44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to the applicability to election judges of a prohibition
77 on the carrying of a concealed handgun at a polling place.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 46.15, Penal Code, is amended by adding
1010 Subsection (s) to read as follows:
1111 (s) Section 46.03(a)(2) does not apply to a person who
1212 carries a concealed handgun if the person:
1313 (1) is licensed to carry a handgun under Subchapter H,
1414 Chapter 411, Government Code; and
1515 (2) is engaged in the performance of the person's
1616 duties as:
1717 (A) an election judge under Chapter 32, Election
1818 Code; or
1919 (B) an early voting clerk or a deputy early
2020 voting clerk who is serving as an election judge at an early voting
2121 polling place under Chapter 83 or 85, Election Code.
2222 SECTION 2. The change in law made by this Act applies only
2323 to an offense committed on or after the effective date of this Act.
2424 An offense committed before the effective date of this Act is
2525 governed by the law in effect on the date the offense was committed,
2626 and the former law is continued in effect for that purpose. For
2727 purposes of this section, an offense was committed before the
2828 effective date of this Act if any element of the offense was
2929 committed before that date.
3030 SECTION 3. This Act takes effect September 1, 2023.
