77 relating to creating a cause of action for nonconsensual condom

99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Title 4, Civil Practice and Remedies Code, is
1111 amended by adding Chapter 98C to read as follows:
1212 CHAPTER 98C. LIABILITY FOR NONCONSENSUAL REMOVAL OF CONDOM DURING
1313 INTERCOURSE
1414 Sec. 98C.001. LIABILITY FOR NONCONSENSUAL REMOVAL OF CONDOM
1515 DURING INTERCOURSE. A defendant is liable to an individual if the
1616 defendant, after removing a condom without the individual's
1717 consent, caused contact between the defendant's sexual organ and
1818 the individual's anus or sexual organ.
1919 Sec. 98C.002. DAMAGES. (a) A court shall award a claimant
2020 who prevails in an action brought under this chapter:
2121 (1) actual damages, including damages for mental
2222 anguish;
2323 (2) appropriate injunctive relief;
2424 (3) court costs; and
2525 (4) reasonable attorney's fees.
2626 (b) In addition to an award under Subsection (a), a claimant
2727 who prevails in an action brought under this chapter may recover
2828 exemplary damages.
2929 SECTION 2. The change in law made by this Act applies only
3030 to a cause of action that accrues on or after the effective date of
3131 this Act.
3232 SECTION 3. This Act takes effect September 1, 2023.
