55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to analyzing and mitigating transportation security
88 threats in this state.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. DEFINITIONS. In this Act:
1111 (1) "Commission" means the Public Safety Commission.
1212 (2) "Department" means the Department of Public Safety
1313 of the State of Texas.
1414 (3) "Director" means the public safety director.
1515 (4) "Division" means the Intelligence and
1616 Counterterrorism division of the department.
1717 SECTION 2. TRANSPORTATION SECURITY THREAT ANALYSIS. (a)
1818 The division shall conduct an analysis of emerging and potential
1919 future threats to transportation security in this state. The
2020 analysis must include emerging and potential future threats posed
2121 by the following:
2222 (1) evolving tactics by terrorist organizations that
2323 may pose a catastrophic risk to an aviation or surface
2424 transportation entity;
2525 (2) explosive devices or attacks involving the use of
2626 explosives that may cause catastrophic damage to an aviation or
2727 surface transportation system;
2828 (3) the release of chemical or biological agents in
2929 either aviation or surface transportation systems;
3030 (4) cyberthreat actors seeking to undermine
3131 confidence in transportation systems or cause service disruptions
3232 that jeopardize transportation security;
3333 (5) unmanned aerial systems with the capability of
3434 inflicting harm on transportation targets;
3535 (6) individuals or groups seeking to attack soft
3636 targets, public areas, or crowded spaces of transportation systems,
3737 including attacks against transportation security personnel;
3838 (7) foreign actors seeking to exploit vulnerabilities
3939 posed by inconsistent or inadequate security screening protocols at
4040 last point of departure airports with direct flights to this state;
4141 (8) information-sharing challenges within state
4242 government and between state government and private and
4343 governmental entities; and
4444 (9) growth in passenger volume in both the aviation
4545 and surface transportation sectors in this state.
4646 (b) In conducting the analysis required under Subsection
4747 (a) of this section, the division shall engage transportation
4848 stakeholders and account for security concerns of transportation
4949 operators by:
5050 (1) convening at least three industry day events for
5151 transportation stakeholders to hear from relevant public and
5252 private sector security partners and provide feedback on emerging
5353 threats identified by the transportation stakeholders;
5454 (2) developing strategies to solicit feedback on a
5555 consistent basis from transportation stakeholders across all modes
5656 of transportation and providing consistent responses to
5757 stakeholder concerns;
5858 (3) improving the quality, timeliness, and relevancy
5959 of information-sharing products disseminated by the division to
6060 transportation stakeholders, including classified
6161 information-sharing products;
6262 (4) coordinating security incident response and
6363 communications drills, including tabletop exercises, to improve
6464 incident preparedness and response capabilities across
6565 transportation modes and among transportation systems;
6666 (5) encouraging regular communication between
6767 governmental entities responsible for transportation security and
6868 transportation stakeholders; and
6969 (6) establishing regular opportunities for senior
7070 department leadership to engage with transportation stakeholders
7171 regarding changes in the threat environment and ways the department
7272 can offer security support to address those changes.
7373 (c) Not later than June 1, 2024, the division shall submit
7474 the analysis required under Subsection (a) of this section to the
7575 commission and director.
7676 SECTION 3. MITIGATION. Not later than October 1, 2024, the
7777 director shall:
7878 (1) develop, as appropriate, a threat mitigation
7979 strategy for each of the threats examined in the analysis; and
8080 (2) assign appropriate department resources to
8181 address those threats based on the calculated risk or provide
8282 recommendations to the appropriate governmental entity responsible
8383 for addressing those threats.
8484 SECTION 4. REPORT TO THE LEGISLATURE. Not later than
8585 December 1, 2024, the director shall provide a written report to
8686 each legislative standing committee with primary jurisdiction over
8787 transportation on the results of the analysis required under
8888 Section 2 of this Act and relevant mitigation strategies developed
8989 in accordance with Section 3 of this Act.
9090 SECTION 5. EXPIRATION. This Act expires December 31, 2024.
9191 SECTION 6. EFFECTIVE DATE. This Act takes effect September
9292 1, 2023.
