A BILL TO BE ENTITLED
AN ACT
relating to the definition of a motorcycle.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 541.201(9), Transportation Code, is
amended to read as follows:
(9) "Motorcycle" means a motor vehicle[, other than a
tractor or moped,] that, as originally manufactured:
(A) is equipped with a seat or [rider's] saddle
that requires the rider to sit astride;
(B) is [and] designed to operate on [have when
propelled] not more than three wheels in contact with [on] the
ground;
(C) uses handlebars for steering;
(D) uses handlebars and foot controls for
acceleration and braking; and
(E) is capable of reaching a speed of more than 30
miles per hour.
SECTION 2. This Act takes effect September 1, 2023.
