66 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
77 SECTION 1. This Act may be cited as the Alan Vera Memorial
88 Act.
99 SECTION 2. Section 18.062, Election Code, is amended to
1010 read as follows:
1111 Sec. 18.062. INTERSTATE VOTER REGISTRATION CROSSCHECK
1212 PROGRAM. (a) To maintain the statewide voter registration list
1313 and to prevent duplication of registration in more than one state or
1414 jurisdiction, the secretary of state shall:
1515 (1) cooperate with other states and jurisdictions to
1616 develop systems to compare voters, voter history, and voter
1717 registration lists to identify voters:
1818 (A) whose addresses have changed;
1919 (B) who are not qualified under Section
2020 11.002(a)(4); or
2121 (C) who are registered to vote in more than one
2222 state; or
2323 (2) identify and contract with the provider of a
2424 private sector data system to identify voters:
2525 (A) whose addresses have changed;
2626 (B) who are registered to vote in more than one
2727 state;
2828 (C) who are deceased; or
2929 (D) who are not qualified under Section
3030 11.002(a)(4).
3131 (a-1) A private sector data system under Subsection (a)(2)
3232 must have demonstrated an ability to work with registered voter
3333 identification and matching systems.
3434 (b) A system developed under this section and any vendor
3535 involved with the system must comply with:
3636 (1) the National Voter Registration Act of 1993 (52
3737 U.S.C. Section 20501 et seq.) and the Help America Vote Act of 2002
3838 (52 U.S.C. Section 20901 et seq.); and
3939 (2) all state and federal laws relating to the
4040 protection of personal information.
4141 (c) The cost to begin operations with a system under
4242 Subsection (a)(2) may not exceed $100,000.
4343 (d) The cost of continuing operations with a system under
4444 Subsection (a)(2) may not exceed one dollar for each voter
4545 identified under Subsection (a)(2).
4646 (e) The secretary of state may not provide to a system under
4747 Subsection (a)(2) any information that is not:
4848 (1) found in a voter roll; and
4949 (2) necessary to identify voters under Subsection
5050 (a)(2).
5151 (f) The secretary of state shall record information related
5252 to the system under Subsection (a)(2) and shall submit to the
5353 legislature a report on that information not later than the first
5454 day of each quarter of the state's fiscal year.
5555 (g) A contract with a system under Subsection (a)(2) may not
5656 require any additional duty of the state not required by this
5757 section.
5858 (h) The secretary of state may not contract with a private
5959 sector data system under Subsection (a)(2) unless the system:
6060 (1) requires a background check for each employee of a
6161 potential vendor for the system; and
6262 (2) uses data from the National Change of Address
6363 database.
6464 (i) In addition to using a system described by Subsection
6565 (a), the secretary of state shall use data from the National Change
6666 of Address database to identify voters whose addresses have changed
6767 for the purpose of preventing duplication of registration in more
6868 than one state or jurisdiction.
6969 SECTION 3. This Act takes effect September 1, 2023.
