99 A BILL TO BE ENTITLED
1010 AN ACT
1111 relating to the eligibility requirements for grants under programs
1212 of the Texas Commission on Environmental Quality.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Section 5.124(f), Water Code, is amended to read
1515 as follows:
1616 (f) A grant may be made by direct award only if:
1717 (1) the executive director determines that:
1818 (A) selection of recipients by the solicitation
1919 of proposals or applications is not feasible; and
2020 (B) awarding the grant directly is in the best
2121 interest of the state;
2222 (2) eligibility for the grant is limited to:
2323 (A) an agency or political subdivision of this
2424 state or of another state;
2525 (B) a state institution of higher learning of
2626 this state or of another state, including any part or service of the
2727 institution; [or]
2828 (C) an agency of the United States; or
2929 (D) a nonprofit organization and the grant is
3030 awarded for the purpose of funding projects implementing a
3131 comprehensive conservation and management plan under the Federal
3232 Water Pollution Control Act (33 U.S.C. Section 1251 et seq.) for a
3333 national estuary located in this state; or
3434 (3) the grant is awarded to a person established or
3535 authorized to develop or implement a comprehensive conservation and
3636 management plan under Section 320, Federal Water Pollution Control
3737 Act (33 U.S.C. Section 1330), for a national estuary in this state.
3838 SECTION 2. This Act takes effect September 1, 2023.
