88 AN ACT
99 relating to operation by certain nonprofit organizations of certain
1010 regional health care programs for employees of small employers.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 75.051, Health and Safety Code, is
1313 amended by adding Subsection (c) to read as follows:
1414 (c) A community-based nonprofit organization may establish
1515 or participate in a regional health care program under this
1616 subchapter without the participation of the commissioners court of
1717 a county if the program is a premium assistance program not offering
1818 health care services or health care benefits.
1919 SECTION 2. Section 75.052(a), Health and Safety Code, is
2020 amended to read as follows:
2121 (a) A regional health care program may be operated subject
2222 to the direct governance of the commissioners courts of the
2323 participating counties or, for a program under Section 75.051(c), a
2424 nonprofit organization. A local health care program may be
2525 operated subject to the direct governance of the commissioners
2626 court of the participating county. A regional or local health care
2727 program may be operated by a joint council, tax-exempt nonprofit
2828 entity, or other entity that:
2929 (1) operates the program under a contract with the
3030 commissioners court or courts, as applicable; [or]
3131 (2) is an entity in which the county or counties
3232 participate or that is established or designated by the
3333 commissioners court or courts, as applicable, to operate the
3434 program; or
3535 (3) for a program under Section 75.051(c), is a
3636 participating nonprofit organization.
3737 SECTION 3. Section 75.101, Health and Safety Code, is
3838 amended to read as follows:
3939 Sec. 75.101. ALTERNATIVE PROGRAMS AUTHORIZED; PROGRAM
4040 OBJECTIVES. In developing a regional or local health care program,
4141 a governing body may provide health care services or benefits as
4242 described by this subchapter or may develop another type of program
4343 to accomplish the purposes of this chapter. A regional or local
4444 health care program must be developed, to the extent practicable,
4545 to:
4646 (1) reduce the number of individuals without health
4747 benefit plan coverage within the boundaries of the participating
4848 county or counties or, for a program under Section 75.051(c), in a
4949 county in which a participating nonprofit organization operates;
5050 (2) address rising health care costs and reduce the
5151 cost of health care services or health benefit plan coverage for
5252 small employers and their employees within the boundaries of the
5353 participating county or counties or, for a program under Section
5454 75.051(c), in a county in which a participating nonprofit
5555 organization operates;
5656 (3) promote preventive care and reduce the incidence
5757 of preventable health conditions, such as heart disease, cancer,
5858 and diabetes and low birth weight in infants;
5959 (4) promote efficient and collaborative delivery of
6060 health care services;
6161 (5) serve as a model for the innovative use of health
6262 information technology to promote efficient delivery of health care
6363 services, reduce health care costs, and improve the health of the
6464 community; and
6565 (6) provide fair payment rates for health care
6666 providers.
6767 SECTION 4. This Act takes effect September 1, 2023.
