 (6) Sections 411.1386(a-4), (a-5), (d), (f), and (i),
31953195 Government Code; and
31963196 (7) Section 411.13861(f), Government Code.
31973197 SECTION 72. This Act takes effect immediately if it
31983198 receives a vote of two-thirds of all the members elected to each
31993199 house, as provided by Section 39, Article III, Texas Constitution.
32003200 If this Act does not receive the vote necessary for immediate
32013201 effect, this Act takes effect September 1, 2023.
