8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 9 | | SECTION 1. Chapter 240, Local Government Code, is amended |
---|
10 | 10 | | by adding Subchapter D to read as follows: |

11 | 11 | | SUBCHAPTER D. REGULATION OF NOISE LEVELS IN CERTAIN COUNTIES |

12 | 12 | | Sec. 240.061. AUTHORITY TO REGULATE. (a) To promote public |
---|
13 | 13 | | health, safety, and welfare, the commissioners court of a county |
---|
14 | 14 | | with a population of more than 3.3 million by order may regulate the |
---|
15 | 15 | | level of noise emanating from a residence located in a residential |
---|
16 | 16 | | area in the unincorporated area of the county. |
---|
17 | 17 | | (b) This section does not authorize the commissioners court |
---|
18 | 18 | | of a county to regulate the use of fireworks. |
---|
19 | 19 | | Sec. 240.062. CRIMINAL PENALTY. (a) A person commits an |
---|
20 | 20 | | offense if the person on three or more occasions violates an order |
---|
21 | 21 | | adopted under this subchapter. |
---|
22 | 22 | | (b) An offense under this section is a Class C misdemeanor. |
---|
23 | 23 | | SECTION 2. This Act takes effect September 1, 2023. |
