A BILL TO BE ENTITLED
AN ACT
relating to the authority of a school district to contract with an
open-enrollment charter school to operate certain district
campuses.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 11.174, Education Code, is amended by
adding Subsection (a-1) to read as follows:
(a-1) If a school district campus is located in the
territory of another district, the district may not enter a
contract under Subsection (a) for that campus to be operated by an
open-enrollment charter school unless authorized by a majority vote
of the board of trustees of both districts.
SECTION 2. This Act takes effect September 1, 2023.
