77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Subtitle C, Title 4, Special District Local Laws
99 Code, is amended by adding Chapter 3942 to read as follows:
1010 CHAPTER 3942. WEST LAKE RANCH MUNICIPAL MANAGEMENT DISTRICT
1111 SUBCHAPTER A. GENERAL PROVISIONS
1212 Sec. 3942.0101. DEFINITIONS. In this chapter:
1313 (1) "Board" means the district's board of directors.
1414 (2) "City" means the City of Corsicana.
1515 (3) "County" means Navarro County.
1616 (4) "Director" means a board member.
1717 (5) "District" means the West Lake Ranch Municipal
1818 Management District.
1919 Sec. 3942.0102. NATURE OF DISTRICT. The West Lake Ranch
2020 Municipal Management District is a special district created under
2121 Section 59, Article XVI, Texas Constitution.
2222 Sec. 3942.0103. PURPOSE; DECLARATION OF INTENT. (a) The
2323 creation of the district is essential to accomplish the purposes of
2424 Sections 52 and 52-a, Article III, and Section 59, Article XVI,
2525 Texas Constitution, and other public purposes stated in this
2626 chapter.
2727 (b) By creating the district and in authorizing the county,
2828 the city, and other political subdivisions to contract with the
2929 district, the legislature has established a program to accomplish
3030 the public purposes set out in Section 52-a, Article III, Texas
3131 Constitution.
3232 (c) The creation of the district is necessary to promote,
3333 develop, encourage, and maintain employment, commerce,
3434 transportation, housing, tourism, recreation, the arts,
3535 entertainment, economic development, safety, and the public
3636 welfare in the district.
3737 (d) This chapter and the creation of the district may not be
3838 interpreted to relieve the county or the city from providing the
3939 level of services provided as of the effective date of the Act
4040 enacting this chapter to the area in the district. The district is
4141 created to supplement and not to supplant county or city services
4242 provided in the district.
4343 Sec. 3942.0104. FINDINGS OF BENEFIT AND PUBLIC PURPOSE.
4444 (a) All land and other property included in the district will
4545 benefit from the improvements and services to be provided by the
4646 district under powers conferred by Sections 52 and 52-a, Article
4747 III, and Section 59, Article XVI, Texas Constitution, and other
4848 powers granted under this chapter.
4949 (b) The district is created to serve a public use and
5050 benefit.
5151 (c) The creation of the district is in the public interest
5252 and is essential to further the public purposes of:
5353 (1) developing and diversifying the economy of the
5454 state;
5555 (2) eliminating unemployment and underemployment; and
5656 (3) developing or expanding transportation and
5757 commerce.
5858 (d) The district will:
5959 (1) promote the health, safety, and general welfare of
6060 residents, employers, potential employees, employees, visitors,
6161 and consumers in the district, and of the public;
6262 (2) provide needed funding for the district to
6363 preserve, maintain, and enhance the economic health and vitality of
6464 the district territory as a community and business center;
6565 (3) promote the health, safety, welfare, and enjoyment
6666 of the public by providing pedestrian ways and by landscaping and
6767 developing certain areas in the district, which are necessary for
6868 the restoration, preservation, and enhancement of scenic beauty;
6969 and
7070 (4) provide for water, wastewater, drainage, road, and
7171 recreational facilities for the district.
7272 (e) Pedestrian ways along or across a street, whether at
7373 grade or above or below the surface, and street lighting, street
7474 landscaping, parking, and street art objects are parts of and
7575 necessary components of a street and are considered to be a street
7676 or road improvement.
7777 (f) The district will not act as the agent or
7878 instrumentality of any private interest even though the district
7979 will benefit many private interests as well as the public.
8080 Sec. 3942.0105. INITIAL DISTRICT TERRITORY. (a) The
8181 district is initially composed of the territory described by
8282 Section 2 of the Act enacting this chapter.
8383 (b) The boundaries and field notes contained in Section 2 of
8484 the Act enacting this chapter form a closure. A mistake in the
8585 field notes or in copying the field notes in the legislative process
8686 does not affect the district's:
8787 (1) organization, existence, or validity;
8888 (2) right to issue any type of bonds for the purposes
8989 for which the district is created or to pay the principal of and
9090 interest on the bonds;
9191 (3) right to impose or collect an assessment or tax; or
9292 (4) legality or operation.
9393 Sec. 3942.0106. ELIGIBILITY FOR INCLUSION IN SPECIAL ZONES.
9494 All or any part of the area of the district is eligible to be
9595 included in:
9696 (1) a tax increment reinvestment zone created under
9797 Chapter 311, Tax Code; or
9898 (2) a tax abatement reinvestment zone created under
9999 Chapter 312, Tax Code.
100100 Sec. 3942.0107. APPLICABILITY OF MUNICIPAL MANAGEMENT
101101 DISTRICTS LAW. Except as otherwise provided by this chapter,
102102 Chapter 375, Local Government Code, applies to the district.
103103 Sec. 3942.0108. CONSTRUCTION OF CHAPTER. This chapter
104104 shall be liberally construed in conformity with the findings and
105105 purposes stated in this chapter.
106106 SUBCHAPTER B. BOARD OF DIRECTORS
107107 Sec. 3942.0201. GOVERNING BODY; TERMS. (a) The district is
108108 governed by a board of five elected directors who serve staggered
109109 terms of four years.
110110 (b) Directors are elected in the manner provided by
111111 Subchapter D, Chapter 49, Water Code.
112112 Sec. 3942.0202. COMPENSATION; EXPENSES. (a) The district
113113 may compensate each director in an amount not to exceed $150 for
114114 each board meeting. The total amount of compensation for each
115115 director in one year may not exceed $7,200.
116116 (b) A director is entitled to reimbursement for necessary
117117 and reasonable expenses incurred in carrying out the duties and
118118 responsibilities of the board.
119119 Sec. 3942.0203. TEMPORARY DIRECTORS. (a) On or after the
120120 effective date of the Act creating this chapter, the owner or owners
121121 of a majority of the assessed value of the real property in the
122122 district according to the most recent certified tax appraisal roll
123123 for the county may submit a petition to the Texas Commission on
124124 Environmental Quality requesting that the commission appoint as
125125 temporary directors the five persons named in the petition. The
126126 commission shall appoint as temporary directors the five persons
127127 named in the petition.
128128 (b) The temporary or successor temporary directors shall
129129 hold an election to elect five permanent directors as provided by
130130 Section 49.102, Water Code.
131131 (c) Temporary directors serve until the earlier of:
132132 (1) the date permanent directors are elected under
133133 Subsection (b); or
134134 (2) the fourth anniversary of the effective date of
135135 the Act creating this chapter.
136136 (d) If permanent directors have not been elected under
137137 Subsection (b) and the terms of the temporary directors have
138138 expired, successor temporary directors shall be appointed or
139139 reappointed as provided by Subsection (e) to serve terms that
140140 expire on the earlier of:
141141 (1) the date permanent directors are elected under
142142 Subsection (b); or
143143 (2) the fourth anniversary of the date of the
144144 appointment or reappointment.
145145 (e) If Subsection (d) applies, the owner or owners of a
146146 majority of the assessed value of the real property in the district
147147 according to the most recent certified tax appraisal roll for the
148148 county may submit a petition to the Texas Commission on
149149 Environmental Quality requesting that the commission appoint as
150150 successor temporary directors the five persons named in the
151151 petition. The commission shall appoint as successor temporary
152152 directors the five persons named in the petition.
153153 SUBCHAPTER C. POWERS AND DUTIES
154154 Sec. 3942.0301. GENERAL POWERS AND DUTIES. The district
155155 has the powers and duties necessary to accomplish the purposes for
156156 which the district is created.
157157 Sec. 3942.0302. IMPROVEMENT PROJECTS AND SERVICES. (a) The
158158 district, using any money available to the district for the
159159 purpose, may provide, design, construct, acquire, improve,
160160 relocate, operate, maintain, or finance an improvement project or
161161 service authorized under this chapter or Chapter 375, Local
162162 Government Code.
163163 (b) The district may contract with a governmental or private
164164 entity to carry out an action under Subsection (a).
165165 (c) The implementation of a district project or service is a
166166 governmental function or service for the purposes of Chapter 791,
167167 Government Code.
168168 Sec. 3942.0303. LAW ENFORCEMENT SERVICES. To protect the
169169 public interest, the district may contract with a qualified party,
170170 including the county or the city, to provide law enforcement
171171 services in the district for a fee.
172172 Sec. 3942.0304. MEMBERSHIP IN CHARITABLE ORGANIZATIONS.
173173 The district may join and pay dues to a charitable or nonprofit
174174 organization that performs a service or provides an activity
175175 consistent with the furtherance of a district purpose.
176176 Sec. 3942.0305. ECONOMIC DEVELOPMENT PROGRAMS. (a) The
177177 district may engage in activities that accomplish the economic
178178 development purposes of the district.
179179 (b) The district may establish and provide for the
180180 administration of one or more programs to promote state or local
181181 economic development and to stimulate business and commercial
182182 activity in the district, including programs to:
183183 (1) make loans and grants of public money; and
184184 (2) provide district personnel and services.
185185 (c) The district may create economic development programs
186186 and exercise the economic development powers provided to
187187 municipalities by:
188188 (1) Chapter 380, Local Government Code; and
189189 (2) Subchapter A, Chapter 1509, Government Code.
190190 Sec. 3942.0306. PARKING FACILITIES. (a) The district may
191191 acquire, lease as lessor or lessee, construct, develop, own,
192192 operate, and maintain parking facilities or a system of parking
193193 facilities, including lots, garages, parking terminals, or other
194194 structures or accommodations for parking motor vehicles off the
195195 streets and related appurtenances.
196196 (b) The district's parking facilities serve the public
197197 purposes of the district and are owned, used, and held for a public
198198 purpose even if leased or operated by a private entity for a term of
199199 years.
200200 (c) The district's parking facilities are parts of and
201201 necessary components of a street and are considered to be a street
202202 or road improvement.
203203 (d) The development and operation of the district's parking
204204 facilities may be considered an economic development program.
205205 Sec. 3942.0307. ADDING OR EXCLUDING LAND. The district may
206206 add or exclude land in the manner provided by Subchapter J, Chapter
207207 49, Water Code, or by Subchapter H, Chapter 54, Water Code.
208208 Sec. 3942.0308. DISBURSEMENTS AND TRANSFERS OF MONEY. The
209209 board by resolution shall establish the number of directors'
210210 signatures and the procedure required for a disbursement or
211211 transfer of district money.
212212 Sec. 3942.0309. NO EMINENT DOMAIN POWER. The district may
213213 not exercise the power of eminent domain.
214214 SUBCHAPTER D. ASSESSMENTS
215215 Sec. 3942.0401. PETITION REQUIRED FOR FINANCING SERVICES
216216 AND IMPROVEMENTS WITH ASSESSMENTS. (a) The board may not finance a
217217 service or improvement project with assessments under this chapter
218218 unless a written petition requesting that service or improvement
219219 has been filed with the board.
220220 (b) A petition filed under Subsection (a) must be signed by
221221 the owners of a majority of the assessed value of real property in
222222 the district subject to assessment according to the most recent
223223 certified tax appraisal roll for the county.
224224 Sec. 3942.0402. ASSESSMENTS; LIENS FOR ASSESSMENTS. (a)
225225 The board by resolution may impose and collect an assessment for any
226226 purpose authorized by this chapter in all or any part of the
227227 district.
228228 (b) An assessment, a reassessment, or an assessment
229229 resulting from an addition to or correction of the assessment roll
230230 by the district, penalties and interest on an assessment or
231231 reassessment, an expense of collection, and reasonable attorney's
232232 fees incurred by the district:
233233 (1) are a first and prior lien against the property
234234 assessed;
235235 (2) are superior to any other lien or claim other than
236236 a lien or claim for county, school district, or municipal ad valorem
237237 taxes; and
238238 (3) are the personal liability of and a charge against
239239 the owners of the property even if the owners are not named in the
240240 assessment proceedings.
241241 (c) The lien is effective from the date of the board's
242242 resolution imposing the assessment until the date the assessment is
243243 paid. The board may enforce the lien in the same manner that the
244244 board may enforce an ad valorem tax lien against real property.
245245 (d) The board may make a correction to or deletion from the
246246 assessment roll that does not increase the amount of assessment of
247247 any parcel of land without providing notice and holding a hearing in
248248 the manner required for additional assessments.
249249 SUBCHAPTER E. TAXES AND BONDS
250250 Sec. 3942.0501. TAX ELECTION REQUIRED. (a) The district
251251 must hold an election in the manner provided by Chapter 49, Water
252252 Code, or, if applicable, Chapter 375, Local Government Code, to
253253 obtain voter approval before the district may impose an ad valorem
254254 tax.
255255 (b) Section 375.243, Local Government Code, does not apply
256256 to the district.
257257 Sec. 3942.0502. OPERATION AND MAINTENANCE TAX. (a) If
258258 authorized by a majority of the district voters voting at an
259259 election under Section 3942.0501, the district may impose an
260260 operation and maintenance tax on taxable property in the district
261261 in the manner provided by Section 49.107, Water Code, for any
262262 district purpose, including to:
263263 (1) maintain and operate the district;
264264 (2) construct or acquire improvements; or
265265 (3) provide a service.
266266 (b) The board shall determine the operation and maintenance
267267 tax rate. The rate may not exceed the rate approved at the
268268 election.
269269 Sec. 3942.0503. AUTHORITY TO BORROW MONEY AND TO ISSUE
270270 BONDS AND OTHER OBLIGATIONS. (a) The district may borrow money on
271271 terms determined by the board.
272272 (b) The district may issue bonds, notes, or other
273273 obligations payable wholly or partly from ad valorem taxes,
274274 assessments, impact fees, revenue, contract payments, grants, or
275275 other district money, or any combination of those sources of money,
276276 to pay for any authorized district purpose.
277277 Sec. 3942.0504. BONDS SECURED BY REVENUE OR CONTRACT
278278 PAYMENTS. The district may issue, without an election, bonds
279279 secured by:
280280 (1) revenue other than ad valorem taxes, including
281281 contract revenues; or
282282 (2) contract payments, provided that the requirements
283283 of Section 49.108, Water Code, have been met.
284284 Sec. 3942.0505. BONDS SECURED BY AD VALOREM TAXES;
285285 ELECTIONS. (a) If authorized at an election under Section
286286 3942.0501, the district may issue bonds payable from ad valorem
287287 taxes.
288288 (b) At the time the district issues bonds payable wholly or
289289 partly from ad valorem taxes, the board shall provide for the annual
290290 imposition of a continuing direct annual ad valorem tax, without
291291 limit as to rate or amount, for each year that all or part of the
292292 bonds are outstanding as required and in the manner provided by
293293 Sections 54.601 and 54.602, Water Code.
294294 (c) All or any part of any facilities or improvements that
295295 may be acquired by a district by the issuance of its bonds may be
296296 submitted as a single proposition or as several propositions to be
297297 voted on at the election.
298298 Sec. 3942.0506. CONSENT OF MUNICIPALITY REQUIRED. (a) The
299299 board may not issue bonds until each municipality in whose
300300 corporate limits or extraterritorial jurisdiction the district is
301301 located has consented by ordinance or resolution to the creation of
302302 the district and to the inclusion of land in the district as
303303 required by applicable law.
304304 (b) This section applies only to the district's first
305305 issuance of bonds payable from ad valorem taxes.
306306 SUBCHAPTER I. DISSOLUTION
307307 Sec. 3942.0901. DISSOLUTION. (a) The board shall dissolve
308308 the district on written petition filed with the board by the owners
309309 of:
310310 (1) at least two-thirds of the assessed value of the
311311 property subject to assessment by the district based on the most
312312 recent certified county property tax rolls; or
313313 (2) at least two-thirds of the surface area of the
314314 district, excluding roads, streets, highways, utility
315315 rights-of-way, other public areas, and other property exempt from
316316 assessment by the district according to the most recent certified
317317 county property tax rolls.
318318 (b) The board by majority vote may dissolve the district at
319319 any time.
320320 (c) The district may not be dissolved by its board under
321321 Subsection (a) or (b) if the district:
322322 (1) has any outstanding bonded indebtedness until that
323323 bonded indebtedness has been repaid or defeased in accordance with
324324 the order or resolution authorizing the issuance of the bonds;
325325 (2) has a contractual obligation to pay money until
326326 that obligation has been fully paid in accordance with the
327327 contract; or
328328 (3) owns, operates, or maintains public works,
329329 facilities, or improvements unless the district contracts with
330330 another person for the ownership, operation, or maintenance of the
331331 public works, facilities, or improvements.
332332 (d) Sections 375.261, 375.262, and 375.264, Local
333333 Government Code, do not apply to the district.
