7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

8 | 8 | | SECTION 1. Subchapter B, Chapter 372, Transportation Code, |
---|
9 | 9 | | is amended by adding Section 372.059 to read as follows: |
---|
10 | 10 | | Sec. 372.059. TREATMENT OF TOLL ROADWAY DURING INCLEMENT |
---|
11 | 11 | | WEATHER. (a) Except as provided by Subsections (e) and (f), a toll |
---|
12 | 12 | | project entity that treats a roadway maintained by the entity |
---|
13 | 13 | | during icy or snowy weather shall require each employee or |
---|
14 | 14 | | contractor who develops and supervises a plan for roadway treatment |
---|
15 | 15 | | to complete a training course on treating roadways during icy or |
---|
16 | 16 | | snowy weather in the same manner as a department employee who treats |
---|
17 | 17 | | roadways during icy or snowy weather. |
---|
18 | 18 | | (b) The department, in coordination with public toll |
---|
19 | 19 | | project entities: |
---|
20 | 20 | | (1) shall make training courses that the department |
---|
21 | 21 | | provides to department employees who develop and supervise plans |
---|
22 | 22 | | for roadway treatment available to a person required to receive |
---|
23 | 23 | | training under Subsection (a); and |
---|
24 | 24 | | (2) may adopt rules as necessary to implement this |
---|
25 | 25 | | section. |
---|
26 | 26 | | (c) The department, in coordination with toll project |
---|
27 | 27 | | entities, shall identify the types of employees and contractors who |
---|
28 | 28 | | are subject to the training requirements under Subsection (a). |
---|
29 | 29 | | (d) A training course described by Subsection (b) must |
---|
30 | 30 | | include instruction regarding: |
---|
31 | 31 | | (1) prioritizing treatment of elevated structures and |
---|
32 | 32 | | other roadway elements that pose the highest risk to public health |
---|
33 | 33 | | and safety during icy or snowy weather; |
---|
34 | 34 | | (2) timing of treatment of roadways during icy or |
---|
35 | 35 | | snowy weather; and |
---|
36 | 36 | | (3) treatment of general purpose lanes adjacent to a |
---|
37 | 37 | | toll project. |
---|
38 | 38 | | (e) The department may authorize a toll project entity to |
---|
39 | 39 | | require that an employee or contractor required to receive training |
---|
40 | 40 | | under Subsection (a) complete a training course provided by another |
---|
41 | 41 | | entity that includes substantially the same information as a course |
---|
42 | 42 | | provided by the department. |
---|
43 | 43 | | (f) For a roadway that is subject to a comprehensive |
---|
44 | 44 | | development agreement entered into by the department or a public |
---|
45 | 45 | | toll project entity under which a private participant is |
---|
46 | 46 | | responsible for maintaining the roadway, the private participant is |
---|
47 | 47 | | responsible for requiring each employee or contractor of the |
---|
48 | 48 | | private participant who develops and supervises a plan for roadway |
---|
49 | 49 | | treatment to complete the training required by Subsection (a). |
---|
50 | 50 | | SECTION 2. This Act takes effect September 1, 2023. |
