66 AN ACT
77 relating to the authority of certain counties to create a county
88 ethics commission.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 161.001, Local Government Code, is
1111 amended to read as follows:
1212 Sec. 161.001. APPLICABILITY OF CHAPTER. This chapter
1313 applies only to:
1414 (1) a county that:
1515 (A) has a population of 800,000 or more;
1616 (B) is located on the international border; and
1717 (C) before September 1, 2009, had a county ethics
1818 board appointed by the commissioners court;
1919 (2) a county that:
2020 (A) has a population of 425,000 or more;
2121 (B) is adjacent to a county with a population of
2222 3.3 million or more; and
2323 (C) contains a portion of the San Jacinto River;
2424 [and]
2525 (3) a county that has a population of less than 40,000
2626 that is adjacent to a county with a population of more than 3.3
2727 million; and
2828 (4) a county that has a population of more than 3.3
2929 million.
3030 SECTION 2. This Act takes effect immediately if it receives
3131 a vote of two-thirds of all the members elected to each house, as
3232 provided by Section 39, Article III, Texas Constitution. If this
3333 Act does not receive the vote necessary for immediate effect, this
3434 Act takes effect September 1, 2023.
