9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Subchapter C, Chapter 302, Labor Code, is |
---|
11 | 11 | | amended by adding Section 302.0465 to read as follows: |
---|
12 | 12 | | Sec. 302.0465. DIRECT FUNDING APPLICATION. (a) The |
---|
13 | 13 | | commission shall adopt a plan to allow nonprofit service providers |
---|
14 | 14 | | to apply for funding directly from the commission if the local |
---|
15 | 15 | | workforce development board is nonresponsive. A local workforce |
---|
16 | 16 | | development board is considered nonresponsive if, as determined by |
---|
17 | 17 | | the commission, the board: |
---|
18 | 18 | | (1) is not fulfilling the board's statutory |
---|
19 | 19 | | requirements; and |
---|
20 | 20 | | (2) has not met at least 80 percent of the performance |
---|
21 | 21 | | standards established under this chapter and other applicable |
---|
22 | 22 | | federal and state law for two consecutive program years. |
---|
23 | 23 | | (b) The plan adopted under this section may include an |
---|
24 | 24 | | application for funding for: |
---|
25 | 25 | | (1) job training programs funded under the Workforce |
---|
26 | 26 | | Innovation and Opportunity Act (29 U.S.C. Section 3101 et seq.); |
---|
27 | 27 | | (2) postsecondary vocational and technical job |
---|
28 | 28 | | training programs that are not part of approved courses or programs |
---|
29 | 29 | | that lead to licensing, certification, or an associate degree under |
---|
30 | 30 | | Chapter 61, 130, or 135, Education Code, or Subchapter E, Chapter |
---|
31 | 31 | | 88, Education Code; |
---|
32 | 32 | | (3) adult education programs under Chapter 315; |
---|
33 | 33 | | (4) employment services programs; |
---|
34 | 34 | | (5) support services provided for recipients of |
---|
35 | 35 | | financial assistance under Chapter 31, Human Resources Code; and |
---|
36 | 36 | | (6) employment and training programs for recipients of |
---|
37 | 37 | | supplemental nutrition assistance under Chapter 33, Human |
---|
38 | 38 | | Resources Code. |
---|
39 | 39 | | SECTION 2. As soon as practicable after the effective date |
---|
40 | 40 | | of this Act, the Texas Workforce Commission shall adopt the rules |
---|
41 | 41 | | necessary to implement Section 302.0465, Labor Code, as added by |
---|
42 | 42 | | this Act. |
---|
43 | 43 | | SECTION 3. This Act takes effect September 1, 2023. |
