55 relating to the liability of a business owner or operator arising
66 from the exposure of an individual to a pandemic disease.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 148.003, Civil Practice and Remedies
99 Code, is amended by adding Subsection (k) to read as follows:
1010 (k) Notwithstanding any other provision of this section, a
1111 business owner or operator that does not require employees or
1212 contractors of the business to be vaccinated against a pandemic
1313 disease is not liable for injury or death caused by the exposure of
1414 an individual to the pandemic disease through an employee or
1515 contractor of the business.
1616 SECTION 2. Section 148.003(k), Civil Practice and Remedies
1717 Code, as added by this Act, applies only to a cause of action that
1818 accrues on or after the effective date of this Act.
1919 SECTION 3. This Act takes effect immediately if it receives
2020 a vote of two-thirds of all the members elected to each house, as
2121 provided by Section 39, Article III, Texas Constitution. If this
2222 Act does not receive the vote necessary for immediate effect, this
2323 Act takes effect September 1, 2023.
