6 | 6 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

7 | 7 | | SECTION 1. This Act may be cited as the Alan Vera Memorial |
---|
8 | 8 | | Act. |
---|
9 | 9 | | SECTION 2. Section 18.062, Election Code, is amended to |
---|
10 | 10 | | read as follows: |
---|
11 | 11 | | Sec. 18.062. INTERSTATE VOTER REGISTRATION CROSSCHECK |
---|
12 | 12 | | PROGRAM. (a) To maintain the statewide voter registration list |
---|
13 | 13 | | and to prevent duplication of registration in more than one state or |
---|
14 | 14 | | jurisdiction, the secretary of state shall: |
---|
15 | 15 | | (1) cooperate with other states and jurisdictions to |
---|
16 | 16 | | develop systems to compare voters, voter history, and voter |
---|
17 | 17 | | registration lists to identify voters: |
---|
18 | 18 | | (A) whose addresses have changed; |
---|
19 | 19 | | (B) who are not qualified under Section |
---|
20 | 20 | | 11.002(a)(4); or |
---|
21 | 21 | | (C) who are registered to vote in more than one |
---|
22 | 22 | | state; or |
---|
23 | 23 | | (2) identify and contract with the provider of a |
---|
24 | 24 | | private sector data system to identify voters: |
---|
25 | 25 | | (A) whose addresses have changed; |
---|
26 | 26 | | (B) who are registered to vote in more than one |
---|
27 | 27 | | state; |
---|
28 | 28 | | (C) who are deceased; or |
---|
29 | 29 | | (D) who are not qualified under Section |
---|
30 | 30 | | 11.002(a)(4). |
---|
31 | 31 | | (a-1) A private sector data system under Subsection (a)(2) |
---|
32 | 32 | | must have demonstrated an ability to work with registered voter |
---|
33 | 33 | | identification and matching systems. |
---|
34 | 34 | | (b) A system developed under this section and any vendor |
---|
35 | 35 | | involved with the system must comply with: |
---|
36 | 36 | | (1) the National Voter Registration Act of 1993 (52 |
---|
37 | 37 | | U.S.C. Section 20501 et seq.) and the Help America Vote Act of 2002 |
---|
38 | 38 | | (52 U.S.C. Section 20901 et seq.); and |
---|
39 | 39 | | (2) all state and federal laws relating to the |
---|
40 | 40 | | protection of personal information. |
---|
41 | 41 | | (c) The cost to begin operations with a system under |
---|
42 | 42 | | Subsection (a)(2) may not exceed $100,000. |
---|
43 | 43 | | (d) The cost of continuing operations with a system under |
---|
44 | 44 | | Subsection (a)(2) may not exceed one dollar for each voter |
---|
45 | 45 | | identified under Subsection (a)(2). |
---|
46 | 46 | | (e) The secretary of state may not provide to a system under |
---|
47 | 47 | | Subsection (a)(2) any information that is not: |
---|
48 | 48 | | (1) found in a voter roll; and |
---|
49 | 49 | | (2) necessary to identify voters under Subsection |
---|
50 | 50 | | (a)(2). |
---|
51 | 51 | | (f) The secretary of state shall record information related |
---|
52 | 52 | | to the system under Subsection (a)(2) and shall submit to the |
---|
53 | 53 | | legislature a report on that information not later than the first |
---|
54 | 54 | | day of each quarter of the state's fiscal year. |
---|
55 | 55 | | (g) A contract with a system under Subsection (a)(2) may not |
---|
56 | 56 | | require any additional duty of the state not required by this |
---|
57 | 57 | | section. |
---|
58 | 58 | | (h) The secretary of state may not contract with a private |
---|
59 | 59 | | sector data system under Subsection (a)(2) unless the system: |
---|
60 | 60 | | (1) requires a background check for each employee of a |
---|
61 | 61 | | potential vendor for the system; and |
---|
62 | 62 | | (2) uses data from the National Change of Address |
---|
63 | 63 | | database. |
---|
64 | 64 | | (i) In addition to using a system described by Subsection |
---|
65 | 65 | | (a), the secretary of state shall use data from the National Change |
---|
66 | 66 | | of Address database to identify voters whose addresses have changed |
---|
67 | 67 | | for the purpose of preventing duplication of registration in more |
---|
68 | 68 | | than one state or jurisdiction. |
---|
69 | 69 | | SECTION 3. This Act takes effect September 1, 2023. |
