66 AN ACT
77 relating to the use of medication designated for treatment of
88 respiratory distress on public and private school campuses.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. The heading to Subchapter E, Chapter 38,
1111 Education Code, is amended to read as follows:
1212 SUBCHAPTER E. MAINTENANCE AND ADMINISTRATION OF EPINEPHRINE
1313 AUTO-INJECTORS AND MEDICATION FOR RESPIRATORY DISTRESS [ASTHMA
1414 MEDICINE]
1515 SECTION 2. Section 38.201, Education Code, is amended by
1616 adding Subdivision (3-a) to read as follows:
1717 (3-a) "Medication for respiratory distress" means
1818 albuterol, levalbuterol, or another medication designated by the
1919 executive commissioner of the Health and Human Services Commission
2020 for treatment of respiratory distress under Section 38.208(c).
2121 SECTION 3. Section 38.202(a), Education Code, is amended to
2222 read as follows:
2323 (a) The commissioner of state health services shall
2424 establish an advisory committee to examine and review the
2525 administration, on a campus of a school district, an
2626 open-enrollment charter school, a private school, or an institution
2727 of higher education, of:
2828 (1) epinephrine auto-injectors to a person
2929 experiencing an anaphylactic reaction; and
3030 (2) medication for respiratory distress to a person
3131 experiencing respiratory distress [on a campus of a school
3232 district, an open-enrollment charter school, a private school, or
3333 an institution of higher education].
3434 SECTION 4. Section 38.207, Education Code, is amended to
3535 read as follows:
3636 Sec. 38.207. ADVISORY COMMITTEE: DUTIES. The advisory
3737 committee shall advise the commissioner of state health services
3838 on:
3939 (1) the storage and maintenance of epinephrine
4040 auto-injectors and medication for respiratory distress on school
4141 campuses and campuses of institutions of higher education;
4242 (2) the training of school personnel and school
4343 volunteers, and of personnel and volunteers at institutions of
4444 higher education, in the administration of an epinephrine
4545 auto-injector;
4646 (2-a) the training of school personnel and school
4747 volunteers, and of personnel and volunteers at institutions of
4848 higher education, in the administration of a medication for
4949 respiratory distress; and
5050 (3) a plan for:
5151 (A) one or more school personnel members or
5252 school volunteers trained in the administration of an epinephrine
5353 auto-injector to be on each school campus; [and]
5454 (B) one or more school personnel members or
5555 school volunteers trained in the administration of medication for
5656 respiratory distress to be on each school campus;
5757 (C) one or more personnel members or volunteers
5858 of an institution of higher education trained in the administration
5959 of an epinephrine auto-injector to be on each campus of an
6060 institution of higher education; and
6161 (D) one or more personnel members or volunteers
6262 of an institution of higher education trained in the administration
6363 of medication for respiratory distress to be on each campus of an
6464 institution of higher education.
6565 SECTION 5. The heading to Section 38.208, Education Code,
6666 is amended to read as follows:
6767 Sec. 38.208. MAINTENANCE AND ADMINISTRATION OF EPINEPHRINE
6868 AUTO-INJECTORS AND MEDICATION FOR RESPIRATORY DISTRESS [ASTHMA
6969 MEDICINE].
7070 SECTION 6. Section 38.208, Education Code, is amended by
7171 amending Subsections (a-1), (b-1), (c), (e), and (f) and adding
7272 Subsections (b-2), (b-3), (d-1), and (e-1) to read as follows:
7373 (a-1) Each school district, open-enrollment charter school,
7474 and private school may adopt and implement a policy regarding the
7575 maintenance, administration, and disposal of medication for
7676 respiratory distress [authorizing a school nurse to maintain and
7777 administer asthma medicine] at each campus in the district or
7878 school.
7979 (b-1) If a policy is adopted under Subsection (a-1), the
8080 policy must provide that school personnel and school volunteers who
8181 are authorized and trained [the school nurse] may administer
8282 medication for respiratory distress [prescription asthma medicine]
8383 to a person reasonably believed to be experiencing respiratory
8484 distress on [student only if the school nurse has written
8585 notification from a parent or guardian of the student that the
8686 student has been diagnosed as having asthma and stating that the
8787 school nurse may administer prescription asthma medicine to the
8888 student. A school nurse may administer the prescription asthma
8989 medicine only at] a school campus, or at a school-sponsored or
9090 school-related activity on or off school property.
9191 (b-2) If medication for respiratory distress is
9292 administered to a student whose parent or guardian has not provided
9393 notification to the school that the student has been diagnosed with
9494 asthma, the school must refer the student to the student's primary
9595 care provider on the day the medication for respiratory distress is
9696 administered and inform the student's parent or guardian regarding
9797 the referral. The referral must include:
9898 (1) the symptoms of respiratory distress observed;
9999 (2) the name of the medication for respiratory
100100 distress administered to the student; and
101101 (3) any patient care instructions given to the
102102 student.
103103 (b-3) If a student who has received medication for
104104 respiratory distress does not have a primary care provider or the
105105 parent or guardian of the student has not engaged a primary care
106106 provider for the student, the student's parent or guardian must
107107 receive information to assist the parent or guardian in selecting a
108108 primary care provider for the student.
109109 (c) The executive commissioner of the Health and Human
110110 Services Commission, in consultation with the commissioner of
111111 education, and with advice from the advisory committee as
112112 appropriate, shall adopt rules regarding the maintenance,
113113 administration, and disposal of an epinephrine auto-injector at a
114114 school campus subject to a policy adopted under Subsection (a) and
115115 the maintenance, [and] administration, and disposal of medication
116116 for respiratory distress [asthma medicine] at a school campus
117117 subject to a policy adopted under Subsection (a-1). The rules must
118118 establish:
119119 (1) the number of epinephrine auto-injectors
120120 available at each campus;
121121 (2) the amount of medication for respiratory distress
122122 [prescription asthma medicine] available at each campus;
123123 (3) the process for each school district,
124124 open-enrollment charter school, and private school to check the
125125 inventory of epinephrine auto-injectors and medication for
126126 respiratory distress [asthma medicine] at regular intervals for
127127 expiration and replacement; [and]
128128 (4) the amount of training required for school
129129 personnel and school volunteers to administer:
130130 (A) an epinephrine auto-injector; or
131131 (B) medication for respiratory distress; and
132132 (5) the types of medication that may be administered
133133 under Subsection (b-1) to persons experiencing respiratory
134134 distress, based on a review of the best available medical evidence.
135135 (d-1) Each school district, open-enrollment charter school,
136136 and private school that adopts a policy under Subsection (a-1) must
137137 require that each campus have one or more school personnel or school
138138 volunteers authorized and trained to administer medication for
139139 respiratory distress present during regular school hours.
140140 (e) The supply of epinephrine auto-injectors at each campus
141141 must be stored in a secure location and be easily accessible to
142142 school personnel and school volunteers authorized and trained to
143143 administer an epinephrine auto-injector. [The supply of asthma
144144 medicine at each campus must be stored in a secure location and be
145145 easily accessible to the school nurse.]
146146 (e-1) The supply of medication for respiratory distress at
147147 each campus must be stored in a secure location and be easily
148148 accessible to authorized school personnel and school volunteers.
149149 (f) The policy described by Subsection (a-1) may not require
150150 a school district, open-enrollment charter school, or private
151151 school to purchase medication for respiratory distress
152152 [prescription asthma medicine] or require any other expenditure
153153 related to the maintenance or administration of medication for
154154 respiratory distress [asthma medicine] that would result in a
155155 negative fiscal impact on the district or school.
156156 SECTION 7. Subchapter E, Chapter 38, Education Code, is
157157 amended by adding Section 38.2091 to read as follows:
158158 Sec. 38.2091. REPORT ON ADMINISTERING MEDICATION FOR
159159 RESPIRATORY DISTRESS. (a) Not later than the 10th business day
160160 after the date a school personnel member or school volunteer
161161 administers medication for respiratory distress to a person
162162 experiencing respiratory distress in accordance with a policy
163163 adopted under Section 38.208(a-1), the school shall report the
164164 information required under Subsection (b) to:
165165 (1) the school district, the charter holder if the
166166 school is an open-enrollment charter school, or the governing body
167167 of the school if the school is a private school;
168168 (2) the physician or other person who prescribed the
169169 medication for respiratory distress; and
170170 (3) the commissioner of state health services.
171171 (b) The report required under this section must include:
172172 (1) the age of the person who received the
173173 administration of the medication for respiratory distress;
174174 (2) whether the person who received the administration
175175 of the medication for respiratory distress was a student, a school
176176 personnel member or school volunteer, or a visitor;
177177 (3) the dosage of the medication for respiratory
178178 distress administered;
179179 (4) the title of the person who administered the
180180 medication for respiratory distress; and
181181 (5) any other information required by the commissioner
182182 of education.
183183 SECTION 8. Section 38.210, Education Code, is amended by
184184 amending Subsections (a) and (b) and adding Subsection (a-1) to
185185 read as follows:
186186 (a) Each school district, open-enrollment charter school,
187187 and private school that adopts a policy under Section 38.208(a) is
188188 responsible for training school personnel and school volunteers in
189189 the administration of an epinephrine auto-injector. The training
190190 must include information on:
191191 (1) recognizing the signs and symptoms of anaphylaxis;
192192 (2) administering an epinephrine auto-injector;
193193 (3) implementing emergency procedures, if necessary,
194194 after administering an epinephrine auto-injector; and
195195 (4) properly disposing of used or expired epinephrine
196196 auto-injectors.
197197 (a-1) Each school district, open-enrollment charter school,
198198 and private school that adopts a policy under Section 38.208(a-1)
199199 is responsible for training school personnel and school volunteers
200200 in the administration of medication for respiratory distress. The
201201 training must include information on:
202202 (1) recognizing the signs and symptoms of respiratory
203203 distress;
204204 (2) administering medication for respiratory
205205 distress;
206206 (3) implementing emergency procedures, if necessary,
207207 after administering medication for respiratory distress; and
208208 (4) proper sanitization, reuse, and disposal of
209209 medication for respiratory distress.
210210 (b) Training required under this section must be provided:
211211 (1) [include information on:
212212 [(A) recognizing the signs and symptoms of
213213 anaphylaxis;
214214 [(B) administering an epinephrine auto-injector;
215215 [(C) implementing emergency procedures, if
216216 necessary, after administering an epinephrine auto-injector; and
217217 [(D) properly disposing of used or expired
218218 epinephrine auto-injectors;
219219 [(2) be provided] in a formal training session or
220220 through online education; and
221221 (2) [(3) be provided] in accordance with the policy
222222 adopted under Section 21.4515.
223223 SECTION 9. The heading to Section 38.211, Education Code,
224224 is amended to read as follows:
225225 Sec. 38.211. PRESCRIPTION OF EPINEPHRINE AUTO-INJECTORS
226226 AND MEDICATION FOR RESPIRATORY DISTRESS [ASTHMA MEDICINE].
227227 SECTION 10. Sections 38.211(a), (b), (c), (e), and (f),
228228 Education Code, are amended to read as follows:
229229 (a) A physician or person who has been delegated
230230 prescriptive authority under Chapter 157, Occupations Code, may
231231 prescribe epinephrine auto-injectors or medication for respiratory
232232 distress [asthma medicine] in the name of a school district,
233233 open-enrollment charter school, or private school.
234234 (b) A physician or other person who prescribes epinephrine
235235 auto-injectors or medication for respiratory distress [asthma
236236 medicine] under Subsection (a) shall provide the school district,
237237 open-enrollment charter school, or private school with a standing
238238 order for the administration of, as applicable:
239239 (1) an epinephrine auto-injector to a person
240240 reasonably believed to be experiencing anaphylaxis; or
241241 (2) medication for respiratory distress [asthma
242242 medicine] to a person reasonably believed to be experiencing
243243 respiratory distress [a symptom of asthma and who has provided
244244 written notification and permission as required by Section
245245 38.208(b-1)].
246246 (c) The standing order under Subsection (b) is not required
247247 to be patient-specific, and the epinephrine auto-injector or
248248 medication for respiratory distress [asthma medicine] may be
249249 administered to a person without a previously established
250250 physician-patient relationship.
251251 (e) An order issued under this section must contain:
252252 (1) the name and signature of the prescribing
253253 physician or other person;
254254 (2) the name of the school district, open-enrollment
255255 charter school, or private school to which the order is issued;
256256 (3) as applicable, the quantity of epinephrine
257257 auto-injectors or the quantity and types of medications for
258258 respiratory distress [asthma medicine] to be obtained and
259259 maintained under the order; and
260260 (4) the date of issue.
261261 (f) A pharmacist may dispense an epinephrine auto-injector
262262 or medication for respiratory distress [asthma medicine] to a
263263 school district, open-enrollment charter school, or private school
264264 without requiring the name or any other identifying information
265265 relating to the user.
266266 SECTION 11. Section 38.215(a), Education Code, is amended
267267 to read as follows:
268268 (a) A person who in good faith takes, or fails to take, any
269269 action under this subchapter is immune from civil or criminal
270270 liability or disciplinary action resulting from that action or
271271 failure to act, including:
272272 (1) issuing an order for epinephrine auto-injectors or
273273 medication for respiratory distress [asthma medicine];
274274 (2) supervising or delegating the administration of an
275275 epinephrine auto-injector or medication for respiratory distress
276276 [asthma medicine];
277277 (3) possessing, maintaining, storing, or disposing of
278278 an epinephrine auto-injector or medication for respiratory
279279 distress [asthma medicine];
280280 (4) prescribing an epinephrine auto-injector or
281281 medication for respiratory distress [asthma medicine];
282282 (5) dispensing:
283283 (A) an epinephrine auto-injector; or
284284 (B) medication for respiratory distress [asthma
285285 medicine, provided that permission has been granted as provided by
286286 Section 38.208(b-1)];
287287 (6) administering, or assisting in administering, an
288288 epinephrine auto-injector or medication for respiratory distress
289289 [asthma medicine, provided that permission has been granted as
290290 provided by Section 38.208(b-1)];
291291 (7) providing, or assisting in providing, training,
292292 consultation, or advice in the development, adoption, or
293293 implementation of policies, guidelines, rules, or plans; or
294294 (8) undertaking any other act permitted or required
295295 under this subchapter.
296296 SECTION 12. This Act takes effect immediately if it
297297 receives a vote of two-thirds of all the members elected to each
298298 house, as provided by Section 39, Article III, Texas Constitution.
299299 If this Act does not receive the vote necessary for immediate
300300 effect, this Act takes effect September 1, 2023.
