| 7 | 7 | | relating to unlawfully carrying a handgun in a motor vehicle or |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 46.02(a-1), Penal Code, is amended to |
|---|
| 11 | 11 | | read as follows: |
|---|
| 12 | 12 | | (a-1) A person commits an offense if the person |
|---|
| 13 | 13 | | intentionally, knowingly, or recklessly carries a handgun on or |
|---|
| 14 | 14 | | about his or her person [a handgun] in a motor vehicle or watercraft |
|---|
| 15 | 15 | | [that is owned by the person or under the person's control] at any |
|---|
| 16 | 16 | | time in which: |
|---|
| 17 | 17 | | (1) the handgun is in plain view, unless the person is |
|---|
| 18 | 18 | | 21 years of age or older or is licensed to carry a handgun under |
|---|
| 19 | 19 | | Subchapter H, Chapter 411, Government Code, and the handgun is |
|---|
| 20 | 20 | | carried in a holster; or |
|---|
| 21 | 21 | | (2) the person is: |
|---|
| 22 | 22 | | (A) engaged in criminal activity, other than a |
|---|
| 23 | 23 | | Class C misdemeanor that is a violation of a law or ordinance |
|---|
| 24 | 24 | | regulating traffic or boating; or |
|---|
| 25 | 25 | | (B) prohibited by law from possessing a firearm. |

| 26 | 26 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 27 | 27 | | to an offense committed on or after the effective date of this |
|---|
| 28 | 28 | | Act. An offense committed before the effective date of this Act is |
|---|
| 29 | 29 | | governed by the law in effect on the date the offense was committed, |
|---|
| 30 | 30 | | and the former law is continued in effect for that purpose. For |
|---|
| 31 | 31 | | purposes of this section, an offense was committed before the |
|---|
| 32 | 32 | | effective date of this Act if any element of the offense occurred |
|---|
| 33 | 33 | | before that date. |
|---|
| 34 | 34 | | SECTION 3. This Act takes effect September 1, 2023. |
