77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Subchapter B, Chapter 372, Transportation Code,
99 is amended by adding Section 372.059 to read as follows:
1010 Sec. 372.059. TREATMENT OF TOLL ROADWAY DURING INCLEMENT
1111 WEATHER. (a) Except as provided by Subsections (e) and (f), a toll
1212 project entity that treats a roadway maintained by the entity
1313 during icy or snowy weather shall require each employee or
1414 contractor who develops and supervises a plan for roadway treatment
1515 to complete a training course on treating roadways during icy or
1616 snowy weather in the same manner as a department employee who treats
1717 roadways during icy or snowy weather.
1818 (b) The department, in coordination with public toll
1919 project entities:
2020 (1) shall make training courses that the department
2121 provides to department employees who develop and supervise plans
2222 for roadway treatment available to a person required to receive
2323 training under Subsection (a); and
2424 (2) may adopt rules as necessary to implement this
2525 section.
2626 (c) The department, in coordination with toll project
2727 entities, shall identify the types of employees and contractors who
2828 are subject to the training requirements under Subsection (a).
2929 (d) A training course described by Subsection (b) must
3030 include instruction regarding:
3131 (1) prioritizing treatment of elevated structures and
3232 other roadway elements that pose the highest risk to public health
3333 and safety during icy or snowy weather;
3434 (2) timing of treatment of roadways during icy or
3535 snowy weather; and
3636 (3) treatment of general purpose lanes adjacent to a
3737 toll project.
3838 (e) The department may authorize a toll project entity to
3939 require that an employee or contractor required to receive training
4040 under Subsection (a) complete a training course provided by another
4141 entity that includes substantially the same information as a course
4242 provided by the department.
4343 (f) For a roadway that is subject to a comprehensive
4444 development agreement entered into by the department or a public
4545 toll project entity under which a private participant is
4646 responsible for maintaining the roadway, the private participant is
4747 responsible for requiring each employee or contractor of the
4848 private participant who develops and supervises a plan for roadway
4949 treatment to complete the training required by Subsection (a).
5050 SECTION 2. This Act takes effect September 1, 2023.
