A BILL TO BE ENTITLED
AN ACT
relating to the sale of eggs in a reused carton.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter C, Chapter 132, Agriculture Code, is
amended by adding Section 132.048 to read as follows:
Sec. 132.048. REUSED EGG CARTON. A retailer or a person
directly selling eggs to a consumer may sell eggs packaged in a
reused carton if the carton is properly labeled with the
information required by Section 132.044.
SECTION 2. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2023.
