66 relating to the authority of certain counties to regulate noise
77 levels in residential areas; creating a criminal offense.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Chapter 240, Local Government Code, is amended
1010 by adding Subchapter D to read as follows:
1111 SUBCHAPTER D. REGULATION OF NOISE LEVELS IN CERTAIN COUNTIES
1212 Sec. 240.061. AUTHORITY TO REGULATE. (a) To promote public
1313 health, safety, and welfare, the commissioners court of a county
1414 with a population of more than 3.3 million by order may regulate the
1515 level of noise emanating from a residence located in a residential
1616 area in the unincorporated area of the county.
1717 (b) This section does not authorize the commissioners court
1818 of a county to regulate the use of fireworks.
1919 Sec. 240.062. CRIMINAL PENALTY. (a) A person commits an
2020 offense if the person on three or more occasions violates an order
2121 adopted under this subchapter.
2222 (b) An offense under this section is a Class C misdemeanor.
2323 SECTION 2. This Act takes effect September 1, 2023.
