55 AN ACT
66 relating to a mitigation and preparedness program and a fortified
77 homes program administered by the Texas Windstorm Insurance
88 Association.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 2210.454, Insurance Code, is amended to
1111 read as follows:
1212 Sec. 2210.454. MITIGATION AND PREPAREDNESS PROGRAM
1313 [PLAN]. (a) Subject to a plan approved by the [The] commissioner,
1414 the association may administer [shall annually develop and
1515 implement] a mitigation and preparedness program [plan].
1616 (b) Each [state fiscal] year, the association [department]
1717 may fund the mitigation and preparedness program [plan] using money
1818 from the catastrophe reserve trust fund not to exceed $500,000
1919 annually [available funds].
2020 (c) The association must design the mitigation and
2121 preparedness program [plan must provide for actions to be taken in
2222 the seacoast territory by the commissioner, or by a local
2323 government, state agency, educational institution, or nonprofit
2424 organization designated by the commissioner in the plan, to
2525 implement programs] to:
2626 (1) improve preparedness for windstorm and hail
2727 catastrophes; and
2828 (2) reduce potential losses in the event of such a
2929 catastrophe[; and
3030 [(3) provide research into the means to:
3131 [(A) reduce those losses;
3232 [(B) educate or inform the public in determining
3333 the appropriateness of particular upgrades to structures; or
3434 [(C) protect infrastructure from potential
3535 damage from those catastrophes].
3636 (d) Money [in excess of $1 million] may not be used under
3737 this section if the commissioner determines that an expenditure [of
3838 investment income] from the trust fund would jeopardize the
3939 actuarial soundness of the association [fund] or materially impair
4040 the ability of the association [fund] to serve the state purposes
4141 for which the association [fund] was established.
4242 SECTION 2. Subchapter J, Chapter 2210, Insurance Code, is
4343 amended by adding Section 2210.456 to read as follows:
4444 Sec. 2210.456. FORTIFIED HOMES PROGRAM. (a) Subject to a
4545 plan approved by the commissioner, the association may administer a
4646 fortified homes program.
4747 (b) Each year, the association may fund the fortified homes
4848 program using money from the catastrophe reserve trust fund not to
4949 exceed $500,000 annually.
5050 (c) The fortified homes program must be designed to:
5151 (1) improve preparedness for windstorm and hail
5252 catastrophes; and
5353 (2) reduce potential losses in the event of such a
5454 catastrophe.
5555 (d) Money may not be used under this section if the
5656 commissioner determines that an expenditure from the trust fund
5757 would:
5858 (1) jeopardize the actuarial soundness of the
5959 association; or
6060 (2) materially impair the ability of the association
6161 to serve the state purposes for which the association was
6262 established.
6363 SECTION 3. This Act takes effect September 1, 2023.
