| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Subchapter C, Chapter 132, Agriculture Code, is |
|---|
| 10 | 10 | | amended by adding Section 132.048 to read as follows: |
|---|
| 11 | 11 | | Sec. 132.048. REUSED EGG CARTON. A retailer or a person |
|---|
| 12 | 12 | | directly selling eggs to a consumer may sell eggs packaged in a |
|---|
| 13 | 13 | | reused carton if the carton is properly labeled with the |
|---|
| 14 | 14 | | information required by Section 132.044. |
|---|
| 15 | 15 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 16 | 16 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 17 | 17 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 18 | 18 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 19 | 19 | | Act takes effect September 1, 2023. |
