6 | 6 | | student conducted by a public school's threat assessment and safe |

7 | 7 | | and supportive school team. |

8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 9 | | SECTION 1. Section 37.115, Education Code, is amended by |
---|
10 | 10 | | adding Subsections (f-1) and (f-2) to read as follows: |
---|
11 | 11 | | (f-1) Before a team may conduct a threat assessment of a |
---|
12 | 12 | | student, the team must notify the parent of or person standing in |
---|
13 | 13 | | parental relation to the student regarding the assessment. In |
---|
14 | 14 | | conducting the assessment, the team shall provide an opportunity |
---|
15 | 15 | | for the parent or person to: |
---|
16 | 16 | | (1) participate in the assessment, either in person or |
---|
17 | 17 | | remotely; and |
---|
18 | 18 | | (2) submit to the team information regarding the |
---|
19 | 19 | | student. |
---|
20 | 20 | | (f-2) After completing a threat assessment of a student, the |
---|
21 | 21 | | team shall provide to the parent of or person standing in parental |
---|
22 | 22 | | relation to the student the team's findings and conclusions |
---|
23 | 23 | | regarding the student. |
---|
24 | 24 | | SECTION 2. This Act applies beginning with the 2023-2024 |
---|
25 | 25 | | school year. |
---|
26 | 26 | | SECTION 3. This Act takes effect immediately if it receives |
---|
27 | 27 | | a vote of two-thirds of all the members elected to each house, as |
---|
28 | 28 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
29 | 29 | | Act does not receive the vote necessary for immediate effect, this |
---|
30 | 30 | | Act takes effect September 1, 2023. |
