77 AN ACT
88 relating to the confidentiality of certain home address information
99 in ad valorem tax appraisal records.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 25.025(a), Tax Code, is amended to read
1212 as follows:
1313 (a) This section applies only to:
1414 (1) a current or former peace officer as defined by
1515 Article 2.12, Code of Criminal Procedure, and the spouse or
1616 surviving spouse of the peace officer;
1717 (2) the adult child of a current peace officer as
1818 defined by Article 2.12, Code of Criminal Procedure;
1919 (3) a current or honorably retired county jailer as
2020 defined by Section 1701.001, Occupations Code;
2121 (4) an employee of the Texas Department of Criminal
2222 Justice;
2323 (5) a commissioned security officer as defined by
2424 Section 1702.002, Occupations Code;
2525 (6) an individual who shows that the individual, the
2626 individual's child, or another person in the individual's household
2727 is a victim of family violence as defined by Section 71.004, Family
2828 Code, by providing:
2929 (A) a copy of a protective order issued under
3030 Chapter 85, Family Code, or a magistrate's order for emergency
3131 protection issued under Article 17.292, Code of Criminal Procedure;
3232 or
3333 (B) other independent documentary evidence
3434 necessary to show that the individual, the individual's child, or
3535 another person in the individual's household is a victim of family
3636 violence;
3737 (7) an individual who shows that the individual, the
3838 individual's child, or another person in the individual's household
3939 is a victim of sexual assault or abuse, stalking, or trafficking of
4040 persons by providing:
4141 (A) a copy of a protective order issued under
4242 Subchapter A or B, Chapter 7B, Code of Criminal Procedure, or a
4343 magistrate's order for emergency protection issued under Article
4444 17.292, Code of Criminal Procedure; or
4545 (B) other independent documentary evidence
4646 necessary to show that the individual, the individual's child, or
4747 another person in the individual's household is a victim of sexual
4848 assault or abuse, stalking, or trafficking of persons;
4949 (8) a participant in the address confidentiality
5050 program administered by the attorney general under Subchapter B,
5151 Chapter 58, Code of Criminal Procedure, who provides proof of
5252 certification under Article 58.059, Code of Criminal Procedure;
5353 (9) a federal judge, a federal bankruptcy judge, a
5454 marshal of the United States Marshals Service, a state judge, or a
5555 family member of a federal judge, a federal bankruptcy judge, a
5656 marshal of the United States Marshals Service, or a state judge;
5757 (10) a current or former district attorney, criminal
5858 district attorney, or county or municipal attorney whose
5959 jurisdiction includes any criminal law or child protective services
6060 matters;
6161 (11) a current or former employee of a district
6262 attorney, criminal district attorney, or county or municipal
6363 attorney whose jurisdiction includes any criminal law or child
6464 protective services matters;
6565 (12) an officer or employee of a community supervision
6666 and corrections department established under Chapter 76,
6767 Government Code, who performs a duty described by Section 76.004(b)
6868 of that code;
6969 (13) a criminal investigator of the United States as
7070 described by Article 2.122(a), Code of Criminal Procedure;
7171 (14) a current or honorably retired police officer or
7272 inspector of the United States Federal Protective Service;
7373 (15) a current or former United States attorney,
7474 assistant United States attorney, federal public defender, deputy
7575 federal public defender, or assistant federal public defender and
7676 the spouse and child of the attorney or public defender;
7777 (16) a current or former employee of the office of the
7878 attorney general who is or was assigned to a division of that office
7979 the duties of which involve law enforcement;
8080 (17) a medical examiner or person who performs
8181 forensic analysis or testing who is employed by this state or one or
8282 more political subdivisions of this state;
8383 (18) a current or former member of the United States
8484 armed forces who has served in an area that the president of the
8585 United States by executive order designates for purposes of 26
8686 U.S.C. Section 112 as an area in which armed forces of the United
8787 States are or have engaged in combat;
8888 (19) a current or former employee of the Texas
8989 Juvenile Justice Department or of the predecessors in function of
9090 the department;
9191 (20) a current or former juvenile probation or
9292 supervision officer certified by the Texas Juvenile Justice
9393 Department, or the predecessors in function of the department,
9494 under Title 12, Human Resources Code;
9595 (21) a current or former employee of a juvenile
9696 justice program or facility, as those terms are defined by Section
9797 261.405, Family Code;
9898 (22) a current or former employee of the Texas Civil
9999 Commitment Office or the predecessor in function of the office or a
100100 division of the office;
101101 (23) a current or former employee of a federal judge or
102102 state judge;
103103 (24) a current or former child protective services
104104 caseworker, adult protective services caseworker, or investigator
105105 for the Department of Family and Protective Services or a current or
106106 former employee of a department contractor performing child
107107 protective services caseworker, adult protective services
108108 caseworker, or investigator functions for the contractor on behalf
109109 of the department;
110110 (25) an elected public officer; [and]
111111 (26) a firefighter or volunteer firefighter or
112112 emergency medical services personnel as defined by Section 773.003,
113113 Health and Safety Code; and
114114 (27) a customs and border protection officer or border
115115 patrol agent of United States Customs and Border Protection.
116116 SECTION 2. This Act takes effect immediately if it receives
117117 a vote of two-thirds of all the members elected to each house, as
118118 provided by Section 39, Article III, Texas Constitution. If this
119119 Act does not receive the vote necessary for immediate effect, this
120120 Act takes effect September 1, 2023.
