| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 534.053, Government Code, is amended by |
|---|
| 12 | 12 | | amending Subsection (b) and adding Subsection (b-1) to read as |
|---|
| 13 | 13 | | follows: |
|---|
| 14 | 14 | | (b) To the greatest extent possible, the executive |
|---|
| 15 | 15 | | commissioner shall appoint members of the advisory committee who: |
|---|
| 16 | 16 | | (1) reflect the geographic diversity of the state and |
|---|
| 17 | 17 | | include members who represent rural Medicaid recipients; and |
|---|
| 18 | 18 | | (2) will ensure the continuity in and effective |
|---|
| 19 | 19 | | fulfillment of the advisory committee's advisory responsibility. |
|---|
| 20 | 20 | | (b-1) A member of the advisory committee serves a four-year |
|---|
| 21 | 21 | | term and may be reappointed. |
|---|
| 22 | 22 | | SECTION 2. As soon as practicable after the effective date |
|---|
| 23 | 23 | | of this Act, the executive commissioner of the Health and Human |
|---|
| 24 | 24 | | Services Commission shall adopt rules necessary to implement |
|---|
| 25 | 25 | | Section 534.053, Government Code, as amended by this Act. |
|---|
| 26 | 26 | | SECTION 3. Section 534.053(b-1), Government Code, as added |
|---|
| 27 | 27 | | by this Act, applies to a member of the Intellectual and |
|---|
| 28 | 28 | | Developmental Disability System Redesign Advisory Committee, |
|---|
| 29 | 29 | | regardless of when the member was appointed. For purposes of that |
|---|
| 30 | 30 | | section, the term of a member appointed to the advisory committee |
|---|
| 31 | 31 | | before the effective date of this Act begins on the effective date |
|---|
| 32 | 32 | | of this Act or the date designated by the executive commissioner of |
|---|
| 33 | 33 | | the Health and Human Services Commission as the executive |
|---|
| 34 | 34 | | commissioner determines necessary to effectuate staggered terms. |
|---|
| 35 | 35 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 36 | 36 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 37 | 37 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 38 | 38 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 39 | 39 | | Act takes effect September 1, 2023. |
