7 | 7 | | relating to the authority of certain municipalities to change the |

8 | 8 | | date of the general election for officers. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Section 41.0052, Election Code, is amended by |
---|
11 | 11 | | adding Subsection (a-1) and amending Subsection (c) to read as |
---|
12 | 12 | | follows: |
---|
13 | 13 | | (a-1) The governing body of a city that is intersected by |
---|
14 | 14 | | State Highway 195 and Interstate Highway 14 and that holds its |
---|
15 | 15 | | general election for officers on a uniform election date in May may, |
---|
16 | 16 | | not later than December 31, 2024, change the date on which it holds |
---|
17 | 17 | | its general election for officers to the uniform election date in |
---|
18 | 18 | | November. This subsection expires January 1, 2025. |
---|
19 | 19 | | (c) A home-rule city may implement a [the] change authorized |
---|
20 | 20 | | by this section [Subsection (a)] or provide for the election of all |
---|
21 | 21 | | members of the governing body at the same election through the |
---|
22 | 22 | | adoption of a resolution. The change contained in the resolution |
---|
23 | 23 | | supersedes a city charter provision that requires a different |
---|
24 | 24 | | general election date or that requires the terms of members of the |
---|
25 | 25 | | governing body to be staggered. |
---|
26 | 26 | | SECTION 2. This Act takes effect September 1, 2023. |
