66 AN ACT
77 relating to the consideration of modeled sustained groundwater
88 pumping in the adoption of desired future conditions in groundwater
99 conservation districts.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 36.001, Water Code, is amended by adding
1212 Subdivision (32) to read as follows:
1313 (32) "Modeled sustained groundwater pumping" means
1414 the maximum amount of groundwater that the executive administrator,
1515 using the best available science, determines may be produced
1616 annually in perpetuity from an aquifer.
1717 SECTION 2. Section 36.108, Water Code, is amended by
1818 amending Subsection (d) and adding Subsection (d-5) to read as
1919 follows:
2020 (d) Not later than May 1, 2021, and every five years
2121 thereafter, the districts shall consider groundwater availability
2222 models and other data or information for the management area and
2323 shall propose for adoption desired future conditions for the
2424 relevant aquifers within the management area. Before voting on the
2525 proposed desired future conditions of the aquifers under Subsection
2626 (d-2), the districts shall consider:
2727 (1) aquifer uses or conditions within the management
2828 area, including conditions that differ substantially from one
2929 geographic area to another;
3030 (2) the water supply needs and water management
3131 strategies included in the state water plan;
3232 (3) hydrological conditions[, including] for each
3333 aquifer in the management area, including:
3434 (A) the total estimated recoverable storage; [as
3535 provided by the executive administrator, and]
3636 (B) the average annual recharge, inflows, and
3737 discharge; and
3838 (C) if calculated by the executive
3939 administrator, the modeled sustained groundwater pumping;
4040 (4) other environmental impacts, including impacts on
4141 spring flow and other interactions between groundwater and surface
4242 water;
4343 (5) the impact on subsidence;
4444 (6) socioeconomic impacts reasonably expected to
4545 occur;
4646 (7) the impact on the interests and rights in private
4747 property, including ownership and the rights of management area
4848 landowners and their lessees and assigns in groundwater as
4949 recognized under Section 36.002;
5050 (8) the feasibility of achieving the desired future
5151 condition; and
5252 (9) any other information relevant to the specific
5353 desired future conditions.
5454 (d-5) Notwithstanding Subsection (d)(3), the executive
5555 administrator may not calculate the modeled sustained groundwater
5656 pumping for an aquifer or an aquifer that wholly or partly underlies
5757 an aquifer with a recharge rate such that an owner of land that
5858 overlies the aquifer qualifies or has previously qualified under
5959 federal tax law for a cost depletion deduction for the groundwater
6060 withdrawn from the aquifer for irrigation purposes.
6161 SECTION 3. This Act takes effect September 1, 2023.
