55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the use of deadly force to make an arrest.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Sections 9.51(c) and (d), Penal Code, are
1010 amended to read as follows:
1111 (c) A peace officer is justified in using deadly force
1212 against another when and to the degree the peace officer reasonably
1313 believes the deadly force is immediately necessary to make an
1414 arrest, or to prevent escape after arrest, if:
1515 (1) the use of force would have been justified under
1616 Subsection (a);
1717 (2) the person to be arrested or attempting to escape
1818 after arrest possesses a deadly weapon; and
1919 (3) [:
2020 [(1)] the peace officer [actor] reasonably believes:
2121 (A) the conduct for which arrest is authorized
2222 included the use or attempted use of deadly force; or
2323 (B) [(2) the actor reasonably believes] there is
2424 a substantial risk that the person to be arrested or attempting to
2525 escape after arrest will cause death or serious bodily injury to the
2626 actor or another if the arrest or apprehension is delayed.
2727 (d) A person who is not [other than] a peace officer but is
2828 acting in a peace officer's presence and at the officer's [his]
2929 direction is justified in using deadly force against another when
3030 and to the degree the person reasonably believes the deadly force is
3131 immediately necessary to make a lawful arrest, or to prevent escape
3232 after a lawful arrest, if:
3333 (1) the use of force would have been justified under
3434 Subsection (b);
3535 (2) the person to be arrested or attempting to escape
3636 after arrest possesses a deadly weapon; and
3737 (3) [:
3838 [(1)] the actor reasonably believes:
3939 (A) the felony or offense against the public
4040 peace for which arrest is authorized included the use or attempted
4141 use of deadly force; or
4242 (B) [(2) the actor reasonably believes] there
4343 is a substantial risk that the person to be arrested or attempting
4444 to escape after arrest will cause death or serious bodily injury to
4545 another if the arrest or apprehension is delayed.
4646 SECTION 2. The change in law made by this Act applies only
4747 to an offense committed on or after the effective date of this Act.
4848 An offense committed before the effective date of this Act is
4949 governed by the law in effect on the date the offense was committed,
5050 and the former law is continued in effect for that purpose. For
5151 purposes of this section, an offense was committed before the
5252 effective date of this Act if any element of the offense occurred
5353 before that date.
5454 SECTION 3. This Act takes effect September 1, 2023.
