| 8 | 8 | | underutilized instructional campus allotment under the public |
|---|
| 9 | 9 | | school finance system. |

| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter D, Chapter 11, Education Code, is |
|---|
| 12 | 12 | | amended by adding Section 11.172 to read as follows: |
|---|
| 13 | 13 | | Sec. 11.172. CLOSURE OF CAMPUS. Before the board of |
|---|
| 14 | 14 | | trustees of a school district orders the closure of a campus in the |
|---|
| 15 | 15 | | district: |
|---|
| 16 | 16 | | (1) the board must hold at least two public meetings at |
|---|
| 17 | 17 | | a location in the attendance zone of the campus to discuss the |
|---|
| 18 | 18 | | closure of the campus and receive feedback from the community; and |
|---|
| 19 | 19 | | (2) if the determination to close the campus is based |
|---|
| 20 | 20 | | on the fact that the campus is an underutilized instructional |
|---|
| 21 | 21 | | campus, as defined by Section 48.2521, the board must, if feasible, |
|---|
| 22 | 22 | | enter into a contract for the operation of the district campus under |
|---|
| 23 | 23 | | Section 11.174 instead of closing the campus. |
|---|
| 24 | 24 | | SECTION 2. Subchapter F, Chapter 48, Education Code, is |
|---|
| 25 | 25 | | amended by adding Section 48.2521 to read as follows: |
|---|
| 26 | 26 | | Sec. 48.2521. UNDERUTILIZED INSTRUCTIONAL CAMPUS |
|---|
| 27 | 27 | | ALLOTMENT. (a) In this section, "underutilized instructional |
|---|
| 28 | 28 | | campus" means a campus of a school district at which student |
|---|
| 29 | 29 | | instruction is provided and the number of students in average daily |
|---|
| 30 | 30 | | attendance enrolled at the campus constitutes 50 percent or less of |
|---|
| 31 | 31 | | the maximum student capacity of the campus, as determined by |
|---|
| 32 | 32 | | commissioner rule. |
|---|
| 33 | 33 | | (b) In addition to the amount to which a school district is |
|---|
| 34 | 34 | | entitled under Section 48.252, for the first two school years for |
|---|
| 35 | 35 | | which an underutilized instructional campus in a school district is |
|---|
| 36 | 36 | | operated under a contract entered into by the school district under |
|---|
| 37 | 37 | | Section 11.174, the district is entitled to an allotment equal to |
|---|
| 38 | 38 | | the product of the amount of funding to which the district is |
|---|
| 39 | 39 | | entitled under Section 48.252 for each student in average daily |
|---|
| 40 | 40 | | attendance multiplied by the amount equal to the difference |
|---|
| 41 | 41 | | between: |
|---|
| 42 | 42 | | (1) the number of students equal to the maximum |
|---|
| 43 | 43 | | student capacity of the underutilized instructional campus; and |
|---|
| 44 | 44 | | (2) the number of students in attendance at the |
|---|
| 45 | 45 | | underutilized instructional campus on the last Friday in October of |
|---|
| 46 | 46 | | the school year for which the allotment is provided. |
|---|
| 47 | 47 | | SECTION 3. This Act takes effect September 1, 2023. |
