66 AN ACT
77 relating to expedited forcible detainer suits to evict certain
88 occupants of a dwelling.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 24, Property Code, is amended by adding
1111 Section 24.012 to read as follows:
1212 Sec. 24.012. FORCIBLE DETAINER SUITS AGAINST CERTAIN
1313 OCCUPANTS OF A DWELLING. (a) Notwithstanding any other law, a
1414 person with the right of possession of a dwelling may file a
1515 forcible detainer suit to remove an occupant of the dwelling who:
1616 (1) is not the property owner;
1717 (2) is not entitled to occupy the dwelling under a
1818 written lease or oral rental agreement with:
1919 (A) the landlord; or
2020 (B) another person entitled to occupy the
2121 dwelling under a written lease or oral rental agreement with the
2222 landlord; and
2323 (3) does not pay rent.
2424 (b) A person is not required to comply with any oral or
2525 written notice requirement of this chapter or any other law before
2626 the person files a forcible detainer suit under this section.
2727 (c) A person who files a forcible detainer suit under this
2828 section is entitled to a judgment for possession and a writ of
2929 possession under Section 24.0061 if the person presents to the
3030 court:
3131 (1) a copy of one or more of the following orders
3232 protecting the person filing the suit or a tenant or lawful occupant
3333 of the dwelling from family violence alleged to have been committed
3434 by the person whose eviction is sought:
3535 (A) a temporary injunction issued under
3636 Subchapter F, Chapter 6, Family Code;
3737 (B) a temporary ex parte order issued under
3838 Chapter 83, Family Code;
3939 (C) a protective order issued under Chapter 85,
4040 Family Code; or
4141 (D) an order of emergency protection under
4242 Article 17.292, Code of Criminal Procedure;
4343 (2) a copy of documentation of the family violence
4444 described against the person filing the suit or a tenant or lawful
4545 occupant of the dwelling by the person whose eviction is sought
4646 from:
4747 (A) a licensed health care services provider who
4848 examined the victim;
4949 (B) a licensed mental health services provider
5050 who examined or evaluated the victim; or
5151 (C) an advocate as defined by Section 93.001,
5252 Family Code, who assisted the victim;
5353 (3) if the person filing the suit or a tenant or lawful
5454 occupant of the dwelling is a victim or a parent or guardian of a
5555 victim of sexual assault under Section 22.011, Penal Code,
5656 aggravated sexual assault under Section 22.021, Penal Code,
5757 indecency with a child under Section 21.11, Penal Code, sexual
5858 performance by a child under Section 43.25, Penal Code, continuous
5959 sexual abuse of young child or disabled individual under Section
6060 21.02, Penal Code, or an attempt to commit any of the preceding
6161 offenses under Section 15.01, Penal Code, that takes place during
6262 the preceding six-month period at the dwelling or on the dwelling
6363 premises, that is alleged to have been committed by the person whose
6464 eviction is sought, a copy of:
6565 (A) documentation of the assault or abuse, or
6666 attempted assault or abuse, of the victim from a licensed health
6767 care services provider who examined the victim;
6868 (B) documentation of the assault or abuse, or
6969 attempted assault or abuse, of the victim from a licensed mental
7070 health services provider who examined or evaluated the victim;
7171 (C) documentation of the assault or abuse, or
7272 attempted assault or abuse, of the victim from an individual
7373 authorized under Chapter 420, Government Code, who provided
7474 services to the victim; or
7575 (D) documentation of a protective order issued
7676 under Subchapter A, Chapter 7B, Code of Criminal Procedure, except
7777 for a temporary ex parte order;
7878 (4) if the person filing the suit or a tenant or lawful
7979 occupant of the dwelling is a victim or a parent or guardian of a
8080 victim of stalking under Section 42.072, Penal Code, that takes
8181 place during the preceding six-month period at the dwelling or on
8282 the dwelling premises, that is alleged to have been committed by the
8383 person whose eviction is sought, a copy of:
8484 (A) documentation of a protective order issued
8585 under Subchapter A or B, Chapter 7B, Code of Criminal Procedure,
8686 except for a temporary ex parte order; or
8787 (B) documentation of the stalking from a provider
8888 of services described by Subdivision (1), (2), or (3) and:
8989 (i) a law enforcement incident report or,
9090 if a law enforcement incident report is unavailable, another record
9191 maintained in the ordinary course of business by a law enforcement
9292 agency; and
9393 (ii) if the report or record described by
9494 Paragraph (A) identifies the victim by means of a pseudonym, as
9595 defined by Article 58.001, Code of Criminal Procedure, a copy of a
9696 pseudonym form completed and returned under Article 58.152(a) of
9797 that code; or
9898 (5) evidence showing that the person whose eviction is
9999 sought has been convicted of either:
100100 (A) a violent offense, including:
101101 (i) aggravated assault under Section 22.02,
102102 Penal Code;
103103 (ii) robbery under Section 29.02, Penal
104104 Code;
105105 (iii) murder under Section 19.02, Penal
106106 Code; or
107107 (iv) an attempt to commit any of the
108108 preceding offenses under Section 15.01, Penal Code; or
109109 (B) a sex offense, including:
110110 (i) sexual assault under Section 22.011,
111111 Penal Code;
112112 (ii) aggravated sexual assault under
113113 Section 22.021, Penal Code;
114114 (iii) indecency with a child under Section
115115 21.11, Penal Code;
116116 (iv) sexual performance by a child under
117117 Section 43.25, Penal Code;
118118 (v) continuous sexual abuse of a young
119119 child or disabled individual under Section 21.02, Penal Code; or
120120 (vi) an attempt to commit any of the
121121 preceding offenses under Section 15.01, Penal Code.
122122 (d) A court shall expedite a hearing on a suit filed under
123123 this section.
124124 SECTION 2. This Act takes effect September 1, 2023.
