44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to a study by the Texas A&M Transportation Institute
77 regarding the economic impact of navigation districts on the state
88 and local economies.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. (a) In this section, "institute" means the Texas
1111 A&M Transportation Institute.
1212 (b) The institute, in consultation with the comptroller of
1313 public accounts and the standing committees of the legislature with
1414 primary jurisdiction over the institute, shall study each
1515 navigation district and municipal utility agency responsible for a
1616 ship channel with a federally authorized depth of at least 35 feet
1717 in this state.
1818 (c) In conducting the study, the institute shall, for each
1919 navigation district and municipal utility agency:
2020 (1) analyze the district's and agency's:
2121 (A) assessment of fees imposed by the district or
2222 agency;
2323 (B) cargoes and commodities;
2424 (C) navigation safety; and
2525 (D) primary expenditures; and
2626 (2) collect the following information:
2727 (A) annual fee income;
2828 (B) consistency of fee income;
2929 (C) historical rate of growth in the previous 15
3030 years for fee income;
3131 (D) fee income sources;
3232 (E) expenditures based on the following
3333 categories:
3434 (i) labor for maintenance and operations;
3535 (ii) materials for maintenance and
3636 operations;
3737 (iii) materials for expansion projects;
3838 (iv) consumables;
3939 (v) cost overruns;
4040 (vi) utilities;
4141 (vii) capital expenditures;
4242 (viii) project expenditures; and
4343 (ix) operating expenditures;
4444 (F) direct economic impacts to the state and
4545 local economies from the district's or agency's activities;
4646 (G) projected economic growth over the next 10
4747 years;
4848 (H) an assessment of all import and export
4949 commodities; and
5050 (I) a comprehensive analysis of security and
5151 resiliency of cargoes, vessels, containers, and navigation.
5252 (d) The institute shall disaggregate the data described by
5353 Subsection (c) of this section by county.
5454 (e) Not later than December 1, 2024, the institute shall
5555 prepare a written report with the information described by this
5656 section, a summary of the institute's findings, and recommendations
5757 for legislative or other action and submit the report to the
5858 governor, the lieutenant governor, the speaker of the house of
5959 representatives, and the chairs of the committees of the
6060 legislature with primary jurisdiction over the institute.
6161 (f) This section expires January 1, 2025.
6262 SECTION 2. This Act takes effect September 1, 2023.
