| 7 | 7 | | relating to the authority of certain counties to create a county |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 161.001, Local Government Code, is |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | Sec. 161.001. APPLICABILITY OF CHAPTER. This chapter |
|---|
| 13 | 13 | | applies only to: |
|---|
| 14 | 14 | | (1) a county that: |
|---|
| 15 | 15 | | (A) has a population of 800,000 or more; |
|---|
| 16 | 16 | | (B) is located on the international border; and |
|---|
| 17 | 17 | | (C) before September 1, 2009, had a county ethics |
|---|
| 18 | 18 | | board appointed by the commissioners court; |
|---|
| 19 | 19 | | (2) a county that: |
|---|
| 20 | 20 | | (A) has a population of 425,000 or more; |
|---|
| 21 | 21 | | (B) is adjacent to a county with a population of |
|---|
| 22 | 22 | | 3.3 million or more; and |
|---|
| 23 | 23 | | (C) contains a portion of the San Jacinto River; |
|---|
| 24 | 24 | | [and] |
|---|
| 25 | 25 | | (3) a county that has a population of less than 40,000 |
|---|
| 26 | 26 | | that is adjacent to a county with a population of more than 3.3 |
|---|
| 27 | 27 | | million; and |
|---|
| 28 | 28 | | (4) a county that has a population of more than 3.3 |
|---|
| 29 | 29 | | million. |
|---|
| 30 | 30 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 31 | 31 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 32 | 32 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 33 | 33 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 34 | 34 | | Act takes effect September 1, 2023. |
