66 AN ACT
77 relating to a uniform coordination of benefits questionnaire for
88 health benefit plans.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 1203, Insurance Code, is amended by
1111 adding Subchapter C to read as follows:
1212 SUBCHAPTER C. COORDINATION OF BENEFITS QUESTIONNAIRE
1313 Sec. 1203.101. APPLICABILITY OF SUBCHAPTER. (a) This
1414 subchapter applies only to a health benefit plan that provides
1515 benefits for medical or surgical expenses incurred as a result of a
1616 health condition, accident, or sickness, including an individual,
1717 group, blanket, or franchise insurance policy or insurance
1818 agreement, a group hospital service contract, or an individual or
1919 group evidence of coverage or similar coverage document that is
2020 issued by:
2121 (1) an insurance company;
2222 (2) a group hospital service corporation operating
2323 under Chapter 842;
2424 (3) a health maintenance organization operating under
2525 Chapter 843;
2626 (4) an approved nonprofit health corporation that
2727 holds a certificate of authority under Chapter 844;
2828 (5) a multiple employer welfare arrangement that holds
2929 a certificate of authority under Chapter 846;
3030 (6) a stipulated premium company operating under
3131 Chapter 884;
3232 (7) a fraternal benefit society operating under
3333 Chapter 885;
3434 (8) a Lloyd's plan operating under Chapter 941; or
3535 (9) an exchange operating under Chapter 942.
3636 (b) Notwithstanding any other law, this subchapter applies
3737 to:
3838 (1) a small employer health benefit plan subject to
3939 Chapter 1501, including coverage provided through a health group
4040 cooperative under Subchapter B of that chapter;
4141 (2) a standard health benefit plan issued under
4242 Chapter 1507;
4343 (3) a basic coverage plan under Chapter 1551;
4444 (4) a basic plan under Chapter 1575;
4545 (5) a primary care coverage plan under Chapter 1579;
4646 (6) a plan providing basic coverage under Chapter
4747 1601;
4848 (7) nonprofit agricultural organization health
4949 benefits offered by a nonprofit agricultural organization under
5050 Chapter 1682;
5151 (8) alternative health benefit coverage offered by a
5252 subsidiary of the Texas Mutual Insurance Company under Subchapter
5353 M, Chapter 2054;
5454 (9) health benefits provided by or through a church
5555 benefits board under Subchapter I, Chapter 22, Business
5656 Organizations Code;
5757 (10) group health coverage made available by a school
5858 district in accordance with Section 22.004, Education Code;
5959 (11) the state Medicaid program, including the
6060 Medicaid managed care program operated under Chapter 533,
6161 Government Code;
6262 (12) the child health plan program under Chapter 62,
6363 Health and Safety Code;
6464 (13) a regional or local health care program operated
6565 under Section 75.104, Health and Safety Code;
6666 (14) a self-funded health benefit plan sponsored by a
6767 professional employer organization under Chapter 91, Labor Code;
6868 (15) county employee group health benefits provided
6969 under Chapter 157, Local Government Code; and
7070 (16) health and accident coverage provided by a risk
7171 pool created under Chapter 172, Local Government Code.
7272 Sec. 1203.102. CREATION OF UNIFORM COORDINATION OF BENEFITS
7373 QUESTIONNAIRE. In collaboration with appropriate stakeholders,
7474 the commissioner shall adopt rules establishing a uniform
7575 coordination of benefits questionnaire to be used by all health
7676 benefit plan issuers and administrators in this state.
7777 Sec. 1203.103. UNIFORM COORDINATION OF BENEFITS
7878 QUESTIONNAIRE REQUIRED. Each health benefit plan issuer and
7979 administrator shall use the uniform coordination of benefits
8080 questionnaire established under Section 1203.102 and make the
8181 questionnaire available to health care providers as appropriate.
8282 SECTION 2. (a) Not later than January 1, 2024, the
8383 commissioner of insurance shall adopt rules establishing the
8484 uniform coordination of benefits questionnaire under Section
8585 1203.102, Insurance Code, as added by this Act.
8686 (b) The changes in law made by this Act apply only to the use
8787 of a coordination of benefits questionnaire on or after February 1,
8888 2024.
8989 SECTION 3. This Act takes effect September 1, 2023.
