9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Title 4, Civil Practice and Remedies Code, is |

11 | 11 | | amended by adding Chapter 98C to read as follows: |

12 | 12 | | CHAPTER 98C. LIABILITY FOR NONCONSENSUAL REMOVAL OF CONDOM DURING |

14 | 14 | | Sec. 98C.001. LIABILITY FOR NONCONSENSUAL REMOVAL OF CONDOM |

15 | 15 | | DURING INTERCOURSE. A defendant is liable to an individual if the |
---|
16 | 16 | | defendant, after removing a condom without the individual's |
---|
17 | 17 | | consent, caused contact between the defendant's sexual organ and |
---|
18 | 18 | | the individual's anus or sexual organ. |
---|
19 | 19 | | Sec. 98C.002. DAMAGES. (a) A court shall award a claimant |
---|
20 | 20 | | who prevails in an action brought under this chapter: |
---|
21 | 21 | | (1) actual damages, including damages for mental |
---|
22 | 22 | | anguish; |
---|
23 | 23 | | (2) appropriate injunctive relief; |
---|
24 | 24 | | (3) court costs; and |
---|
25 | 25 | | (4) reasonable attorney's fees. |
---|
26 | 26 | | (b) In addition to an award under Subsection (a), a claimant |
---|
27 | 27 | | who prevails in an action brought under this chapter may recover |
---|
28 | 28 | | exemplary damages. |
---|
29 | 29 | | SECTION 2. The change in law made by this Act applies only |
---|
30 | 30 | | to a cause of action that accrues on or after the effective date of |
---|
31 | 31 | | this Act. |
---|
32 | 32 | | SECTION 3. This Act takes effect September 1, 2023. |
