55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the authority of certain municipalities to change the
88 date of the general election for officers.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 41.0052, Election Code, is amended by
1111 adding Subsection (a-1) and amending Subsection (c) to read as
1212 follows:
1313 (a-1) The governing body of a city that is intersected by
1414 State Highway 195 and Interstate Highway 14 and that holds its
1515 general election for officers on a uniform election date in May may,
1616 not later than December 31, 2024, change the date on which it holds
1717 its general election for officers to the uniform election date in
1818 November. This subsection expires January 1, 2025.
1919 (c) A home-rule city may implement a [the] change authorized
2020 by this section [Subsection (a)] or provide for the election of all
2121 members of the governing body at the same election through the
2222 adoption of a resolution. The change contained in the resolution
2323 supersedes a city charter provision that requires a different
2424 general election date or that requires the terms of members of the
2525 governing body to be staggered.
2626 SECTION 2. This Act takes effect September 1, 2023.
