| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 541.201(9), Transportation Code, is |
|---|
| 10 | 10 | | amended to read as follows: |
|---|
| 11 | 11 | | (9) "Motorcycle" means a motor vehicle[, other than a |
|---|
| 12 | 12 | | tractor or moped,] that, as originally manufactured: |
|---|
| 13 | 13 | | (A) is equipped with a seat or [rider's] saddle |
|---|
| 14 | 14 | | that requires the rider to sit astride; |
|---|
| 15 | 15 | | (B) is [and] designed to operate on [have when |
|---|
| 16 | 16 | | propelled] not more than three wheels in contact with [on] the |
|---|
| 17 | 17 | | ground; |
|---|
| 18 | 18 | | (C) uses handlebars for steering; |
|---|
| 19 | 19 | | (D) uses handlebars and foot controls for |
|---|
| 20 | 20 | | acceleration and braking; and |
|---|
| 21 | 21 | | (E) is capable of reaching a speed of more than 30 |
|---|
| 22 | 22 | | miles per hour. |

| 23 | 23 | | SECTION 2. This Act takes effect September 1, 2023. |
