55 A JOINT RESOLUTION
66 proposing a constitutional amendment relating to the right to own,
77 hold, and use a mutually agreed upon medium of exchange.
88 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Article I, Texas Constitution, is amended by
1010 adding Section 36 to read as follows:
1111 Sec. 36. The right of the people to own, hold, and use a
1212 mutually agreed upon medium of exchange, including cash, coin,
1313 bullion, digital currency, or privately issued scrip, when trading
1414 and contracting for goods and services shall not be infringed. No
1515 government shall prohibit or encumber the ownership or holding of
1616 any form or amount of money or other currency. Nothing in this
1717 section shall be construed as restricting this state from choosing
1818 the medium of exchange the state will accept for payments made to
1919 the state.
2020 SECTION 2. This proposed constitutional amendment shall be
2121 submitted to the voters at an election to be held November 7, 2023.
2222 The ballot shall be printed to permit voting for or against the
2323 proposition: "The constitutional amendment recognizing the right
2424 of the people to own, hold, and use a mutually agreed upon medium of
2525 exchange, including cash, coin, bullion, digital currency, or
2626 privately issued scrip."
