55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the closure of a school district campus and an
88 underutilized instructional campus allotment under the public
99 school finance system.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter D, Chapter 11, Education Code, is
1212 amended by adding Section 11.172 to read as follows:
1313 Sec. 11.172. CLOSURE OF CAMPUS. Before the board of
1414 trustees of a school district orders the closure of a campus in the
1515 district:
1616 (1) the board must hold at least two public meetings at
1717 a location in the attendance zone of the campus to discuss the
1818 closure of the campus and receive feedback from the community; and
1919 (2) if the determination to close the campus is based
2020 on the fact that the campus is an underutilized instructional
2121 campus, as defined by Section 48.2521, the board must, if feasible,
2222 enter into a contract for the operation of the district campus under
2323 Section 11.174 instead of closing the campus.
2424 SECTION 2. Subchapter F, Chapter 48, Education Code, is
2525 amended by adding Section 48.2521 to read as follows:
2626 Sec. 48.2521. UNDERUTILIZED INSTRUCTIONAL CAMPUS
2727 ALLOTMENT. (a) In this section, "underutilized instructional
2828 campus" means a campus of a school district at which student
2929 instruction is provided and the number of students in average daily
3030 attendance enrolled at the campus constitutes 50 percent or less of
3131 the maximum student capacity of the campus, as determined by
3232 commissioner rule.
3333 (b) In addition to the amount to which a school district is
3434 entitled under Section 48.252, for the first two school years for
3535 which an underutilized instructional campus in a school district is
3636 operated under a contract entered into by the school district under
3737 Section 11.174, the district is entitled to an allotment equal to
3838 the product of the amount of funding to which the district is
3939 entitled under Section 48.252 for each student in average daily
4040 attendance multiplied by the amount equal to the difference
4141 between:
4242 (1) the number of students equal to the maximum
4343 student capacity of the underutilized instructional campus; and
4444 (2) the number of students in attendance at the
4545 underutilized instructional campus on the last Friday in October of
4646 the school year for which the allotment is provided.
4747 SECTION 3. This Act takes effect September 1, 2023.
