---|
7 | 7 | | relating to analyzing and mitigating transportation security |
---|
8 | 8 | | threats in this state. |
---|
9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
---|
10 | 10 | | SECTION 1. DEFINITIONS. In this Act: |
---|
11 | 11 | | (1) "Commission" means the Public Safety Commission. |
---|
12 | 12 | | (2) "Department" means the Department of Public Safety |
---|
13 | 13 | | of the State of Texas. |
---|
14 | 14 | | (3) "Director" means the public safety director. |
---|
15 | 15 | | (4) "Division" means the Intelligence and |
---|
16 | 16 | | Counterterrorism division of the department. |
---|
17 | 17 | | SECTION 2. TRANSPORTATION SECURITY THREAT ANALYSIS. (a) |
---|
18 | 18 | | The division shall conduct an analysis of emerging and potential |
---|
19 | 19 | | future threats to transportation security in this state. The |
---|
20 | 20 | | analysis must include emerging and potential future threats posed |
---|
21 | 21 | | by the following: |
---|
22 | 22 | | (1) evolving tactics by terrorist organizations that |
---|
23 | 23 | | may pose a catastrophic risk to an aviation or surface |
---|
24 | 24 | | transportation entity; |
---|
25 | 25 | | (2) explosive devices or attacks involving the use of |
---|
26 | 26 | | explosives that may cause catastrophic damage to an aviation or |
---|
27 | 27 | | surface transportation system; |
---|
28 | 28 | | (3) the release of chemical or biological agents in |
---|
29 | 29 | | either aviation or surface transportation systems; |
---|
30 | 30 | | (4) cyberthreat actors seeking to undermine |
---|
31 | 31 | | confidence in transportation systems or cause service disruptions |
---|
32 | 32 | | that jeopardize transportation security; |
---|
33 | 33 | | (5) unmanned aerial systems with the capability of |
---|
34 | 34 | | inflicting harm on transportation targets; |
---|
35 | 35 | | (6) individuals or groups seeking to attack soft |
---|
36 | 36 | | targets, public areas, or crowded spaces of transportation systems, |
---|
37 | 37 | | including attacks against transportation security personnel; |
---|
38 | 38 | | (7) foreign actors seeking to exploit vulnerabilities |
---|
39 | 39 | | posed by inconsistent or inadequate security screening protocols at |
---|
40 | 40 | | last point of departure airports with direct flights to this state; |
---|
41 | 41 | | (8) information-sharing challenges within state |
---|
42 | 42 | | government and between state government and private and |
---|
43 | 43 | | governmental entities; and |
---|
44 | 44 | | (9) growth in passenger volume in both the aviation |
---|
45 | 45 | | and surface transportation sectors in this state. |
---|
46 | 46 | | (b) In conducting the analysis required under Subsection |
---|
47 | 47 | | (a) of this section, the division shall engage transportation |
---|
48 | 48 | | stakeholders and account for security concerns of transportation |
---|
49 | 49 | | operators by: |
---|
50 | 50 | | (1) convening at least three industry day events for |
---|
51 | 51 | | transportation stakeholders to hear from relevant public and |
---|
52 | 52 | | private sector security partners and provide feedback on emerging |
---|
53 | 53 | | threats identified by the transportation stakeholders; |
---|
54 | 54 | | (2) developing strategies to solicit feedback on a |
---|
55 | 55 | | consistent basis from transportation stakeholders across all modes |
---|
56 | 56 | | of transportation and providing consistent responses to |
---|
57 | 57 | | stakeholder concerns; |
---|
58 | 58 | | (3) improving the quality, timeliness, and relevancy |
---|
59 | 59 | | of information-sharing products disseminated by the division to |
---|
60 | 60 | | transportation stakeholders, including classified |
---|
61 | 61 | | information-sharing products; |
---|
62 | 62 | | (4) coordinating security incident response and |
---|
63 | 63 | | communications drills, including tabletop exercises, to improve |
---|
64 | 64 | | incident preparedness and response capabilities across |
---|
65 | 65 | | transportation modes and among transportation systems; |
---|
66 | 66 | | (5) encouraging regular communication between |
---|
67 | 67 | | governmental entities responsible for transportation security and |
---|
68 | 68 | | transportation stakeholders; and |
---|
69 | 69 | | (6) establishing regular opportunities for senior |
---|
70 | 70 | | department leadership to engage with transportation stakeholders |
---|
71 | 71 | | regarding changes in the threat environment and ways the department |
---|
72 | 72 | | can offer security support to address those changes. |
---|
73 | 73 | | (c) Not later than June 1, 2024, the division shall submit |
---|
74 | 74 | | the analysis required under Subsection (a) of this section to the |
---|
75 | 75 | | commission and director. |
---|
76 | 76 | | SECTION 3. MITIGATION. Not later than October 1, 2024, the |
---|
77 | 77 | | director shall: |
---|
78 | 78 | | (1) develop, as appropriate, a threat mitigation |
---|
79 | 79 | | strategy for each of the threats examined in the analysis; and |
---|
80 | 80 | | (2) assign appropriate department resources to |
---|
81 | 81 | | address those threats based on the calculated risk or provide |
---|
82 | 82 | | recommendations to the appropriate governmental entity responsible |
---|
83 | 83 | | for addressing those threats. |
---|
84 | 84 | | SECTION 4. REPORT TO THE LEGISLATURE. Not later than |
---|
85 | 85 | | December 1, 2024, the director shall provide a written report to |
---|
86 | 86 | | each legislative standing committee with primary jurisdiction over |
---|
87 | 87 | | transportation on the results of the analysis required under |
---|
88 | 88 | | Section 2 of this Act and relevant mitigation strategies developed |
---|
89 | 89 | | in accordance with Section 3 of this Act. |
---|
90 | 90 | | SECTION 5. EXPIRATION. This Act expires December 31, 2024. |
---|
91 | 91 | | SECTION 6. EFFECTIVE DATE. This Act takes effect September |
---|
92 | 92 | | 1, 2023. |
