 A BILL TO BE ENTITLED
 AN ACT
 relating to the closure of a school district campus and an
 underutilized instructional campus allotment under the public
 school finance system.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1.  Subchapter D, Chapter 11, Education Code, is
 amended by adding Section 11.172 to read as follows:
 Sec. 11.172.  CLOSURE OF CAMPUS. Before the board of
 trustees of a school district orders the closure of a campus in the
 district:
 (1)  the board must hold at least two public meetings at
 a location in the attendance zone of the campus to discuss the
 closure of the campus and receive feedback from the community; and
 (2)  if the determination to close the campus is based
 on the fact that the campus is an underutilized instructional
 campus, as defined by Section 48.2521, the board must, if feasible,
 enter into a contract for the operation of the district campus under
 Section 11.174 instead of closing the campus.
 SECTION 2.  Subchapter F, Chapter 48, Education Code, is
 amended by adding Section 48.2521 to read as follows:
 Sec. 48.2521.  UNDERUTILIZED INSTRUCTIONAL CAMPUS
 ALLOTMENT. (a)  In this section, "underutilized instructional
 campus" means a campus of a school district at which student
 instruction is provided and the number of students in average daily
 attendance enrolled at the campus constitutes 50 percent or less of
 the maximum student capacity of the campus, as determined by
 commissioner rule.
 (b)  In addition to the amount to which a school district is
 entitled under Section 48.252, for the first two school years for
 which an underutilized instructional campus in a school district is
 operated under a contract entered into by the school district under
 Section 11.174, the district is entitled to an allotment equal to
 the product of the amount of funding to which the district is
 entitled under Section 48.252 for each student in average daily
 attendance multiplied by the amount equal to the difference
 between:
 (1)  the number of students equal to the maximum
 student capacity of the underutilized instructional campus; and
 (2)  the number of students in attendance at the
 underutilized instructional campus on the last Friday in October of
 the school year for which the allotment is provided.
 SECTION 3.  This Act takes effect September 1, 2023.
