55 relating to the limitations period for certain criminal offenses
66 based on assaultive conduct.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Article 12.01, Code of Criminal Procedure, is
99 amended to read as follows:
1010 Art. 12.01. FELONIES. Except as provided in Article 12.03,
1111 felony indictments may be presented within these limits, and not
1212 afterward:
1313 (1) no limitation:
1414 (A) murder and manslaughter;
1515 (B) sexual assault under Section 22.011(a)(2),
1616 Penal Code, or aggravated sexual assault under Section
1717 22.021(a)(1)(B), Penal Code;
1818 (C) sexual assault, if:
1919 (i) during the investigation of the offense
2020 biological matter is collected and the matter:
2121 (a) has not yet been subjected to
2222 forensic DNA testing; or
2323 (b) has been subjected to forensic DNA
2424 testing and the testing results show that the matter does not match
2525 the victim or any other person whose identity is readily
2626 ascertained; or
2727 (ii) probable cause exists to believe that
2828 the defendant has committed the same or a similar sex offense
2929 against five or more victims;
3030 (D) continuous sexual abuse of young child or
3131 disabled individual under Section 21.02, Penal Code;
3232 (E) indecency with a child under Section 21.11,
3333 Penal Code;
3434 (F) an offense involving leaving the scene of an
3535 accident under Section 550.021, Transportation Code, if the
3636 accident resulted in the death of a person;
3737 (G) trafficking of persons under Section
3838 20A.02(a)(7) or (8), Penal Code;
3939 (H) continuous trafficking of persons under
4040 Section 20A.03, Penal Code; or
4141 (I) compelling prostitution under Section
4242 43.05(a)(2), Penal Code;
4343 (2) ten years from the date of the commission of the
4444 offense:
4545 (A) theft of any estate, real, personal or mixed,
4646 by an executor, administrator, guardian or trustee, with intent to
4747 defraud any creditor, heir, legatee, ward, distributee,
4848 beneficiary or settlor of a trust interested in such estate;
4949 (B) theft by a public servant of government
5050 property over which the public servant exercises control in the
5151 public servant's official capacity;
5252 (C) forgery or the uttering, using, or passing of
5353 forged instruments;
5454 (D) injury to an elderly or disabled individual
5555 punishable as a felony of the first degree under Section 22.04,
5656 Penal Code;
5757 (E) sexual assault, except as provided by
5858 Subdivision (1) or (7);
5959 (F) arson;
6060 (G) trafficking of persons under Section
6161 20A.02(a)(1), (2), (3), or (4), Penal Code; or
6262 (H) compelling prostitution under Section
6363 43.05(a)(1), Penal Code;
6464 (3) seven years from the date of the commission of the
6565 offense:
6666 (A) misapplication of fiduciary property or
6767 property of a financial institution;
6868 (B) fraudulent securing of document execution;
6969 (C) a felony violation under Chapter 162, Tax
7070 Code;
7171 (D) false statement to obtain property or credit
7272 under Section 32.32, Penal Code;
7373 (E) money laundering;
7474 (F) credit card or debit card abuse under Section
7575 32.31, Penal Code;
7676 (G) fraudulent use or possession of identifying
7777 information under Section 32.51, Penal Code;
7878 (H) exploitation of a child, elderly individual,
7979 or disabled individual under Section 32.53, Penal Code;
8080 (I) health care fraud under Section 35A.02, Penal
8181 Code; or
8282 (J) bigamy under Section 25.01, Penal Code,
8383 except as provided by Subdivision (6);
8484 (4) five years from the date of the commission of the
8585 offense:
8686 (A) theft or robbery;
8787 (B) except as provided by Subdivision (5),
8888 kidnapping or burglary;
8989 (C) injury to an elderly or disabled individual
9090 that is not punishable as a felony of the first degree under Section
9191 22.04, Penal Code;
9292 (D) abandoning or endangering a child; [or]
9393 (E) insurance fraud;
9494 (F) assault under Section 22.01, Penal Code, if
9595 the assault was committed against a person whose relationship to or
9696 association with the defendant is described by Section 71.0021(b),
9797 71.003, or 71.005, Family Code;
9898 (G) continuous violence against the family under
9999 Section 25.11, Penal Code; or
100100 (H) aggravated assault under Section 22.02,
101101 Penal Code;
102102 (5) if the investigation of the offense shows that the
103103 victim is younger than 17 years of age at the time the offense is
104104 committed, 20 years from the 18th birthday of the victim of one of
105105 the following offenses:
106106 (A) sexual performance by a child under Section
107107 43.25, Penal Code;
108108 (B) aggravated kidnapping under Section
109109 20.04(a)(4), Penal Code, if the defendant committed the offense
110110 with the intent to violate or abuse the victim sexually; or
111111 (C) burglary under Section 30.02, Penal Code, if
112112 the offense is punishable under Subsection (d) of that section and
113113 the defendant committed the offense with the intent to commit an
114114 offense described by Subdivision (1)(B) or (D) of this article or
115115 Paragraph (B) of this subdivision;
116116 (6) ten years from the 18th birthday of the victim of
117117 the offense:
118118 (A) trafficking of persons under Section
119119 20A.02(a)(5) or (6), Penal Code;
120120 (B) injury to a child under Section 22.04, Penal
121121 Code; or
122122 (C) bigamy under Section 25.01, Penal Code, if
123123 the investigation of the offense shows that the person, other than
124124 the legal spouse of the defendant, whom the defendant marries or
125125 purports to marry or with whom the defendant lives under the
126126 appearance of being married is younger than 18 years of age at the
127127 time the offense is committed;
128128 (7) two years from the date the offense was
129129 discovered: sexual assault punishable as a state jail felony under
130130 Section 22.011(f)(2), Penal Code; or
131131 (8) three years from the date of the commission of the
132132 offense: all other felonies.
133133 SECTION 2. Article 12.02, Code of Criminal Procedure, is
134134 amended to read as follows:
135135 Art. 12.02. MISDEMEANORS. (a) Except as provided by
136136 Subsection (b), the following charging instruments may be presented
137137 within two years from the date of the commission of the offense, and
138138 not afterward:
139139 (1) an [An] indictment or information for any Class A
140140 or Class B misdemeanor; and
141141 (2) a [may be presented within two years from the date
142142 of the commission of the offense, and not afterward.
143143 [(b) A] complaint or information for any Class C
144144 misdemeanor.
145145 (b) An indictment, information, or complaint, as
146146 applicable, for assault under Section 22.01, Penal Code, may be
147147 presented within three [two] years from the date of the commission
148148 of the offense, and not afterward, if the offense:
149149 (1) is punishable as a misdemeanor; and
150150 (2) was committed against a person whose relationship
151151 to or association with the defendant is described by Section
152152 71.0021(b), 71.003, or 71.005, Family Code.
153153 SECTION 3. The change in law made by this Act does not apply
154154 to an offense if the prosecution of that offense becomes barred by
155155 limitation before the effective date of this Act. The prosecution
156156 of that offense remains barred as if this Act had not taken effect.
157157 SECTION 4. This Act takes effect September 1, 2023.
