| 12 | 12 | | of the Texas Commission on Environmental Quality. |

| 13 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 14 | 14 | | SECTION 1. Section 5.124(f), Water Code, is amended to read |
|---|
| 15 | 15 | | as follows: |
|---|
| 16 | 16 | | (f) A grant may be made by direct award only if: |
|---|
| 17 | 17 | | (1) the executive director determines that: |
|---|
| 18 | 18 | | (A) selection of recipients by the solicitation |
|---|
| 19 | 19 | | of proposals or applications is not feasible; and |
|---|
| 20 | 20 | | (B) awarding the grant directly is in the best |
|---|
| 21 | 21 | | interest of the state; |
|---|
| 22 | 22 | | (2) eligibility for the grant is limited to: |
|---|
| 23 | 23 | | (A) an agency or political subdivision of this |
|---|
| 24 | 24 | | state or of another state; |
|---|
| 25 | 25 | | (B) a state institution of higher learning of |
|---|
| 26 | 26 | | this state or of another state, including any part or service of the |
|---|
| 27 | 27 | | institution; [or] |
|---|
| 28 | 28 | | (C) an agency of the United States; or |
|---|
| 29 | 29 | | (D) a nonprofit organization and the grant is |
|---|
| 30 | 30 | | awarded for the purpose of funding projects implementing a |
|---|
| 31 | 31 | | comprehensive conservation and management plan under the Federal |
|---|
| 32 | 32 | | Water Pollution Control Act (33 U.S.C. Section 1251 et seq.) for a |
|---|
| 33 | 33 | | national estuary located in this state; or |
|---|
| 34 | 34 | | (3) the grant is awarded to a person established or |
|---|
| 35 | 35 | | authorized to develop or implement a comprehensive conservation and |
|---|
| 36 | 36 | | management plan under Section 320, Federal Water Pollution Control |
|---|
| 37 | 37 | | Act (33 U.S.C. Section 1330), for a national estuary in this state. |
|---|
| 38 | 38 | | SECTION 2. This Act takes effect September 1, 2023. |
