99 relating to purchasing by the Department of Information Resources
1010 of information technology commodity items.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 2157.068(a), Government Code, is amended
1313 to read as follows:
1414 (a) In this section:
1515 (1) "Commodity[, "commodity] items" means commercial
1616 software, hardware, or technology services, other than
1717 telecommunications services, that are generally available to
1818 businesses or the public and for which the department determines
1919 that a reasonable demand exists from a customer [two or more
2020 customers], including a state agency or [agencies and] political
2121 subdivision [subdivisions] of this state, an entity [entities]
2222 described by Subsection (j), or a [and] governmental entity
2323 [entities] of another state, that purchases [purchase] the items
2424 through the department. The term includes seat management, through
2525 which a customer transfers its personal computer equipment and
2626 service responsibilities to a private vendor to manage the personal
2727 computing needs for each desktop of the customer, including all
2828 necessary hardware, software, and support services.
2929 (2) "Technology services" means services, regardless
3030 of how the fees for those services are generally charged, that:
3131 (A) relate to the development, configuration,
3232 review, assessment, acquisition, implementation, or maintenance of
3333 information technology hardware, software, or services; or
3434 (B) consist of other routine technology services
3535 not described by Paragraph (A).
3636 SECTION 2. This Act takes effect September 1, 2023.
